Members present: Councilmen Schnirring, Kramer, Hallberg, O'Connor, Fischer, Driscoll, Novak and Mayor Petersen. r j Members absent: Councilman Collins. Minutes of the last meeting were read and approved. Councilman Driscoll introduced the following resolution and moved its adoption: RESOLUTION ON TECHNICAL SERVICE AGREEMENT #- / WITH MINNESOTA HIGHWAY DEPARTMENT BE IT RESOLVED, that pursuant to statutory authority, that DuWayne Kasma of To1tz, King, Duvall, Anderson and Associates, for and on behalf of the City of Hastings is hereby authorized to request and obtain from the Minnesota Department of Highways, needed engineering and technical service during the year of 1973; for which ent will be made by the City of Hastings upon receipt of verified c1ai from e Commissioner of High- ways. Regina Memorial Hospital Hastings Country Club Larry's Bierstube Tom's Shell Oil Gregory's Onion Ring Rother's Skelly Service Eddy's Cafe m6 ;.37(., Councilman Novak introduced the following resolution and moved its adoption: &'t' RESOLUTION TO AGREE TO PARTICIPATE IN THE MINNESOTA HIGHWAY SAFETY PROGRAM PROJECT FOR CORRECTING REGULATORY AND WARNING TRAFFIC SIGN DEFICIENCIES WHEREAS, under the Federal Highway Safety Act of 1966, on of the objectives set forth by the Department of Transportation is the conformance of all traffic control devices to the National Manual on Uniform Traffic Control Devices for Streets and Highways; and WHEREAS, funds are available through the Federal Highway Adminis- O. tration for the replacement of non-standard devices; and WHEREAS, the City of Hastings is desirous of bringing the traffic control devices on street and roads under its jurisdiction into conformance with National standards; NOW, THEREFORE, (1) It is hereby agreed that the City of Hastings will remove, replace, or install all regulatory and warning signs necessary to comply with National standards as determined through an inventory of inplace signs and a survey of needed additional signs. Such removal, replacement, or installation to be done by the City of Hastings on all streets and roads under its jurisdic- tion and completed by June 30, 1975. (2) The State of Minnesota, Department of Highways, will review the work done and certify to the Federal Highway Administration satisfactory com- pletion for reimbursement from available Federal Highway Safety Funds for the cost of such work in accordance with conditions set forth in the Project Description and the attached estimate of costs. Such reimbursement to be applicable only to the work done on the non-Federal Aid Portion of the street and road system by June 30, 1974. Moved by Councilman Driscoll, seconded by Councilman Hallberg to refer to the Planning Commission the Petition of Al~and Lucille Sieben for annexation of property to the City of Hastings, within Marshan Township abutting the existing boundary of the corporate limitsof the City. Ayes; all, Nayes; none. Moved by Councilman Kramer, seconded by Councilman Hallberg that the following abatement, as recommended by the County Assessor be approved. Ayes; all, Nayes; none. Real Estate Parcel #11908 Hancock and Thomas Addition., should have been classified as homestead with Parcel #12118 but did not through an error in posting. Reduce assessed value from $129.00 to $120.00 The Mayor recommended the appointment of Ted Riches to the Police 0 Civil Service Commission for a term of three years.~expiring Nov. 1, 1976 . Moved by Councilman Novak, seconded by Councilman Driscoll to ratify the Mayor's appointment. Ayes; all, Nayes; none. Moved by Councilman Schnirring, seconded by Councilman Kramer to approve the expenses for Officer Hillmer and Wasylik to attend the Juvenile Officers Institute to be conducted in Rochester on January 30, 31, and February 1st. Ayes; all, Nayes; none. ~ /..3 77 Councilman O'Connor introduced the following resolution and moved its-adoption: RESOLUTION RECEIVING PRELIMINARY REPORT AND ~ ~ SETTING PUBLIC HEARING ON PROPOSED IMPROVEMENTS WHEREAS, a preliminary report has been prepared by the Acting City Engineer with respect to the improvements described in the Notice of Hearing hereinafter set forth, and ,..-. WHEREAS, sAid Engineers have advised this Council that the aforesaid improvements are feasible and should be made as proposed in the Notice of Hearing thereon, and WHEREAS, the Council considers it expedient to make the follow- ing listed improvements, NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings, Minnesota, as follows: 1. Such Feasibility Reports are hereby accepted and approved. 2. Said Improvements are hereby combined and designated 1974 Improvements and shall be undertaken pursuant to the provisions of Chapter 429, Minnesota Statutes 1961. 3. A Public Hearing relative to said improvements will be held on February 25, 1974 at 7:00 o'clock P.M. in the Council Chambers of the City Hall for the consideration of said im- provements, the nature of which, the estimated cost thereof, the area proposed to be assessed therefore, are described in the Notice of Hearing which shall be in substantially the following form and is made a part thereof. r- I Notice is hereby given that the City Council of the City of Hastings, Minnesota, will meet in the Council Chambers of the City Hall at 7:00 o'clock P.M. on Monday, February 25, 1974 to consider the following improvements designated Improvements 1974: PROPOSAL I BITUMINOUS SURFACING CONCRETE. CURB AND GUTTER AND SIDEWALK 1. North Frontage Road from Pleasant Drive to T.H. 55 West of Courthouse entrance. 2. Brittany Road and the Easterly 880ft of 14th Street within Sontag's Second Addition. 3. Westview Drive from 14th Street to T.H. 55. 4. Bah1's Drive from Park Lane to the North line of Lot 7, Block 2, Valley Manor Addition. 5. Louis Lane within Country Club Second Addition and 19th Street from Pine Street to Louis Lane. 6. Eddy Street, 16th Street and Spring Street from 15th Street to 17th Street. r- I I 7. 20th Street from CSAH 47 to Eddy Street. 8. CSAH 42 from 2nd Street to the Hospital entrance. 9. Pleasant Drive within Bauer's Second Addition from Honeysuckle Lane to T.H. 55. ~ /.J 7f 2. 13th Street east of Westview Drive, 13th Place, un-named Street, 13th Street west of Westview Drive and Honeysuckle Lane from 13th to 14th Street, all within Dakota Hills 4th Addition. 3. Eddy Street, 16th Street & Spring Street between 15th and 17th Streets. 4. Sixth Street from Forest Street to Pine Street. 5. 16th Street east from Pine Street. 6. Storm Sewer as determined by Studies. STATE-AID PROJECT II 7. South Frontage Road, Prairie Street to Pine Street. 1. Pleasant Drive within Bauer's Second Addition - Street Grading, Gravel Base and Storm Sewer. 2. 15th Street from Ashland to Pine Street - Street widening with concrete curb and gutter and concrete sidewalk construction. 3. 15th Street, Pine Street to Westview Drive - Street widening with concrete curb and gutter and sidewalk (concrete) construction. STATE HIGHWAY TURNBACK PROJECT 1. 10th Street from Vermillion Street to Lea Street - Street Re-construc- tion with concrete curb and gutter, Bituminous surfacing and Storm Sewer Extension. The City Council proposes to assess all or part of the cost for such improvements against every lot, piece or parcel of land within the Corpor- ate Limits that abuts upon said improvements according to the special benefits received without regard to cash valuation. The estimated cost of said improvements is $825,000.00 o Persons desiring to be heard in reference to the proposed improve- ments may be heard at said time and place. Dated this 7th day of January, 1974. The City Clerk is hereby authorized and directed to cause said notice to be given two publications in the official newspaper and to give mailed notice to every property owner whose property is benefited by said improvements. Such publications shall be one week apart and at least three days shall elapse betwe e last publication and the date of hearing. Mailed notice shall e gi en not less than ten days before the hearing, pursuant to provis ons Section 429.031 Minnesota Statutes. Moved by Councilman Novak, seconded by Councilman Driscoll that the request for a Special Use Permit from Mikel Wheeler and Sandy Kilbride to operate a Craft and Hobby Shop at 422 W. 6th. St. be referred to the Planning Commission. Ayes; all, Nayes; none. o _ J Moved by Councilman Novak, seconded by Councilman Fischer to pass the first reading of an Amendment to the Ordinance governing the licensing of Sauna; Massage Parlor (City Code Section 5.70) as follows: ~ /J71 increase the Annual Fee for either or both to $2,500.00, requiring the employment of only licensed Massuers and Masseure, of limiting hours of operation to 8:00 A.M. - 1:00 A.M., prescribing sanitary conditions, pre- scribing minimum age requirements, prescribing conditions for granting and rescinding licenses and impresingeadditional requirements. Councilman O'Connor introduced the following resolution and moved its adoption: r-- RESOLUTION DECLARING ADEQUACY OF PETITION 4f If AND ORDERING PREPARATION OF REPORT BE IT RESOLVED, by the City Council of Hastings, Minnesota: 1. A certain petition requesting the improvement of the following street: Part of Lot 2 & all of Lots 3 & 4 inclusive in Block 3, Town of Hastings. Improve into a public parking facility with surfacing, striping, lighting, signs, landscaping and walkway. 2. This Petition is hereby referred to the City Engineer and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whe r the proposed improvements are feasible and as to whether it should est b made as proposed or in connection with some other improvement and the e timated cost of the im- provement as recommended. Moved by Councilman Driscoll, seconded by Councilman Novak that the letter from Roger Haugen of the First National Bank requesting a Variance to improve the water and sewer system on the Prano property at 1005 E. Second Street be referred to the Engineer for study and report to the City Council with his findings. Ayes; all, Nayes; none. Moved by Councilman Hallberg, seconded by Councilman Driscoll that the Acting Engineer be authorized to perform a Feasibility Study for a Sanitary Sewer to serve the area South of T.H. #55 between Prairie and Pine Street. Ayes; all, Nayes; none. Moved by Councilman Fischer, seconded by Councilman Novak that the owner of the property at 802 Pine Street be allowed to upgrade the existing private sewer system to perform adequately until such time the Sanitary Sewer service becomes available, subject to submitting a letter stating that the service for this property will be connected to the City System when it becomes available. Ayes; all, Nayes; none. Fire Chief Latch then presented to the Council the following letters, from Volunteer Fireman Gerald E. Lucking and Eugene Kasel, tender- ing their resignations from the Volunteer Fire Department: r--I I December 11, 1973 Hastings Fire Department Attn: Chief Latch It is with regret I write this letter to {the City of Hastings and the Hastings Fire Department. Due to my work commitments, I find that it is next to impossible to attend the Fire Department Drills, Schools, and the Fire duty. I do not think it is fair to my fellow firemen if I remain on the Department under these conditions. ~ /.38'0 If, at a later date there is an opening on the Fire Department, and I find less demand on my free time, I would like your consideration for a position on the force at that time. Honorable Mayor, City of Hastings Members of City Council, City of Hastings u To: Mr. Clarence Latch, Fire Chief, City of Hastings. I would like to apply for termination with the Hastings Fire Department and Hastings Fire Department Relief Association in accordance with their Constitution and By-Laws. In particular under Article VII, Benefits, Section 9. My service record with the Hastings Volunteer Fire Department dates back to August of 1959. As you mayor may not know in September of 1967 I underwent an operation for the removal of the lower lobe of my left lung due to a Fungus infection. This had been preceeded by a year of doubt and uncertainty. Iv'e also been prone to Hernias of which I've had two. The most recent repair was in September of this year. Bearing these factors in mind I felt it was in my best interest to consult my doctor with regard to the feasability of con- tinuing service with the Hastings Volunteer Fire Department. Street Hastings, Minnesota Birth Date: 12-11-33 To whom it may concern: This patient consulted me on October 12, 1973, regarding his ability to continue as a member of your department. It was my conclusion that it would be better for him to be relieved of his duties at the Hastings Fire Department. His history indicates that he had a portion of one lung removed in 1967. He has functioned reasonably well since that time. However, it is now quite apparent that he has a tendency to tire extremely easily. He also has noted that he simply does not have the lung capacity that would be required to continue to carryon his duties in the department. It is not unlikely that, if he were to inhale a great deal of smoke he could suffer rather severe damage to the lungs on a permanent basis. The patient has also had two operations for hernia's. The most recent operation was in September, 1973. o It is my opinion, inspite of the fact that Mr. Lucking looks to be in good health, that he does run a very definite risk as far as his health is concerned on a long term basis if he continues with the department. It is, therefore, my recommendation that his association with the Hastings Fire Department be terminated on a permanent basis. Respectfully, s/ L. N. Dale Lester N.
