The City Council of the City of Hastings, Minnesota met in a
regular meeting on Tuesday, February 19, 1974 at 8:00 o'clock P.M. in
the Council Chambers of the City Hall.
Members present: Councilmen Collins, Schnirring, Kramer, Hallberg,
O'Connor, Fischer, Driscoll, Novak and Mayor
Petersen.
Members absent: None.
Minutes of the last meeting were read and approved.
Moved by Councilman O'Connor, seconded by Councilman Driscoll to
pass the third and final reading of the following:

IN THE CITY OF HASTINGS
BE IT ORDAINED BY THE CITY COUNCIL_aFTHE CITY OF HASTINGS,
AS FOLLOWS:
WHEREAS, a uniform system of street names is desirable; and
WHEREAS, certain numbered streets in the City are not presently
numbered consistent with the designation of other numbered streets in the
City;
NOW, THEREFORE BE IT ORDAINED:

That the east-west street centered generally along the center line
of Section 34 is designated Twenty First Street.

Chapter 11 of the City Code, Subdivision Regulation (Platting)
is hereby amended as follows:
Chapter 11 and in particular Section 11.06, Subdivision 3, is
hereby amended by adding thereto the following:
Subdivision 6:
The City Council may, as a condition to acceptance of
a Petition for Improvements, require the petitioner to
provide the City Engineering Department with a true
copy of the recorded plat or plats of the area wherein
the improvement is to be constructed.

shall be punished as for a misdemeanor.

ORDINANCE AMENDING CHAPTER 12 OF THE CITY CODE
UTILITIES, by amending the provision relating to remote reading type meters.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS,
AS follows:
Chapter 12 of the City Code, Utilities, and in particular Section
12.71, Subdivision 2, is hereby amended so as to read as follows:

Subdivision 2 - Sir charge.
Any consumer, using the one inch size water meter, or

smaller, and not having a remot~type meter readable
from the exterior of the dwelling, shall pay a water
sir charge of one dollar ($1.00) per quarter. Provided,
that sir charge shall not be effective until January 1,
1978. The City shall install remote reading devices on
all ur;a;Be meters of one inch size or smaller, and the
owner of the property shall pay therefor the sum of ($10.00)
as partial reimbursement to the city for the expense in-
curred in installing said remote reading meter.

Moved by Councilman Novak to amend the motion adopting the rates
for Ambulance services to read; City rate be reduced from $25.00 to $20.00.

adopt the following schedule of charges for Ambulance Services effective as
of March 1, 1974. Ayes, Councilmen Collins, Schnirring, Kramer, Hallberg,

Re: "Home Occupations"
Dear Mayor and Council:
Indiscussing this problem, we are concerned with five of the zones
established by the zoning ordinance, contained in Chapter 10 of the City
Code. They are the Agricultural Zone and the four Residential Zones. You
will find them described on pages 42 through 45 of Chapter 10.

You will note that in the Agricultural Zone, under Permitted Uses,
provision is made for "Customary Home Occupations" which are then described
to some extent.
In the R-l Zone, "Home Occupations" are allowed as permitted uses.
Gift or craft shops and similar uses of a public service nature are allowed
by special use permits.
In the R-2 Zone, gift or craft shops and similar uses of a public
service nature are allowed uses as are repairmen and nursing homes, pro-
fessional offices, day care centers, and old age homes.

In the R-4 Zone, the permitted uses are the same as in an R-3 Zone.
At the time the current zoning ordinance was adopted in 1970, there
was a substantial amount of discussion with reference to these items. I
feel that in view of having had several years experience with these provi-
sions, the Council should now take another look at these "quasi-commercial
activities" allowed with or without permit, in residential zones.
It is my recommendation that with reference to all five zones re-
ferred to above, these uses be allowed only by special permit. In this way
the City Council would have an opportunity to review the anticipated use
and impose reasonable restrictions with reference to it. Should the Council
decide to allow a specific use pursuant to a special use permit, an appropri-
ately drawn licensing ordinance would call for annual review to make sure
that there are not traffic problems and other problems of a like nature
created by the use. It is my thought that the licensing ordinance would
anticipate review of the various items included in the definition of "home
occupation" found in the definition section of the City Code, as well as
the various restrictions scattered through the definitio~s of the various
sections found on pages 42 through 45.

I feel that the foregoing recommendations, if adopted, wonld not be
implementing any restrictions that do not already exist in one or another
section of the zoning chapter, but it would make the requirements more uni-
form, more understandable, and therefore more enforceable.

the City Clerk be authorized to hire an Appraiser to appraise the property
in that portion of Vermillion ~~er Parkway west of TH 61 plus that part of
Nowicki property lying easterly of a line commencing at a point on the center
line of CSAH 47, 200 feet West of the Vermillion River bridge and running
south co the corporate limits, and to check with the County Engineer regard-

AN ORDINANCE REGULATING THE USE OF MOTOR ~ '\
VEHICLES ON PUBLIC PROPERTY, EXCEPT STREETS,
SEMI-PUBLIC PROPERTY, AND PRIVATE PROPERTY IN
THE CITY OF HASTINGS.
The City Council of the City of Hastings does ordain:

Section 7.65. Regulation of Motor Vehicles on Public, Semi-public
and private property.
Subdivision 1. Definitions. The following terms shall have the
indicated meanings when used in this ordinance.
A. Motor Vehicles. Self-propelled motorized vehicles,
whether or not licensed by the State of Minnesota, in-
cluding automobiles, trucks, motorcycles, motor bikes,
motor scooters and mini bikes (but specifically exclud-
ing snowmobiles as defined by City Code.)
B. Public Property: Property owned by a governmental

body that may be used by the public, subject to reason-
able regulations by the government body, including:
public parks; county, city and school parks, grounds,
yards and parking lots, but excluding state, city and
county streets and roads.
c. Semi-Public Property: privately owned property,
generally open for use by the public, including commercial
and institutional parking lots and other property generally
used by patrons of a commercial business or institution.
D. Private Property: Property, whether owned by govern-
ment unit or private persons or corporations, not open for
use by the public, including yards of residences, apart-
ment buildings, industrial and commercial locations and
railroad property.
E. Parking Lots: Areas designated for parking of motor
vehicles.
Subdivision 2. It is hereby declared unlawful for any person to
operate a motor vehicle:
a. On private property of one other than the owner with-
out express permission of owner.
b. On public property (excluding parking lots) unless
area is expressly posted to allow said use by governmental
unit having control of area in which case operation thereon
shall comply with all posted restrictions and regulations.
c. On semi-public property (except parking lots) unless
expressly authorized by owner.
d. On parking lots (i) at speeds exceeding 15 miles an
hour (ii) contrary to posted instructions and directions.
e. On public semi-public and private property (i) at unsafe
speeds;~(ii) in a careless manner (iii) while under the in-
fluence of an alcoholic beverage or narcotic drug or combin-
ation thereof (iv) at speeds exceeding 15 miles per hour.
f. On public, semi-public or private property so as to
create or cause unnecessary engine noises or tire squeal or
so as to cause the tires to spin or slide upon the accelera-
.tion or stopping of said vehicle or so as to cause the motor
vehicle to turn abruptly of~s~erve from side to side or so as
to create a substantial liklihood of damage to person or
property.
g. On a public sidewalk or boulevard.
h. On any public, semi-public or private property (except
parking lots) during the hours from 10:00 P.M. to 8:00 ~.M.
Subdivision 3. Equipment. It is unlawful to operate a motor
vehicle on public, private or semi-public property unless equipped as
follows:
a. With standard mufflers which are properly attached and
which reduce the noise of operation of the motor vehicle
to the minimum necessary for operation. No muffler cutouts,
by-passes, straight pipes or similar devices shall be allowed.
b. Without brakes adequate to control the movement of and to
stop and hold the vehicle.
c. Without a "deadman" throttle which when pressure is removed
will cause the motor to be disengaged from the drive system.

Subdivision 4. It is unlawful to chase, drive after, run over,
kill or injure any animal with a motor vehicle.
Subdivision 5. Penalty. It is a misdemeanor to violate any
provision of this ordinance.
This ordinance shall become effective upon passage and publication
according to law.
The next item for consideration was a report from the committee
previously established by council resolution to recommend criteria and
other matters regarding the City Administrator's position. Mr. Fluegel
gave the report of the committee.

He stated that the criteria recommended by the committee was as
follows: Bachelors Degree in public administration or related field re-
quired, with Masters Degree in public administration or related field
desired. Three years governmental experience required, preferrable as
City Administrator or Assistant City Administrator with broad spectrum
of experience. Salary range left open to be commensurate with qualifi-
cations and experience. Employment Agreement to be available to applicant
selected. Position immediately open. The advertisement for applicants is
to contain foregoing information, to provide that resumes are to be sent
to Mr. Fluegel and that the ad would further contain the name of the City,
population of the City, the fact that it has a 1.1 million operating budget
and a 4.5 million improvement budget, approximately 53 employees and location
25 miles from St. Paul/Minneapolis.
That ads would be placed in the International City Managers Associa-
tion newsletter and the League of Minnesota Municipalities Magazine. Further
that a copy of the ad would be forwarded to the personnel director of the
League of Municipalities and the Secretary of the Metropolitan Managers
Association for distribution to anyone interested that comes to their atten-
tion. Further that personal contacts were to be made by council members
who are aware of persons qualified that might be interested in the position.
That after the resumes have been received, the committee will review them
and obtain, if necessary additional information from applicants. Further l~.,i~'
that the committee may hire a consultant and expend up to $100.00 in City
funds for review of the applicants by the consultant. That the committee would ~J
notify the council that applicants resumes were on file for review by the
entire council as desired. The committee would recommend final applicants
and review them with the council along with any other applicants designated
as final applicants by the council. That after a final list of applicants
is so determined, they would be invited to meet with the council for per-
sonal interviews.
Councilman Kramer moved and Councilman Driscoll seconded a motion
to approve the committee's report as given, to authorize the committee to
proceed as outlined, and to authorize expenditure of up to to $100.00 of
City funds for consultant services in connection with screening applicants.
Upon being put to a vote, the motion was unanimously carried.

pass the first reading of an Amendment to Section 4.15 of the City Code.
