April 1, 1974
The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, April 1, 1974 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Collins, Schnirring, Kramer, Novak,
Hallberg, O'Connor, Fischer, Driscoll and
Mayor Petersen.
Members absent: None.
Moved by Councilman Kramer, seconded by Councilman Driscoll to
accept the minutes of the March 18, 1974 meeting. Ayes, all; Nayes, none.
Councilman Schnirring introduced the following resolution and
moved its adoption:
BIDS ON CHLORINATION ROOM ADDITION TO SWIMMING POOL ~/1

WHEREAS, pursuant to an advertisement for bids for furnishing
the City with a Chlorination Room Addition to Swimming Pool Filter Room, the

responsible bidder, Item 111, $6,311 & Item 112-A, $4,940, Total Bid $11,261.00
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Hastings, Minnesota:
1. The Mayor and City Clerk are hereby authorized and directed
to enter into a contract with Rumpza Builders for the construction of a
Chlorination Room Addition according to the specifications therefore approved
by the City Council and on file in the office of the City Clerk.

Councilman Hallberg seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, all; Nayes, none.

(~ Moved by Councilman Novak, seconded by Councilman Kramer that the
\ Bids that were opened on March 29, 1974 for the Ice Arena be held over until
the meeting of April 15, 1974. Ayes, all; Nayes, none.
The Mayor declared open the Public Hearing on Smead Mfg. Company's
request for a variance to allow barbed wire fence around propane tanks, as
required by the Ordinance, Section 5.6, Fences, Walls and Hedges.
No one appeared in opposition to the Variance, the Mayor declared
the Hearing closed.
Moved by Councilman Kramer, seconded by Councilman Hallberg to
approve the Variance for Smead Mfg. Company, in accordance with Section 5.6
of the Zoning Ordinance dated December 7th, 1970. Ayes, all; Nayes, none. ,~~
The Mayor declared open the Public Hearing on Our Saviour's
Lutheran Church Variance request to construct the new building within 4 feet
of the rear property line, north of the Alley side of Lot 6, Block 65,
Original Town of Hastings, as required by the Ordinance. Section 9.15 District
Lot Regulations.
No one appeared in opposition to the Variance, the Mayor declared
the Hearing closed.
Moved by Councilman Hallberg, seconded by Councilman Fischer to
approve the Variance for Our Saviour's Lutheran Church, in accordance with
Section 9.15 of the Zoning Ordinance dated December 7th, 1970. Ayes, all;
Nayes, none.
Moved by Councilman Schnirring, seconded by Councilman Fischer
that the City Clerk and City Attorney be authorized to solicit six months
options on the Hagen property and Peavey Mill property along the Vermillion
River, East of Trunk Highway #61, as appraised by Chandler-Davis. Ayes, all;
Nayes, none.
Moved by Councilman Novak, seconded by Councilman Driscoll that
the following abatements, as recommended by the County Assessor be approved. I

Outlot "E" Whispering Oaks Addition is Ponding Area owned by the
City of Hastings and is exempt from taxation, assessed in error, reduce
assessed value to Nil.
Ex. 61 feet of Lot 3, Block 9, all of Lot 4, Block 9, Allisons Add.
was assessed as Commercial/Industrial and Residential. Should have been
assessed only Residential, it is Residential property. Reduce Commercial/
Industrial valuation to Nil.

to the Planning Commission Wayne W. Walk's request for permission to erect a
permanent fireplace on his property at 1358 W. 18th. Street, Hastings, Mn.

Moved by Councilman Driscoll, seconded by Councilman Schnirring to
approve the mileage rate increase from l2~ to l5~ per mile, pursuant to Minn.
Laws of 1974, Chapter 143, that City Officials of the City of Hastings be
entitled to a mileage rate not to exceed l5~ per mile for each mile necessarily
traveled on official business within or without the City of Hastings. Ayes, all;
Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman Driscoll that [1[',':"
Nicholas Wasylik, having completed the recommended probationary period, be
appointed to the permanent rank of Patrolman on the Hastings Police Depart-
ment effective April 1, 1974 Ayes, all; Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman Kramer that
the City hire Chandler-Davis, 234 Eddicott Building, St. Paul, MN to appraise
the Parcels along the Vermillion River West of T.H. #61 including a portion
of the Nowicki property as requested by David Pederson. This appraisal to
indicate a breakdown of costs of Flood Way and Non-Flood Way properties.

paSS the second reading of the following Ordinance. Ayes, all; Nayes, none.
AN ORDINANCE REGULATING THE USE OF MOTOR
VEHICLES ON PUBLIC PROPERTY, EXCEPT STREETS,
SEMI-PUBLIC PROPERTY, AND PRIVATE PROPERTY
IN THE CITY OF HASTINGS
The City Council of the City of Hastings does ordain:
Section 7.65. Regulation of Motor Vehicles on Public, Semi-Public
and private property.
Subdivision 1. Definitions. The following terms shall have the
indicated meanings when used in this ordinance.
A. Motor Vehicles. Self-propelled motorized vehicles,
whether or not licensed by the State of Minnesota,
including automobiles, trucks, motorcycles, motor
bikes, motor scooters, minibikes, dune buggies, trail
bikes, go-carts and all terrain vehicles (but specifi-
cally excluding snowmobiles as defined and regulated
by City Code).
B. Public Property: Property owned by a governmental
body that may be used by the public, subject to
reasonable regulations by the government body, in-
cluding: public parks; county, city and school parks,
grounds, yards and parking lots, but excluding state,
city and county streets and roads.

C. Semi-Public Property: privately owned property, gen-
erally open for use by the public, including commercial
and institutional parking lots and other property gen-
erally used by patrons of a commercial business or
institution.
D. Private Property: Property, whether owned by govern-
ment unit or private person or corporations, not open
for use by the public, including but not limited to
yards of residences, apartment buildings, industrial
and commercial locations, railroads, cemeteries, and
golf courses.
E. Parking Lots: Areas designated for parking of motor
vehicles and access and entrance roads used in con-
nection with said parking lots.
Subdivision 2. It is hereby declared unlawful for any person to
operate a motor vehicle:
a. On private property of one other than the owner, and on
semi-public property (except parking lots), without
express permission of owner.
b. On public property (excluding parking lots) unless area
is expressly posted to allow said use by governmental
unit having control of area in which case operation there-
on shall comply with all posted restrictions and regulations.

c. On parking lots and (when authority is granted as above
provided) on public property, semi-public property and
private property.
(i) contrary to posted instructions and directions.
(ii) at unsafe or unreasonable speeds.
(iii) in a careless, reckless or negligent manner so as
to endanger life or property.
(iv) while under the influence of an alcoholic beverage
or narcotic drug or combination thereof.
(v) so as to create or cause unnecessary engine noises
or tire squeal Or so as to cause the tires to spin

or slide upon the acceleration or stopping of said
vehicle or so as to cause the motor vehicle to turn
abruptly or swerve from side to side or so as to
create a substantial likelihood of damage to person
or property.
d. On any public, semi-public or private property (except
parking lots) during the hours from 10:00 P.M. to
8:00 A.M., except that a property owner or persons
specifically authorized by him may operate between
these hours but said operation shall comply with the
prohibition set forth in Subdivision 2 (c).
Subdivision 3. Equipment. It is unlawful to operate a motoe
vehicle on public, private or semi-public property, including parking lots,
unless equipped as follows:

a. With standard mufflers which are properly attached
and which reduce the noise of operation of the motor
vehicle to the minimum necessary for operation. No
muffler cutouts, by-passes, straight pipes or similar
devices shall be allowed.
b. Without brakes adequate to control the movement of
and to stop and hold the vehicle.
c. Without a "deadman" throttle which when pressure is
removed will cause the motor to be disengaged from
the drive system.
d. When operated at night, without at least one clear
lamp attached to the front, with sufficient intensity
to reveal persons and vehicles at a distance of at
least 100 feet ahead during the hours of darkness
under normal atmospheric conditions. Said head1amps
shall be so aimed that glaring rays are not projected
into the eyes of an oncoming vehicle operator. It
shall also be equipped with at least one red tail lamp,
having a minimum candle power of sufficient intensity
to exhibit a red light plainly visible from a distance
500 feet to the rear during the hours of darkness under
normal atmospheric conditions. This equipment shall be
required and shall be in operating condition when the
vehicle is operated during the hours of one-half hour
after sunset to one-half hour before sunrise or at times of
reduced visibility.

Subdivision 4. It is unlawful to chase, drive after, run over, kill
or injure any animal with a motor vehicle.
Subdivision 5. Vehicles not licensed under the laws of the State of
Minnesota may not be operated on parking lots, whether publicly owned or semi-
private property unless specifically authorized by the owner thereof.
Subdivision 6. Helmets required. Persons operating motor vehicles
the operation of which requires the operator to wear a helmet under regulations
of the State of Minnesota and in particular the Public Safety Department there-
of shall, when operated in the City of Hastings, be operated by a person wear-
ing an approved helmet.
Subdivision 7. Penalty. It is a misdemeanor to violate any pro-
vision of this ordinance and any person violating the terms of this ordinance I
shall, upon conviction thereof, be fined a sum not to exceed $300.00 or
shall be imprisoned for a period of not to exceed 90 days, or both. ~
This ordinance shall become effective upon passage and publication
according to law.

Moved by Councilman O'Connor, seconded by Councilman Kramer to
allow a Bike parking space at 106 E. 2nd. Street. After further discussion
Councilman Novak moved, seconded by Councilman Driscoll to table the park-
ing of Bikes until the April 15, 1974 meeting. Ayes, Councilmen Collins,
Schnirring, O'Connor, Driscoll and Novak; Nayes, Councilmen Kramer, Hallberg,
and Fischer.
The City Attorney, Mr. Fluegel, advised the Council that Mr. Roger
Swanson and Mr. Donald Fluegel, both presently members of the Charter Commiss-
ion, had tendered their resignations from the Charter Commission. Moved by
Councilman Hallberg, seconded by Councilman Driscoll to accept the resigna-
tions of Mr. Roger Swanson and Mr. Donald Fluegel, and to appoint William
Elliott, 713 W. 11th. Street and Audrey Andersen, 1517 Forest Street, Mr. Elliott
to Mr. Swanson's position and Audrey Andersen to Mr. Fluegel's position.

Councilman Novak introduced the following resolution and moved its
adoption:

RESOLUTION TO DEFER SPECIAL ASSESSMENTS ON EARL ~I~
AND NETTIE BAKKEN PROPERTY
WHEREAS, in 1969 and 1970 the City of Hastings did acquire from
Earl Bakken and Nettie Bakken, his wife, certain properties located in
Addition No. 13 to the City of Hastings; and
WHEREAS, the City of Hastings did pay said Earl and Nettie Bakken
for said premises so acquired; and

WHEREAS, as an aditional consideration to said sellers the City
of Hastings did agree to defer special assessments against other real estate
owned by Nettie and Earl Bakken, particularly Lots ten through eighteen in
Block 22, Addition No. 13 to the City of Hastings which assessments so de-
ferred were for the Northwest Area direct lateral benefit trunk sanitary
sewer in the amount of $3,711.84 and for the Northwest Area Storm ponding
Basin and Park Acquisition in the amount of $217.90; and
WHEREAS, it is the desire of the City of Hastings to memorialize
on the land records of the Dakota County Register of Deeds office pertaining
to said lots, the fact that said assessment has been deferred and will later
be imposed at such time as said property commences to be used for other than
agricultural purposes so that prospective purchasers and other interested
parties will be aware of the deferral of said assessment;
NOW, THEREFORE, be it hereby resolved by the City Council of the
City of Hastings as follows:
That the City Clerk of the City of Hastings shall record with the
Dakota County Register of Deeds office, on the land records pertaining to
Lots 10 through eighteen in Block 22 of Addition No. 13 to the City of
Hastings a notice in words and figures as follows:
Notice of Deferred Assessment:
The City of Hastings does hereby give notice that
it has deferred special assessments against Lots
10 through eighteen, in Block 22, Addition No. 13
to the City of Hastings for the "Northwest Area
Storm Ponding Basin and Park Acquisition" in the
amount of $217.90 and for the "Northwest Area Direct
Lateral Benefit Trunk Sanitary Sewer" in the amount
of $3,711.84 and that said assessments will be imposed
and payment will be required at such time as the pro-
perty is used for other than agricultural purposes,
or at such other time as may be determined by the
City Council of the City of Hastings pursuant to
Statute.

Moved by Councilman O'Connor, seconded by Councilman Kramer
that the City Clerk contact the Highway Department requesting them to do
a speed rate study on Highway #55, from the west end of the City Limits
to the East where the 30 M.P.H. begins. Taking into consideration the
Courthouse traffic and the increased traffic from the Senior High School.
The City of Hastings would like to extend the 30 M.P.H. speed limit on Highway
#55 west to the City Limits. Ayes, all; Nayes, none.
Moved by Councilman Hallberg, seconded by Councilman Novak that
the bills as audited be approved and the City Clerk be instructed to issue
warrants for same. Ayes, all; Nayes, none.
