HomeMy WebLinkAbout07-16-74 Hastings, Minnesota July 16, 1974 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, July 16, 1974 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. I Members present: Councilmen Kramer, O'Connor, Novak, Collins, Schnirring, Hallberg, Fischer and Mayor Petersen. Members absent: Councilman Driscoll. Minutes of the last meeting were read and approved. 1539 Moved by Councilman Novak, seconded by Councilman Kramer PUBLIC HEARING to deny the Special Use Permit of Paul Swanstrom, 505 McNamara Ave. CONTINUED for a basement apartment. Ayes, 7; Nayes, O. PAUL SWANSTROM Moved by Councilman Schnirring, seconded by Councilman Kramer that the Variance request of Russell Priewert, 2000 Westview Drive, for the construction of a Deck be referred to the Planning Commission. Ayes, 7; Nayes, O. Moved by Councilman Schnirring, seconded by Councilman Kramer to refer to the Planning Commission the Special Use Permit request of Lou H. Moe, 1217 View Court, for a home operated Beauty Shop. Ayes, 7; Nayes, O. Moved by Councilman Hallberg, seconded by Councilman Kramer to accept the Planning Commission's report on Elmer Lucking and to deny Mr. Lucking's Variance request to install a private sewer system at 2880 TH #61. Ayes, 7; Nayes, O. Moved by Councilman Kramer, seconded by Councilman Novak to approve the issuance of a Building Permit for the storage tank of the Hastings Co-op. Creamery at 17th and Vermillion Street, provided that proper footings be designed by an Engineer. The in- stallation of the tank is not seen as an expansion of its present facility, but rather is a replacement of an existing facility and therefore does not constitute an expansion of non-conforming use. Moved by Councilman Hallberg, seconded by Councilman Kramer to allow the cost for extending sewer and water utilities to serve the proper~~ of Burns & Enstad at 1250 TH #55, to be added to the Enstad utility extension project and that the cost is to be assessed against the above address (1250 TH #55) for the remaining number of years (10) of the original project at 8% interest. This will become effective upon the City Attorney re- ceiving a signed agreement to the conditions above from Burns & Enstad. Ayes, 7; Nayes, O. Mr. Bill Berg of 919 W. 7th. St. addressed the Council concerning the hazards and unsafe conditions of the drainage pond in that area. The staff gave a brief report on problems in that area. Moved by Councilman Novak, seconded by Councilman Fischer to give the necessary ninety (90) day termination notice to Lease of Earl o. Bakken, 1402 W. 4th St. and Bernard Husting, 1424 Walnut St. for the purpose of returning the right of possession to City ownership so that final design and control over the ponding area can be performed. Ayes, 7; Nayes, o. Moved by Councilman Collins, seconded by Councilman Schnirring to change the next regular Council meeting from August 5th to August 6, 1974. Ayes, 7; Nayes, O. COUNCIL MEETING DATE CHANGED 1540 The request to close off 20th Street from Westview Drive to Pleasant Drive was withdrawn from the Agenda and no action was taken. Moved by Councilman Novak, seconded by Councilman Fischer to accept the Health Officer's report concerning a septic problem at 307 W. 7th street and instruct the Staff to take the necessary steps to correct the problem to include hook- ing on to the City Sewer service if necessary. Ayes, 7; Nayes, o. The City Council was informed that the city water sprinkling conservation program was now in effect. The City Council will consider appointment to the Association of Metropolitan Municipalities Committees. Any Councilman interested will notify the Administrator, James Cosby, in the near future. Moved by Councilman Schnirring, seconded by Council- man Hallberg that James Cosby be appointed OSHA Director for the Citys' employees and operations. Ayes, 7; Nayes, o. Moved by Councilman Schnirring, seconded by Council- man Hallberg that the City Council and the Planning Commission have a joint meeting to discuss annexation procedures on July 23, 1974 at 8:00 P.M. in the Council Chambers. Ayes, 7; Nayes, o. Moved by Councilman Novak, seconded by Councilman Fischer to allow the increase of $1.00 in collection fees for trash and garbage pick up at a residence side door. The new rate to become effective August 5, 1974. Mr. Kranz is responsible for notifying his customers of the new rate. Ayes, 7; Nayes, o. Moved by Councilman O'Connor, seconded by Councilman Hallberg to use Federal Revenue Sharing Funds to support the in- creased cost of materials for the 1974 Seal Coating Program, $8,700 being the amount needed. Ayes, 7; Nayes, o. Moved by Councilman O'Connor, seconded by Councilman Kramer that Daryl Plath, Chief of Police, be authorized individual to sign for re-imbursement funds for police training programs which the City of Hastings participates in. Ayes, 7; Nayes, O. Moved by Councilman Schnirring, seconded by Council- man Fischer to table the 3.2 Beer License under consideration until the City Attorney can clarify the liability requirements under a new State law. Ayes, 7; Nayes, o. Moved by Councilman Fischer, seconded by Council- man Kramer to pass the second reading of the Anti-Littering Ordinance and adding Paragraph, Sub. 9, to prohibit placing re- fuse in park receptacles; also Sub. 18, to prohibit placing refuse in receptacles owned by others. A copy of this Ordinance is on file in the City Clerk's office. Ayes, 7; Nayes, o. Moved by Councilman O'Connor, seconded by Councilman Hallberg to pass the second reading of the Ordinance Regulating and Licensing Refuse Collectors, but to include 5.42, Sub. 7, which will allow fees to be set by resolution. Ayes, 7; Nayes, O. Moved by Councilman Novak, seconded by Councilman Fischer to approve the partial payment of $35,109.87 to Arcon Construction Company. Ayes, 7; Nayes, o. Moved by Councilman Novak, seconded by Councilman Fischer to approve the partial payment of $33,938.35 to Bituminous Surface Treating Company. Ayes, 7; Nayes, none.
