HomeMy WebLinkAbout08-07-74 Hastings, Minnesota August 7, 1974 1545 The City Council of the City of Hastings, Minnesota met in a regular meeting on Wednesday, August 7, 1974 at 7:30 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Driscoll, O'Connor, Novak Collins, Schnirring, Hallberg and Mayor Petersen. Members absent: Councilmen Kramer and Fischer. The Mayor and Council then reviewed the regular minutes of the meeting of July 16, 1974 as well as the special meeting of the Planning Commission and the Council and the minutes were excepted as read. The Mayor opened the Public Hearing for the rezoning of certain Lots and Blocks, Dakota Hills 4th Addition at 7:35 P.M. The City Administrator announced that the appropriate legal ads in the newspaper had been done and that a Certificate of mailing to the affected property owners had been performed and the Administrator was in possession of a signed copy of the mailing list. The Mayor then opened the discussion to the Public and asked if there was anyone in the meeting that wished to be heard on the matter. After all citizens present had an opportunity to speak the Mayor closed the Public Hearing at 7:38 P.M. Councilman Hallberg moved, Councilman Driscoll seconded the motion to postpone the rezoning of the Dakota Hills 4th Addition until the final Plat is brought before the Council. The vote was 6-0 in favor of the motion. Councilman Novak moved, Councilman O'Connor seconded to refer to the Planning Commission the Special Use Permit of Alfred F. Helten of 1005 W. 15th St. Ayes, 6; Nayes, o. Dexter Marston gave a report in regard to the Dakota County Thoroughfare Plan and asked that the Council give addi- tional consideration for proper comments that it may wish to make in the future when the public hearings on this proposal are brought forth by the County. Councilman Hallberg moved, Councilman Novak seconded to approve in general concept the comments made by Dexter Marston in his letter of August 1, concerning the Metropolitan Council's physical development report. His comments are to be forwarded to the Metropolitan Council as Hastings' comments concerning the physical development proposal. Additional comments will be forthcoming from the City of Hasti~gs at a time when the next stage of the physical development concept becomes finalized. Ayes, all; Nayes, 0 Councilman O'Connor moved, Councilman Schnirring seconded to approve the Permit of the Downtown Business with their tree planting concept with the understanding that the Engineer of the City of Hastings will have the final authori- zation to approve where the planters will actually be located and that the Business clearly understand that the maintenance, repair and the cleaning out of the planters are the respon- sibility of the Businessmen themselves and not of the City of Hastings. Ayes, 6; Nayes, o. Councilman Driscoll moved, Councilman Hallberg seconded the motion to call for a Public Hearing concerning the Rauenhorst construction porject for August 19th at 8:00 P.M. in the Council Chambers. Proper publication and mailing notice are to be sent out immediately. Ayes, 6; Nayes, o. PUBLIC HEARING REZONING DAKOTA HILLS 4TH ADD. SPECIAL USE PERMIT A. F. OF ELECTIONS APPROVE COUNTY ABATEMENTS Councilman Hallberg moved, Councilman Novak seconded the motion to adopt the procedures as presented by Dexter Marston concerning the proper handling and processing of various requests that come before his office and while the procedures are being approved in this motion the fees as stated in his proposal are not being adopted now but will be voted upon at a later date. The vote was Ayes, 6; Nayes, O. The Council accepted the letter from ICMA and ordered the letter put on file. Councilman Schnirring moved, Councilman Driscoll seconded to approve the list of Election Judges for the September 10th Primary election if the City of Hastings has one and for the General Election of November~th, 1974 as presented before the Council meeting tonight. It is also noted that the voting Precincts are as follows: 'I I I First Ward - Hastings Junior High School Second Ward - Tilden Elementary School Third Ward - Cooper Elementary School Fourth Ward - Calvary Baptist Church and be it further resolved that the salary for the election judges be at the rate of $2.00 per hour. Ayes, 6; Nayes, O. Councilman Novak moved, Councilman O'Connor seconded the motion to authorize the State Auditor of the State of Minnesota to perform the 1973 - 1974 official audit for the City of Hastings. Ayes, 6; Nayes, O. The report was made by the City Administrator announcing that the Sanitary Landfill for the City of Hastings has been officially closed and the final closing procedures are beingfo11owed and application is also being made to the PCA requesting that a portion of the Dump still be used for demolition material. As it stands at this time the Sanitary Landfill will be open from 2:00 to 4:00 P.M., Tuesdays and Thrusdays to receive onlu demolition type material. u The City Administrator presented to the Council a two- part report on Federal Revenue Sharing; due to the fact that this was a rather involved report it was suggested at this time the Council retain the copies of this report but that a more detailed examination be done during the budget work sessions at which time consideration can be given not only to the application of the Revenue Sharing Funds, but to the rest of the financial resources that the City has and is considering in allocations for 1975. Councilman O'Connor moved, Councilman Driscoll seconded to appoint Mr. Wallace Erickson as the Clerk-Treasurer for the City of Hastings and also as Commissioner of Elections for the City of Hastings. Ayes, 6; Nayes, O. Councilman Driscoll moved, Councilman Schnirring seconded to approve the County Abatements as listed on the City Administrator report dated June 3, 1974 as being accepted by the City of Hastings. Ayes, 6; Nayes O. They are as follows: Chicago, Milw. At. Paul & Pac. RR #19-44610-020-00 R.R. property lease was cancelled and therefore should be abated to nil. Reduce from 301 to nil for taxes payable in 1974. o Ronald Moen #19-81700-050-02 This property was re-va1uated and found to be valued to high. Reduce from 20240 to 15360 for taxes payable in 1974. Evelyn Bohlken #10-03300-010-75 The agricultural green acres value on this property was valued too high. Reduce from 7614 to 2387 GA for taxes payable in 1974. Michael Wagner #19-11250-020025 This property was found to be over-valued in comparison to surrounding properties in the same area. Reduce from 5720 to 4400. Paul Smith #19-77300-120-02 This property was re-checked and found that the original value which was placed on it was to high. Reduce from 4360 to 3200. Taxes payable in 1974. Councilman O'Connor moved, Councilman Schnirring seconded to table the authorization to advertise for bids for the one-half ton truck for the Water Department until the August 19th meeting of the Council. Ayes, 6; Nayes, O. Councilman Novak moved, .seconded by Councilman Collins to approve the authorization of the Building Inspector to attend a one day Fall Seminar in Brainerd, Mn. Ayes, 6; Nayes, O. Councilman Hallberg moved, Councilman Novak seconded the motion to approve the third and final reading of the Ordinance Regulating and Licensing Persons involved in the Collection and Disposal of Garbage and Rubbish. Ayes, 6; Nayes, O. Councilman Novak moved, Councilman Schnirring seconded to approve the third and final reading of the Hastings Anti- Littering Ordinance. Ayes, 6; Nayes, O. Councilman Schnirring moved, Councilman O'Connor seconded the motion to defer action on the 3.2 Beer License until more information kan be obtained from the League of Minnesota Municipalities for it is the understanding of the Council that the League is doing a report on this and we should wait until the report is finished and have an opportunity to review and assess the report and consider what the costs are. Ayes, 6; Nayes, O. It is further suggested that the City Staff take an in- formal survey of existing liquor and beer license holders to find out the current level of insurance that they now have. Councilman Driscoll moved, Councilman Hallberg seconded to accept the final Resolution on the H.D. Hudson Mfg. Co. and to accept the project as previously agreed upon. A copy of which is on file in the City Administrator's office. Ayes, 6; Nayes, O. The Council went further to discuss with the Staff the agreed upon payment of administrative and attorney fees by Hudson and that these fees are to be paid before the Staff signs final documents. Councilman Driscoll moved, Councilman O'Connor seconded the motion to authorize the City Administrator to take care of the necessary procedures required to do the final closing out of the Ma1-0-Sen Company project. The Council approved the final resolution subject to the Administrator satisfying himself that full compliance has been done. Ayes, 6; Nayes, O. A copy of this resolution is on file in the City Administrator's office. Councilman Hallberg moved, Councilman Driscoll seconded the motion that the City of Hastings purchase the Gardner prop- erty which is approzimate1y 5 acres in size for the price of $2,400. The purpose of the purchase of this property is for park uses only. Ayes, 6; Nayes, O~ Councilman Driscoll moved, Councilman Schnirring seconded to approve the first reading of the proposed Ordinance to adopt the 1973 Building Code. NO PARKING ASSESSMENT PROPOSAL PRESENTED FOR DOWNTOWN PARKING LOT INSTALLATION STREET LIGHTS WESTVIEW DRIVE ENGINEER AIDE FULL TIME LATE ADDITIONS TO BILLS ICE ARENA The City Attorney informed the Council of the sewer problem which has been at 410 E. 4th Street and that the Attorney will be meeting with the owner of that property in the near future in order to find out what the current owner's disposition of that property will be. Pending the information received at that meeting the Attorney will have an additional report to the Council so if necessary the Council can take final action on the property to confront the current health problem that exists there. Councilman Dr1:scoll moved, Councilman ,Novak, seconded to approve the Smead property line adjustment in the Municipal Parking Lot at no cost as presented by the City Attorney, to wit; The City of Hastings by and through the Mayor and City Clerk are authorized and instructed to convey to the Smead Manufacturing Company the West 1 foot of the East 23 feet of the South 90 feet of Lot 2, Block 3, Town of Hastings upon receipt of a conveyance from the Smead Manufacturing Company of the West 2 feet of the East 25 feet of the North 50 feet of Lot 2, Block 3, Town of Hastings. Ayes, 6; Nayes, O. l_ ! ',: Councilman O'Connor moved, Councilman Collins seconded to approve the partial payment for 1974 State Aid Construction to Husting & Engstrom Contractors for $4,028.56. Ayes, 6; Nayes, O. Councilman O"Connor moved, Councilman Driscoll seconded the motion to approve the final payment to Graus Construction for the Cold Storage Bldg. in the amount of $6,932.00. Ayes, 6; Nayes, O. The City Engineer gave a status report on the North- west Ponding Area and the Council received the report for the record. Councilman Novak moved, Councilman Driscoll seconded to table the resolution pertaining to no parking being allowed on W. 16th Street between Eddy Street and Spring Street. This item won't be brought back before the Council until the Engineer office has had an opportunity to contact the people that would be concerned with this proposed change in parking. Ayes, 6; Nayes, O. I~- The Engineer presented to the City Council for their information and consideration an assessment proposal for the Downtown Park- ing Lot as approved by the Council's Committee. Councilman Hallberg moved, Councilman Driscoll seconded the motion that the Northern States Power be notified that it is the Council's desire that in the Imperial Estates Addition area to have the lines for the street lights put underground as the Ordinance regulations require. It is also moved that the addi- tional light that was put in by error on Westview Drive be re- moved by Northern States Power at no cost to the City. Ayes, 6; Nayes, O. Councilman Hallberg moved, Councilman Driscoll seconded to approve the appointment of the Engineering Aide to a full time position in the city government but that his salary increase request be reviewed by the City Administrator with his recommen- dation before the Council would approve the request. [I Councilman Hallberg moved, seconded by Councilman Novak to approve a late addition to the bills of Graus Construction for $104,393.00 and for O'Connor-Kranz for the sum of $5,557.00. Ayes, 6; Nayes, O. --.! Councilman Driscoll moved, Councilman Novak sgcondea to table the request of James Peters and Dennis Troje for Trash Licenses until the regular Council meeting of August 19th. Ayes, 4; Nayes, Councilmen Schnirring and Hallberg. Motion carried. Councilman Driscoll moved, Councilman Novak seconded that the bills as audited be approved and the Cit Clerk be instructed to issue checks for same.
