M. in the Council Chambers of City Hall. Members present: Councilmen Driscoll, O'Connor, Novak, Collins Schnirring, Hallberg, Kramer, Fischer and .Mayor Petersen Members absent: None The Mayor and Council reviewed the minutes of the meeting of August 6, 1974 and the minutes were accepted as read. The Mayor and Council reviewed the regular minutes of the meeting of August 7, 1974 and the minutes were accepted as read. At 8:05 P. M., Mayor Petersen opened the public hearing. The Planning Director read the notice of public hearing, affidavit of publication, and the certificate of mailing. PUBLIC HEARING RAUENHORST SHOP- PING CENTER, TH 55 AND PLEASANT DR. Name Comments John Schutte The City of Hastings should explore the various alternatives to help improve the pre sent and future traffic problems around the shopping center. If the service drive remains where it is presently located, people are more apt to take that than other resident- ial roads to the shopping center. At the present time, south of T. H. 55, there is only two east and west through streets and that is 14th and 15th. The City should con- sider extending Southview Drive. Another possibility for an east-west road would be along the dike by the Vermillion Rive r. In addition the City should pave Pleasant Drive, install stop lights at the intersection of Pleasant Drive and T. H. 55 and consider making some streets one way to avoid traffic problems. Larry Winter Surfacing of Pleasant Drive and the Pleasant Consulting Engineer Drive bridge across the Vermillion River is scheduled for 1975. Although it is not desir- able to break up the continuity of the service drive, the configuration as suggested in the traffic report would allow greater stacking distances along Pleasant Drive and Westview Drive and therefore should reduce traffic congestion, on the intersection of those two roads and T. H. 55 Charles Berfevin Since the proposal shown by Rauenhorst will require several turns to get from the east to the west edge of their property, people will not use the service drive and therefore more traffic will be forced into the residential ne ighborhood to the south. Mr. Wally Swanson was introduced as a member of a committee that. was in the process of being organized to study traffic problems in the City of Hastings. Mayor Petersen 1553 Name Wally Swanson Gary Siebert Dexter Marston Planning Director Bob Garvey Roger Fredrickson Don Fluegel City Attorney Jerry Dempsey Comments The committee has not reviewed the shopping center project, but would be willing to study any traffic problems that the Council felt appropriate in the future. What streets were included in the traffic study done by Bather-Ringrose- Wolsfeld? Rauenhorst was directed to study the impact that their shopping center would have on the surrounding road network. They were not asked to do a traffic study for southwest Hastings. The Council should be willing to commit it- self to rectifying any problems that may occur in this area in the future. The impact of the shopping center on the surrounding re sidential area is difficult to dete rmine at this time, but if the Council is wilting to correct any problems that may occur in the future, the people in the area would be satis- fied. What are the permitted uses within this zon- ing district? The permitted uses within a shopping center district are the same as in a C- 3 district. The traffic committee should offer a recom- mendation before the Council gives approval to the Rauenhorst Shopping Center. I , I~ \ I '- ' After all people present were afforded an opportunity to be heard, Mayor Petersen closed the public hearing at 9:03 P. M. n L~ Councilman Novak moved, Councilman Dris colI seconded the motion that the Rauenhorst Shopping Center Resolution be approved with the modifications suggested by Rauenhorst. Ayes, 8; Nays, O. Councilman 0' Connor commended the City staH and Planning Commission for their eHortsinvolved in reviewing the shopping center proposal. No consideration has ever been given to widening 14th Street was was suggested by a resident during the public hearing. The City is, and always will be interested in local traffic problems. The Planning Director explained the maps desig- nating the flood plain area within Hastings that has been submitted by the Department of Natural Resources. After a floodway has been designated, the Council can adopt this and if it is approved by the State Department of Natural Resources, appropriate legislation will be incorporated into the existing Zoning, Subdivision requirements, as well as building requirements. Councilman O'Connor expressed some concern that the term, "Administrative Official" in this ordinance as it refers to the City Planner, might conflict with other sections of the Code where this term refers to the City Administrator. Councilman Hallberg moved, Councilman Driscoll seconded the motion to pass the first reading of the ordinance designating the City Planner as the Administrative Official in zoning matters and authorizing the Planning Commission, instead of the Board of Adjustments, to hold public hearings on certain zoning matters. ""'I: _, '.~ ..._ - FLOOD PLAIN STATUS REPORT o ORDINANCE REVISION RE- GARDING PUBLIC HEARINGS Councilman Hallberg moved, Councilman Kramer seconded the motion that the City sell 2.808 acres to 76 Suppliers Warehouse Corporation, Ayes, 8; Nays, O. The Planning Director asked the Council whether they want the Board of Design Control to play any roll in the approval of a building permit for this building. The staff was directed to have the Board of Design Control review the building permit if they felt it was appropriate. -- I \ The Natural Resources Commis sion has recomm- ended to the Council that they purchas e property along the Vermillion River for floodway and parkway purposes. The Natural Resources Commission has suggested that the Council offer the appraised value for all but two parcels of land. The Commission suggested that the Council offer the market value as opposed to the appraised value on the Nowicki property. The total cost would be $129,500.00. Of that $~,z9, 500. 00, $18,200.00 would be used for the acquisition of land for the floodway project. In addition, $13,187.50 is needed for the City's share of. the cost involved with the purchase of the Hagen property east of Vermillion Street on the south side of the Vermillion River. Before the State and Federal Govern- ments will pay their funds, Hastings must draft a purchase agreement for the property. Councilman Schnirring moved, Councilman Hallberg seconded the motion that the City enter into negotiations with the property owners for all of the land mentioned in the Natural Resources Commission recommendation, with the exception of the Nowicki property; and that the City also enter into negotiations for the Hagen property east of Vermillion Street. Ayes, 8; Nays, O. - Councilman Hallberg moved, Councilwoman Fischer seconded the motion to remove the petition for final plat from the table. Ayes, 8; Nays, O. Councilman Kramer moved, Councilman Schnirring seconded the motion to approve the final plat of Dakota Hills 4th Addition. Ayes, 8; Nays, O. Councilman Hallberg moved, Councilman Driscoll seconded the motion to approve the first reading for a re- zoning of Dakota Hills 4th Addition, Lots 1 through 6, Block 1; Lots 7 through 9, Block 2; and Lots 20 through 25, Block 3 from R-l to R-3. Ayes, 8; Nays, O. The Planning Director submitted a proposal which would allow non-permanent type structures to be used as "dead storage'l of off-season recreational vehicles, motor vehicles, and other similar items in an R..A District. ~ Councilman Hallberg felt that the City was better off in creating a Special Use Permit for this type of structure rather than to rezone property in the rural portion of the City for this specific use. This would tend to avoid any concentra- tion of storage buildings in one area. Councilman Kramer suggested that if storage build- ings were allowed by a Special Use Permit in an agricultural zone it would in effect, change the value of the land. Councilman Novak m.oved, Councilman Dx,iscoll seconded the motion to approve the first reading of the ordinance amending Section 10. 10 of the City Code regard- ing Special Uses within an Agricultural Zone. Ayes, 8; Nays, O. 1554 SALE OF 3 ACRES OF LAND IN INDUSTRIAL PARK VERMILLION RIVER FLOODWAY AND PARKWAY APPROVAL OF DAKOTA HILLS 4TH ADDITION FINAL PLAT REZONING OF DAKOTA HILLS 4TH ADDITION FROM R- 1 TO R- 3 MODIFICA TION OF R-A ZONING DISTRICT 1555 RESIGNA TION FROM PLANNING COMMISSION RICHARD JENSEN Councilman Driscoll moved, Councilman Novak seconded the motion to accept the resignation of Richard Jensen from the Planning Commission, directing that a letter be sent to Mr. Jensen expressing the City's appreciation for his services. EJI - , Councilman Hallberg moved, Councilman Driscoll secondedi the motion to approve the first reading of the Sign Ordinance which j'~, eliminates certain setback requirements and provides penalities for violation of said ordinance. Ayes, 7; Nays, 1. Mr. Pellant of the Chamber of Commerce asked for a list of businesses that were in violation of the Sign Ordinance so he could meet with them. Councilman Schnirring moved, Councilman Kramer seconded the motion to approve Resolution No. which adopts procedures for Land Use Applications and the fees therefore. Ayes, 7; Nays, 1. Councilman Novak moved, CouncHman Collins seconded the motion to authorize the adve rtising! oJ bids for a 1/2 ton truck for the Water Department and the old truck ,should be transferred to the Engineering Department. Ayes, 8; Nays, O. Councilman. O'Connor moved, Councilman Hallberg seconded the motion to approve an increase in salary for Steve Pederson of 25~ per hour. Ayes, 8; Nays, O. Councilman O'Connor moved, Councilman Driscoll seconded the motion to change the date of the first meeting of the Council in September from September 2, 1974 to September 3, 1974, due to Labor Day weekend holiday. Ayes, 8; Nays, O. The City Fire Marshal explained that although the Fire Department has no objection to changing the Fire Zone in the Industrial Park, the Council should be aware that there may be reprocussions in terms of limiting the size of the building or limiting the amount of coverage on any particular lot due to buildings that are not protected from fire hazards to the degree that the present buildings are. Fire Zones are losing their significance due to the fact that the present building codes are enforcing more stringent regulations regarding fire protection. o Mr. Merlin Anderson of the Peavey Mill addressed the Council, stating that he felt that before any changes are made in the Fire Zoning, that the Council should address itself to the whole City rather than one specific area. Mr. Anderson's concern is that competing industries in different fire zones will be treated differently due to their location in different fire zones. Councilman Novak moved, Councilwoman Fischer seconded the motion to table the discussion on changing the Fire Zone in the Industrial Park until the staff has an opportunity to review all Fire Zone Districts. Ayes, 8; Nays, O. Councilman 0' Connor moved, Councilman Kramer seconded the motion to approve the expenditure of funds allowing the Chief of Police to attend the National Conference in Washington, D. C. Ayes, 8; Nays, O. Councilman Novak moved, Councilman Driscoll seconded the motion to approve the second reading of the proposed ordinance to adopt the 1973 State Building Code. Ayes, 8; Nays, O. 1556 CHIEF OF POLICE INTERNA TIONAL CONFERENCE OF CHIEFS OF POLICE SECOND READING OF PROPOSED ORDI- NANCE TO ADOPT 1973 BUILDING CODE Councilman Driscoll moved, Councilman Hallberg PARTI.AL PAYMENTS seconded the motion to approve partial payments as follows: 1974 Construction Program- Proposal I Bituminous Surface Treating Company in the amount of $54,647. 34 1974 Construction Program": Proposal II Arcon Construction Company in the amount of $2,980. 12 I Ayes, 8; Nays, O. Councilman Driscoll moved, Councilwoman Fischer seconded the motion to approve the installation of "no parking" signs along both sides of 16th Street from Eddy Street to Spring Street. Ayes, 8; Nays, O. r-, I The Consulting Engineer informed the Council that he had received a request from Mr. Amundson to extend sanitary sewer ahd watermain to Lots 14 and 15, Block 4, Addition No. 13, located on State Street between 1st and 2nd Streets. In addition, Mr. Amundson asked that the co st for th/e Se utility lextens ions be paid from available City funds and then be placed on the tax assessment rolls for the property and spread over a period of 10 years. Councilman Hallberg moved, Councilman Driscoll seconded the motion to approve the request of Mr. Amundson subject so signing an agreement with the City to pay for the cost of the extensions, including Engineer- ing charges, to be installed in accordance with City Standards. Ayes, 8; Nays, O. The Consulting Engineer submitted a letter of resignation from Dorothy Fritze, Engineering Secretary. Councilman Schnirring moved, Councilman Driscoll seconded the motion to accept the resignation. Ayes, 8; Nays, O. ~ Councilman Driscoll moved, Councilman Novak seconded the motion to table the appointment of an Ice Arena Manager until September 3, 1974, due to the fact that the Council was not sure whether the applicant was contacted by the Administrator and since not all members of the Administration Committee were present at their last meet- ing. Ayes, 5; Nays, 3. Councilman Schnirring moved, Councilman Novak seconded the motion to approve the license for non-residential pickup for James Peters. Ayes, 8; Nays, O. Councilman Driscoll stated that since the City sets the rates for garbage haulers we have a responsibility to make sure that we do not issue too many licenses. Mr. Scully claimed that Mr. Peters would be hauling trash that he is not capable of handling from commercial and industrial sites, where Mr. Troje would be 'competing for his present business. Councilman Kramer felt that it would be appropriate to limit Mr. Troje to non-residential pickup. Councilman Driscoll moved, Councilman Novak seconded the motion to end the debate and call the roll. Ayes, 3; Nays, 5. (Nays Schnirring, Kramer, 'Hallberg, O'Connor and Fischer). Councilman Driscoll moved, Councilman Novak seconded the motion that the staff and Council should review the whole concept of trash haulers licenses and Mr. Troje's request for license should be denied until the end of the year when a report could be completed. A temporary license shall be granted how- ever for .Mr. Troje to pick up trash at Master' s, Inc. ' Ayes, 5; Nays, 3. (Nays Schnirring, O'Connor, Fischer). The Loosen, Inc. bill for $998. 10 was tabled until additional information is provided regarding the bill.
