HomeMy WebLinkAbout09-16-74 Hastings, Minnesota September 16, 1974 1568 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, September 16, 1974 at 8:00 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Kramer, O'Connor, Novak, Fischer, Schnirring, Hallberg, Collins and Mayor Petersen. r- I I Members absent: Councilman Driscoll. The Mayor and Council reviewed the minutes of the meeting of September 3, 1974 and the minutes were approved as read. The Mayor opened the Public Hearing on the Special Use Permit oj Alfred P. Helton, 1005 W. 15th St. at 8:02 P.M. The affidavit of calling for the Public Hearing and the affidavit of publication along with a certified copy of the mailed notice to affected property owners was presented and read into the record and notice was given that the Public Hearing had been properly called. The Mayor at that time asked for comments from the audience and giving all those interested and wishing to speak, an opportunity to so speak, closed the Hearing at 8:04 P.M. Councilman Schnirring moved, Councilman Hallberg seconded to approve the Special Use Permit of Alfred P. Helton 1005 W. 15th St. Ayes, 7; Nayes, none. r-- The Mayor opened the Hearing for the Third reading of the Ordinance adding Special Uses to the Agricultural Zone and the affidavits of Hearing and Publication were read into the record as well as a certified copy of the mailed notice to concerned property owners was accepted into the record and the Public Hearing was officially called. The Mayor then giving everyone an opportunity, who so desired to have any comments to be made in regard to the Public Hearing then closed the Public Hearing at 8:06 P.M. Councilman Hallberg moved, Councilman Novak seconded to approve the third reading of the Ordinance adding Special Uses to Agricultural Zones. Ayes, 6; Nayes, Councilman Kramer. The Mayor opened the Hearing for the Special Use Permit of Paul Meiers, County Rd. #91 at 8:11 P.M. and the affidavits of Hearing and Publication were read into the record and a certified copy of the mailed notice was put in the record and the Hearing was properly called. The Mayor having given everyone an opportunity in the audience who wished to say anything in regard to the Hearing then closed the Hearing at 8:12 P.M. Councilman Hallberg moved, Councilman Kramer seconded to approve the Special Use Permit of Paul Meiers, County Rd. #91. Ayes, 7; Nayes, 0 r I The Mayor opened the Public Hearing concerning a Special Use Permit for Louis Hoffman, County Rd. #91, at 8:13 P.M. The affidav1ts of Hearing and Publication were read into the record and a certified copy of the mailed notice was put into the record and the Public Hearing was declared to be properly called. The Mayor after giving everyone an opportunity to so speak on the matter before them then closed the Public Hearing at 8:14 P.M. Councilman Kramer moved, Councilman Schnirring seconded to approve the Special Use Permit of Louis Hoffman, County Rd. #91. Ayes, 7; Nayes, none. PUBLIC HEARING ALFRED P. HELTON 1005 W. 15th ST. PUBLIC HEARING SPECIAL USE AGRICULTURAL ZONE THIRD READING PUBLIC HEARING PAUL MEIERS COUNTY RD. #91 PUBLIC HEARING LOUIS HOFFMAN COUNTY RD. #91 1569 PUBLIC HEARING THIRD READING ORDINANCE ON SIGNS :If 13 PUBLIC HEARING THIRD READING PLANNER AS OFFICIAL OF ZONING CODE */1 The Mayor opened the Public Hearing concerning the Third Reading of the Ordinance concerning Signs at 8:15 P.M. The affidavits of Hearing and Publication were read into the record and a certified copy of the mailed notice was accepted in the record and the Public Hearing was declared as officially being called. The Mayor having given everyone an opportunity to so speak on the matter then closed the Public Hearing at 8:16 P.M. Councilman Fischer moved, Councilman Hallberg seconded to approve the Third Reading of the Ordinance eliminating certain setback requirements and providing penalties for violation of the sign Ordinance. Ayes, 7; Nayes, none. o The Mayor opened the Public Hearing concerning the Third Reading of the Ordinance establishing the City Planner as the Administrative Official of the Zoning Code at 8:25 P.M. The affidavits of Hearing and Publication and a certified copy of the mailed notice were read and admitted into the record. The Hearing was declared as being properly called. The Mayor having given everyone an opportunity .to address tllems~lves to the issu.ebefore them then closed the Public Hearing at 8:26 P.M. Councilman Schnirring moved, Councilman Hallberg seconded to approve the Third Reading of the above mentioned Ordinance. Ayes, 5; Nayes, Councilman Collins and Novak. VARIANCE The City Administrator at this time received a Petition from RUSSELL PRIEWERT Citizens which favored the granting of the Variance of Russell Priewert 2000 WESTVIEW and the Petition was accepted. Councilman Fischer moved, Councilman Novak seconded to approve r-l the variance of David Foxworth, 300 W. 7th st. since the existing L I garage was constructed before the present zoning code standards were .~ in effect, the addition is a continuation of the present setback. Ayes, 7; Nayes, none. Councilman Kramer moved, Councilman Hallberg seconded to approve the Third Reading of the Rezoning proposal of Hastings Const. Co. Dak. Hills 4th Add. subject to the following conditions: The Plat is filed with the County; The Plat be recorded with necessary easements allowing shared driveways wherever possible; The re-zoning will allow construction of duplexes and triplexes only, all other Special Uses will not be allowed. Ayes, 7; Nayes, none. The City Planner announced that a report from the recently retired Fire Marshall had not been forthcoming and there was no new data at this time, he requested that the Fire Zone proposal be post- poned until a later time. No action was taken at this time. Councilman Hallberg moved, Councilman O'Connor seconded to approve the expenditure of $100 for Mr. Marston to attend a Feasibility Analysis for Econ. Dev. Conf. at Madison, Wisc. on October 10 & 11, 1974. Ayes, 7; Nayes, none. Councilman O'Connor moved, Councilman Fischer seconded to approve sending Mr. Endres to the American Water Works Assoc. meeting September 29,30 & Oct. 1, 1974 in St. Paul, Mn. Ayes, 7; Nayes, none. Il L-O Councilman Fischer moved, Councilman Novak seconded to approve the City's share of Assessments in the Courthouse area to the sum of $9,298.98 subject to adjustment by supplemental hearing, as explained by the City Clerk, Mr. Erickson. Ayes, 7; Nayes, none. Councilman Schnirring moved, Councilman Novak seconded to approve the Dakota County's Motor Vehicle Program which involves in- ventory and removal of derelict automobiles from the area. Ayes, 7; Nayes, none. The City Administrator at this time informed the Council that Mr. Kruger, the Civil Defense Director of the City of Hastings, had asked that the proposal on Common Organization with Dakota County be deferred until the next Council meeting, at which time Mr. Kruger himself hopes to be present. The Council agreed to have this item put on the October 7th Agenda. Councilman Kramer moved, Councilman Novak seconded to approve the hiring of a secretary to the Engineer at the rate of $2.50 per hour, Mary Rother. Effective date of em- ployment will be September 18, 1974. Ayes, 7; Nayes, none. Councilman Schnirring moved, Councilman Kramer seconded to hold a Public Hearing on October 7, 1974 at 8:00 P.M. in the City Council Chambers for the purpose of the City being allowed to exceed its Levy Limitation by 5%. Ayes, 7; Nayes, none. Councilman Kramer moved, Councilman Novak seconded that the City Administrator put on the October 7th Council Agenda a discussion to be concerned with whether or not the City of Hastings should consider taking over the old County Courthouse, once the County vacates the premise and occupies its new facility on Hwy #55. This is to be put on the Agenda for discussion purposes. Ayes, 7; Nayes, none. The Council at this time took no action on the Third Reading of the 1973 Building Code Ordinance. Councilman Hallberg moved, Councilman O'Connor seconded to approve final payment on the 1973 construction project to Bob Moore Const. Co. for $39,773.77. Ayes, 7; Nayes, none. ,-- Councilman Collins moved, Councilman Kramer seconded to approve the partial payment for 1974 construction project to B-Tu Mix for the sum of $39,339.03 Ayes, 7; Nayes, none. Councilman Hallberg moved, Councilman O'Connor seconded to approve a request from B-Tu Mix for time extension for the completion of their contract for the 1974 construction program from Sept. 1, 1974 to October 6, 1974. Ayes, 7; Nayes,O Councilman O'Connor moved, Councilman Fischer seconded to approve a request from Arcon Const. for time ex- tension for the completion of their contract for the 1974 construction program from Sept. 1, 1974 to October 6, 1974. Ayes, 7; Nayes, none. Councilman Kramer moved, Councilman novak seconded to deny the Meyer Co. request for a no parking space on Sibley Street in front of the Mall door. Ayes, 7; Nayes, none. Councilman Fischer moved, Councilman Novak seconded to approve the Collins Elect. Const. Co. bill of $12,833.10 Ayes, 6; Nayes, Councilman Kramer. Councilman Fischer moved, Councilman Novak seconded to approve the payment of $.8,867.00 to O'Connor-Kranz Co. Inc. Ayes, 6; Nayes, Councilman Kramer. Councilman Fischer moved, Councilman Novak seconded to approve the payment of $18,000.00 to Loosen Inc. Ayes, 6; Nayes, Councilman Kramer. Councilman\Hallberg moved, Councilman Novak seconded to appoint Donald Louden as the official Tree Inspector for the City of Hastings.
