The City Council of the Cit:y'.ofHastings, Minnesota met in a
special meeting on Tuesday, October I, 1974 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Schnirring, Kramer, Fischer,
Driscoll, Novak and Mayor Petersen.
Members absent: Councilmen Collins; Hallberg and O'Connor.
At 8: 07 P.M. Mayor Petersen declared open the Public Hearing .to,.
consider- the AS'Sessment- 'af the' Downtown" Parking Lot" Development;. involvi.ng. '
acquisition, improvement and development into a parking lot of the follow-
ing real estate:
"The West' 43 feet of Lot 2, all of
Lots 3 and 4 of Block3."Orlginal".ToWD,af
Hastings.
There was noted that, said improvement constituted bituminous surfacing,
lighting, landscaping, etc.
The City Administrator stated that he was in receipt of a properly
executed. Certificate of Mailing Notice to the affected property owners and
further stated that the appropriate legal notice had appeared in the official
newspaper of the City of.. Hastings , all in accordance with the laws of the
State of Minnesota. These documents were ordered placed on file in the City
Administrator's office. The Mayor declared that the public hearing had been
properly called and the Mayor declared t~e hearing open. Everyone present
was given an opportunity to be heard with reference to the downtown parking
lot development' and the assessment of costs thereof.' The Mayor stated that
acquisition of the subject property and development of the same into a public
parking facility was necessary for the municipality's regulation and control
of traffic on its streets by providing regulating and operating the off-street
parking facility duly equipped as a parking facility.
The only ,objections heard were with reference to areas proposed to
be assessed which are now used as residences by the owners. The property
specifically referred to were the properties known as the Sylvander property,
the Meier property and the Hjermstad property. An extended discussion took
place with reference to the present and anticipated use of such structures
during the reasonable life of the parking facility. A copy of the proposed
assessment roll. was exhibited. The Mayor stated that the same had been on
file with the City Clerk's office and open for inspection. There were no other
objections to the proposed assessment roll except as they related to the afore-
mentioned three residential properties. " .
Councilman Driscoll moved and Councilman Novak, seconded the motion
to remove the Meier property (legally described as Lot 8, Blk 15, Orig. Twn)
and the Sylvander property(legally described as Lot 7, Blk 15, Orig. Twn. )
from the assessment rolls as it appears that the present and anticipated use
of said property during the life of the parking facility will be residential
and accordingly it does not appear to be any immediate benefit to them nor
will there be any benefit to them so long as the properties are used for
residential purposes.
~ Councilman Novak moved and Councilman Kramer seconded a motion to
amend as follows: That while it is true that the aforementioned Meier and
Sylvander'praperties -are not now or may not now be benefitted by the subject
parking lot facility; that" nevertheless they would realize benefits should--
their use be converted' to a commercial or industrial use and that while they
should not be presently assessed, a notice should be filed against said
property stating that the amount of assessment listed against said properties
on the proposed assessment roll will be levied against said property should
they at any time during the term of the assessment be converted to commercial
or industrial uses. That in the interim the amount to be assessed against
said properties shall be paid from other City funds and when and if the
properties are converted to non-residential. uses and assessment levied there-
for, that the funds received from said assessment shall be paid back to the
City as reimbursement for the funds presently expended at this time in payment
of said items.

A vote was taken on the amendment and the following vote was
recorded: Ayes, 4; Nays, Councilman Schnirring.
A vote was then called for and received on the original motion,
as amended, and the fOllowing vote was received: Ayes, 4; Nays, Councilman
Schnirring.
Councilman Kramer then offered a motion which was seconded by
Councilman Novak as follows: To remove from the proposed assessment roll
the Hjermstad property (legally described as Lts. 3&4, Blk 2, Orig. Twn) ~,
upon the same terms and conditions as applied to the previously removed I I
Meier and Sylvander properties. Upon being put to a vote the following vote I
was recorded: Ayes, 5; Nays, none.

Councilman Kramer then introduced the following resolution and
moved its adoption:
RESOLUTION ADOPTING ASSESSMENTS iX ~ \
WHEREAS, pursuant to proper notice duly given as required by
law, the Council has met and heard and passed upon all objections to the
proposed assessments for the improvement of the following: (pursuant to
M.S.A. 459.14 and M.S.A. 429 et seq)
Downtown Parking Lot Development on the W 41 feet,
of N 50 feet and W 44 feet of S 90 feet of Lot 2,
all of Lots 3 and 4 of Block 3, Original Town of
Hastings. Bituminous Surfacing, Lighting, Landscaping,
etc.
WHEREAS, the City Council of the City of Hastings has heretofore
found and does hereby again find that it is necessary that said properties
be acquired and improved as a parking lot to improve the municipality's
regulation and control of traffic on its,streets, alleys and public grounds;

WHEREAS, the City Council and City staf.f has conducted an intensive
and extensive investigation to determine and allocate benefits from said
improvement;
WHEREAS, a plan has been proposed, considered and found reasonable
and acceptable which plan establishes four assessment 4~stricts which the
Council hereby finds to be a reasonable allocation of benefits, a copy of
which plan is on file in the City Administrator's office and which plan
serves as the basis for the following spreading of ass~ssments against
benefitted property; ,.,

NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HASTINGS as
, .
follows: :.
1. Such proposed assessment roll, a copy of which is
attached hereto and made a part hereof is hereby accepted and shall constitute
the special assessments against the lands therein described and each tract of
land therein included is hereby found to be benefitted by the proposed improve-
ment in the amount of the assessment levied against it.
~ 2. Such assessment shall be payable in equal installments
extending over a period of 10 years, the first of the installments to .be
payable on or before the first Monday of January, 1915. Any deferred insta11- I~
. ments shall bear interest at the rate of eight (8) per cent (8%) per annum.
To the first installments shall be added interest on the entire ~ssessment,
from the date of this assessment resolution, until December 31, 1975. To
each subsequent installment when due shall be added interest for one year on
all unpaid instailments.

3. The owner of any property so assessed may, for30daya.
after no tif icatian from the City Treasurer, pay to the City Treasurer,
the whole of the assessment without interest, and he may at any time,.
p:r:ior to certification of the assessment to. the County Auditor, as
herein provided, pay the whole of the assessment against any pare:el.with
interest acctued to the date of payment to the City Treasurer, and he
may at any time thereafter pay the County Treasurer the entire amount
of the assessment. remaining unpaid with interest accrued to December 31st
of the year in which such payment is mad.e.
4. The City Clerk shall forthwith transmit a certifi.edduplicate
of this assessment.to the County Auditor to be extended on the proper tax
lists of the County and such assessment shall be collected and paidLover.in
the same manner as other numicipal taxes.

Councilman Novak seconded the motion to adopt said resolution and
the same was passed by the following vote: Ayes, 5; Nayes, none.
The Mayor officially opened the Hearing to consider the 1973
Supplemental Assessments as presented at 9:23 P.M. The Administrator read
into the record that all of the proper legal notifications and mailing had
been complied with and that the Hearing had been properly called. The Mayor
then gave an opportunity to all those who wished to speak on the issue to do
so, after everyone had an opportunity to make their comments, the Mayor closed
the Hearing at 9:35 P.M.

notification from the City Treasurer, pay..to the.. City Treasurer, the whole
of the asses'sment without interest, and he may at any time, prior to
certification of the assessment to the County Auditor, as here1nprovided,
pay tbe whole of tbe assessment against any parcel with interest accrued to
the date of payment to the City Treasurer, and he may at any time thereafter
pay tbe County Treasurer. the entire amount of the assessment remaining unpaid
with interest accrued to December 31st of the year in which such payment
is made.
4. The City Clerk shall forthwith transmit a certified duplicate
of this assessment to the County Auditor to be extended on the proper tax
lists or the County and such assessment shall be collected and paid over in

Councilman Fischer seconded the~ motion to adopt the resolution

The Mayor officially opened the Hearing to consider the balance
of the 1974 Construction Projects as presented, at 8:34 P.M. The Administrator
read into the record that all of the proper legal notifications and mailings
had been complied with and that the Hearing had been properly called. The
Mayor then gave an opportunity to all those who wished to speak on the issue to

The total amount to be assessed on 1974 Improvements is $444,500.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HASTINGS:
1. Such proposed assessments, a copy of which is attached
hereto and made a part hereof is hereby accepted and shall constitute
the special assessments against the lands therein, and each tract of
land therein included is hereby found to be benefited by the porposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal installments
extending over a period of 10 years, the first of the installments to
be payable on or before the first Monday of January, 1975. Any deferred
installments shall bear interest at the rate of eight percent (8%) per
annum. To the first installments shall be added interest on the entire
assessment, from the date of this assessment resolution, until December 31,
1974. To each subsequent installment when due shall be added interest for
one year on all unpaid installments.
3. The owner of any property so assessed may, for 30 days after
notification from the City Treasurer, pay to the City Treasurer, the whole
of the assessment without interest, and he may at any time, prior to
certification of the assessment to the County Auditor, as herein provided,
pay the whole of the assessment against any parcel with interest accrued to
the date of payment to the City Treasurer, and he may at any time thereafter,
pay the County Treasurer the entire amount of the assessment remaining unpaid
with interest accrued to December 31st of the year in which such payment
is made.
4. The City Clerk shall forthwith transmit a certified duplicate
of this assessment to the County Auditor to be extended on the proper tax
lists of the County and such assessment shall be collected and paid over in
the same manner as other municipal taxes.
