The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, October 7, 1974 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Driscoll, Fischer, O'Connor,
Collins, Schnirring, Kramer, Hallberg and
Mayor Petersen.

The Mayor asked if there were any corrections or comments to be
made on the Minutes of the Election Canvass of September 12, 1974; the
continued meeting of September 12, 1974; and the regular meeting of September
16, 1974, there being none, the Mayor declared that all three of the above
listed Minutes were approved as read.

Councilman Hallberg moved, Councilman Driscoll
seconded to award the contract on the Railroad Spur Grading
for the Industrial Park to A. Kamish and Sons. Contract
amount is $12,937.96. Ayes, 8; Nayes, none.

The Mayor declared the Bid Opening to be in process
and instructed the Administrator to open the three bids which
were presented to the Council for a ~ Ton Pick-Up Truck for the
Water Department. The bids were as follows:

Councilman Driscoll moved, Councilman Novak seconded
to accept the bid of Bahls Motor & Implement Company for $4,199
subject to the Staff reviewing the specificaitons to insure that
the City's specifications had been complied with. Ayes, 8

Councilman Fischer moved, Councilman Novak seconded
to approve the allocation of $10,000 of Federal Revenue Sharing
Funds to be spent for the Youth Action Council's request for
funds from January 1, to July 31, 1975. Ayes, 8; Nayes, none.
A discussion was conducted in regard to the City of
Hastings' interest in the old County Courthouse and whether or
not the City would consider occupying the County Courthouse
facility after the County has vacated it and moved into its
new facility on Highway $55. Councilman Driscoll moved,
Councilman Novak seconded that a Committee be established to
consist of the Mayor, the City Attorney, Art Baumeister and
James Cosby for the purpose of meeting with the County Board
and state that the City of Hastings is interested inexamining
the possibility of obtaining the old County Courthouse and to
begin talks in an attempt to firm up with the County the specifics
of the offer, if an offer is to be made, and all of the prices
that may be involved in the offer, as well as examination to
determine renovation and other costs in the old County Court-
house that may exist. Ayes, 8; Nayes, none.
Councilman Kramer moved, Councilman Schnirring
seconded, to deny the variance request of Russell Priewert,
2000 Westview Drive, on the grounds that no hardship exists.

Councilman Driscoll moved, Councilman Kramer
seconded to ~pprove the Special Use Permit for Farmer Co-op
Elevator at 700 E. 2nd. Street, with the following condi-
tions being attached to this approval:

CERTIFICATION
1975 TAX LEVY
1. A satellite system will have to be installed and the existing
outhouse will have to be removed.
2. Bottled water will have to be supplied for drinking purposes
for the employees.
3. No outside storage of equipment or materials will be allowed.
4. Since the Lot is not served by Public Utilities, no expansion
of the facilities will be allowed.
5. No dumping of oil will be allowed on the site.
6. The house will be razed.
7. All City requirements regarding storage of flammable materials
must be met.
8. Pay the remainder of the application fee which amounts to
$50.00.
9. Remove materials stored outside at the East Hastings building
storage site.

Councilman Hallberg moved, Councilman Kramer seconded, to
appoint Mr. Henry Stark to the Hastings Planning Commission. Ayes, 7;
Nayes, Councilman Collins.
Councilman Hallberg moved, Councilman Schnirring seconded,
to make the following changes in the Fire Zones within the City of
Hastings. That the fire zones be changed from fire zone #1 to fire
zone #3 in the following two areas in the City of Hastings.
1. That portion of the City of Hastings in Section 27,
Township 115, Zoned 1-1, including the area referred to as the --
Hancock and Russell's Sub-division (old Industrial Park) on East
10th street.
2. Auditor's Sub-division #9, Lot 6, and Auditor's Sub-
division #21, Lot 2, except for the East 800 feet.

The Mayor opened the Public Hearing on the Certification
of the Tax Levy to the County Auditor for the fiscal year 1975 ~t
9:15 P.M. After giving everyone an opportunity, who wished to be
heard on the matter, to speak, the Mayor closed the meeting at 9:20
P.M. which includes exceeding the Levy Limit by 5%

Councilman Kramer introduced the following resolutions and
moved their adoption:

WHEREAS, THE City Council has calculated the expenses of the City of
Hastings, Minnesota, Dakota and Washington Counties, Minnesota, for
the calendar year 1975 to be set at $1,287,208 and:

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Hastings, Minnesota:
That the City Clerk is hereby directed to set the budget
for the year 1975 at the sum of $1,287,208 and that he directs the
Dakota County and Washington County Auditors that the sum of
$879,436 be levied upon taxable property within the limits of the
City of Hastings, Minnesota.

to approve the re-evaluations that have been done by the County
Assessor and presented to the City Council tonight on adjusted
market value of certain properties in the City of Hastings.

Councilman Fischer moved, Councilman Hallberg'seconded
that the law firm of Hertogs, McMenomy & Fluegel be hereby officially
designated as the legal consultants to the City. Due to the fact
that the City Charter requires a designation of a specific in~ividual
to be listed as the City Attorney, be it further known that Donald
Fluegel of the above law firm, is hereby appointed as the official
representative of that law firm, to the City. Ayes, 8; Nayes, none.
At this time it was pointed out to the Council that on
August 19th 1974, a Public Hearing had already been held for the
vacation of the service road along the north side of Westview
Shopping Center, and therefore no additional Hearings are needed

for the road has already been vacated. No further action was
taken on this item.

Councilman Hallberg moved, Councilman O'Connor seconded,
to approve the Resolution for the Airport Study, and authorized the
Mayor and Clerk to sign the necessary documents to forward the study
to the appropriate state and federal authorities for request of
federal fundings, and to get the project moving. Ayes, 8; Nayes, O.
The Council, after a brief discussion on the pro-
posed 1975 Improvements, ordered this item to be set aside
until the next Council meeting, which would be October 21, 1974
and requested the Staff to look into current assessment policies
and procedures and alternatives that are not only being practiced
by Cities in the Metropolitan area, but also practices that may
be available to the City of Hastings.

to approve the Husting & Engstrom extension of contract time
from September 1, to October 1, 1974. Ayes, 7; Nayes,

Councilman O'Connor moved, Councilman Driscoll
seconded to approve the partial payment to Husting & Engstrom
for work done on the 1974 State Aid project in the sum of
$10,990.02. Ayes, 8; Nayes, none.
Councilman Driscoll moved, Councilman Fischer sec-
onded to approve the partial payment to Geo. Olson Construction
Co. on the Public Works garage for the sum of $3,065.24.

seconded, to postpone requiring the underground installations
of electric service and removal of the overhead wires to the
newly installed street light, at the apartment entrance north
of TH 55. until 1975. Ayes, 8; Nayes, none.

seconded to approve the Taxicab Licenses from October 1, 1974
to October 1, 1975. Said license fee to be $12.50 for the first
cab, $7.50 for each additional cab. Ayes, 8; Nayes, none.

The City Administrator at this time pointed out to
the Council that a typeographica1 error had occured on the
Agenda, that Item #36 should read; an On~Sa1e 3.2 Beer License
for the National Guard Armory. Moved by Councilman Novak,
seconded by Councilman Driscoll to approve the On-Sale 3.2
Beer License for the National Guard Armory. Ayes, 8; Nayes, O.
The City Administrator pointed out to the Council
at this time that Milo Houlihan had not passed the appropriate
State examinations for either the Plumbing or Fitters License,
and in view of the fact that we had no grounds on which to base
his qualifications to do this kind of work, that the Council
take no action on his License or move to deny the license. The
Council, at this time, took no action and therefore the license
has been set aside indefinitely.

Councilman Driscoll moved, Councilman Kramer seconded to
re-bid the 2~ Ton Dump Truck for the Street Department which was
bid late in 1973. The bidder and the manufacturer are now unable
to present the type of truck to comply with the specifications.
Therefore, the City should go out and re-bid the truck. Ayes, 8;
Nayes, none.
Councilman Hallberg moved, Councilman Driscoll seconded
to return the Bid Bond to Schneider Motor & Implement Company in
order not to penalize them for their inability to furnish the Truck
as required for the Street Department, in the 1973 bidding process.

Councilman Hallberg moved, Councilman Fischer seconded
to approve the expenditure of Federal Revenue Funds to purchase
the necessary Roll-bar items for the following; with the under-
standing that if any of these vehicles is considered to be a
possible trade-in item or replacement item within the next few
years, we would re-examine the need of putting Roll-bars on at
this time. Ayes, 8; Nayes, none.

Councilman Schnirring moved, Councilman Kramer seconded
to allow the SAC charge of $300.00 for the Amundson building permit

Councilman Driscoll moved, Councilman Kramer seconded to appoint
Ja~es Cosby, the City Administrator, as the Labor Negotiator for
Hastings. Ayes, 8; Nayes, none.
Councilman Fischer moved, Councilman Driscoll seconded to
approve the change of the Polling Place for the General Election in
the 4th Ward in the City of Hastings, from the Calvary Baptist Church
to the Haven Homes garage, which is adjacent to the church, and be
it further noted that the night election judge, Mrs. Marion Kummer,
and a voter registrar for the first ward, Lu Swanson be
appointed to their respective positions. Ayes, 8; Nayes, none.

approve the Fire Chief's attendance to the Minnesota Fire Chief's
Conference to be held October 17, 18 and 19 in Rochester, Mn.

Councilman Kramer moved, Councilman Driscoll seconded to
approve the change in the legal holiday of Veterans Day to conform
to State law, which changed it from its current October 28th date
to November 11th date. Ayes, 8; Nayes, none.

to establish a Public Hearing for November 4, 1974 at 8:00 P.M. to
vacate drainage easements in Dakota Hills 4th Addition. Ayes, 8;
Nayes, none.
Councilman Driscoll moved, Councilman Fischer
seconded, to accept the letter of resignation from Mary Rother
as secretary to the Engineer. Ayes, 8; Nayes, none.
At this time the City Administrator mentioned
to the Council that an acceptable replacement had been found
for Mary Rother, by the name of Judith Knudson, and if there
is no objection from the Council at this time, it would be his
recommendation that Judith Knudson be hired as the replacement,
at a salary of $2.50 per hour, effective date of employment to
be October 10, 1974. The Council stated no objections.
