HomeMy WebLinkAbout10-21-74 Hastings, Minnesota October 21, 1974 1612 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, October 21, 1974 at 8:00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Driscoll, Kramer, O'Connor, Novak Schnirring, Fischer and Mayor Petersen. - , Members absent: Councilmen Collins and Hallberg. Minutes of the last meeting were read and approved. Councilman Driscoll moved, Councilman Fischer seconded to accept the resignation of John Scullin from the Housing and Redevelopment Authority. Ayes, 6; Nayes, none. RESIGNATION JOHN SCULLIN, HRA Councilman Fischer moved, Councilman Schnirring sec- ESTABLISH CAPITAL onded to create the Capital Improvement Sewer Fund and to desig- IMP. SEWER FUND nate the Hastings local sewer hook-up charge of $300.00 be diverted into this fund for the purpose of defraying future sanitary sewer replacement costs and/or major maintenance projects. Ayes, 4; Nayes, Councilmen Kramer and Novak. Councilman Driscoll moved, Councilman Kramer seconded to pass the resolution concerning the City's desire to see Federal Revenue Funds continued and to instruct the Staff to advise the proper government officials appropriately. Ayes, 6; Nayes, none. Councilman Fischer moved, Councilman Novak seconded to pay the League of Minnesota Municipalities dues for the up- coming fiscal year to the sum of $2,376.00. Ayes, 6; Nayes, none. r- I i Councilman Schnirring moved, Councilman Kramer seconded, to establish a hearing at the next Council meeting, November 4th, for the purpose of establishing the 1975 Water and Sewer rates, as proposed by the TKDA study. Mr. Novak moved, Mr. Driscoll seconded to table the above motion. Ayes, Council- men Fischer, Driscoll and Novak; Nayes, Councilmen Schnirring, Kramer and O'Connor. There being a tie, the Mayor noted in favor of tabling the motion, the motion was tabled. Councilman Schnirring moved, Councilman Kramer sec- onded to consider the first reading of the Ordinance, which would adopt the 1975 water and sewer rates, at the next CBuncillIeeting 4. r1SCO of November tho Counc1lman Novak moved, Councilman secon ed, to table the above motion. Ayes, Councilmen Fischer, Driscoll and Novak; Nayes, Councilmen Schnirring, Kramer and O'Connor. Being a tie vote the Mayor voted in favor of tabling the motion. The Council instructed the Staff to have Mr. Dewey Kasma of TKDA, to be present at the next Council meeting to discuss the water and sewer rates and answer any questions that the Council may have. Councilman Novak moved, Councilman Fischer seconded, to approve the Police School Liaison Program for the up&coming fiscal year. DUES TABLE WATER AND SEWER RATES APPROVE SCHOOL LIAISON PROGRAM Councilman O'Connor moved, Councilman Driscoll seconded,APPROVE CHANGE to approve the change order M-4 on the Ice Arena, concernipg the ORDER ICE ARENA valve in the water system. Ayes, 6; Nayes, none. Councilman O'Connor moved, Councilman Schnirring sec- onded to approve the Airport Resolution and to appoint Donald Fluegel as City Attorney, and to appoint the firm of TKDA as the Engineer for the project. Ayes, 6; Nayes, none' The next item on the agenda was the property on East Second Street known as the Majeski property and the property on Vermillion Street known as the Graus or Honda building. Reports were received from the building inspector and fire-marshall with reference to the condition of the properties. Whereupon re- ceiving the report of the building inspector and fire-marshall along with verbal report of the building inspector and a report from the city attorney, Councilman Driscoll moved and Councilman Schnirring seconded the adoption of the following order of the City Council: IN THE MATTER OF THE HAZARDOUS BUILDING LOCATED AT LOT 7, BLOCK 108 AND ON PARTS OF LOTS 3 AND 4, BLOCK 29, ORIGINAL TOWN OF HASTINGS To: Owners of record and all other persons claiming any right, title or interest in the following properties: Lot 7, Block 108, Tawn of Hastings (herein referred to as Majeski property) , and South 23 feet of the North 73 feet of the West 75 feet 7~ inches of Lots 3 and 4, Block 29, Town of Hastings (known as the "Graus Building"). L_ Pursuant to Chapter 393 of the Laws of 1965, as amended, the Hastings City Council, having duly considered the matter, finds the buildings located on the above described property to be haz- ardous for the following reasons: Broken windows, combustibles placed throughout the structures; inoperative electrical systems; vermin occupancey; inoperable heating and plumbing systems; entire structure constituting fire and safety haz- ards; structural members broken and disattached. Pursuant to the foregoing and in accordance with Chapter 393 of the Laws of 1965, as amended, and M.S. 463.151 and M.S. 282.01 and 282.08 and other applicable statutes, it is hereby ordered that the above referred to structures be razed and removed prior to December 15, 1974. It is further ordered that all personal property or fixtures 0 located on the premises shall be removed by the persons owning the same prior to the above date and if not so removed, the City of Hastings may remove and sell such personal property or fixtures at private auction. Ayes, 6; Nayes, none. Councilman Driscoll moved, Councilman Kramer seconded to approve the partial payment to B-TU Mix for $22,857.62. Ayes, 6; Nayes, none. Councilman O'Connor moved, Councilman Schnirring seconded, to approve the partial payment to Arcon Construction for $6,868.66. Ayes, 6; Nayes, none. 1614 The Engineer brought forth the letter of resignation from Judith Knudson. the Engineering secretary. the Council accepted this letter of resignation and instructed the Staff to take the necessary appropriate action to see that the posi- tion was filled as soon as possio1e, and to see whether or not it might be more advantageous to make it a full time position as opposed to two part-time people occupying it at the present time RESIGNATION ENGINEER SEC. Councilman Kramer moved, Councilman Fischer sec- onded that the Engineering Staff for the City of Hastings undertake a Grade Survey and design of Third Street from Ash street to Farm Street and Farm Street from 2nd Street to 3rd. Street and report back to the Council the serious- ness of the grade problem. Ayes, 6; Nayes, none. At the request of the Engineer, Councilman Driscoll moved, Councilman Fischer seconded to order a Feasibility Study on the following pr,Dject. Ayes, 6; Nayes, none. South Frontage Road from Lyn Way to Westview Drive Bituminous surfacing, Concrete curb and gutter and sidewalk. Again, at the request of the Engineer, Councilman Kramer moved, Councilman Driscoll seconded to order a Feasi- bility Study for the following project. Ayes, 6; Nayes, none. 15th Street, from Plesant Drive to Brittany Road Bituminous surfacing, Concrete curb and gutter and sidewalk. Councilman Novak moved, Councilman Driscoll seconded, to have the Engineering Staff draw up the necessary Feasibility reports for sidewalk improvements within the City that can be done with available monies and to select prior- ities and return to the Council with this priority list for final adoption. Ayes, 4; Nayes, Councilmen Schnirring Arid Kramer. ,.-.. Councilman Novak moved, Councilman Driscoll seconded to delay any action concerning the County Courthouse move into its facilities over the weekend of October 12th, with the understanding that nothing new will be moved in the future un- less Mr. Tonsager, himself, gives approval. Ayes, Councilmen Driscoll and Novak; Nayes, Councilmen Schnirring, Kramer, O'Connor and Fischer. Motion failed. Councilman O'Connor moved, Councilman Schnirring seconded to instruct the City Attorney of the City of Hastings to take all Civil action that is necessary to perform the following two steps: 1. Obtain the necessary court order to prohibit further occupancy of the County Courthouse. 2. To conduct an investigation into the possi- bility whether criminal action should be taken, and report back to the Council at the November 4th meeting, regarding the findings of this in- vestigation. Ayes, Councilmen Schnirring, Kramer, O'Connor and Fischer; Nayes, Councilmen Driscoll and Novak. Councilman Novak moved, Councilman Driscoll seconded to approve the bills as audited and that the C structed to issue warrants for same. Ayes, 6; , none.
