The City Council of the City of Hastings, Minnesota met in a
regular meeting on Monday, November 4, 1974 at 8:00 o'clock P.M. in the
Council Chambers of the City Hall.
Members present: Councilmen Novak, Drsicoll, Fischer, O'Connor,
Hallberg, Kramer, Schnirring, Collins and
Mayor Petersen.
Members absent:
None.
Minutes of the Assessment Hearing Meeting of October 1, 1974 were
approved as amended.
Minutes of the meeting of October 21, 1974 were approved as read.

WHEREAS: it appears that Schneider Motor Inc. is the lowest
responsible bidder in furnishing the City with a Dump Truck for the
Street Department,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Hastings, Minnesota:
The Mayor and City Clerk are hereby authorized and directed to
enter into a contract with Schneider Motor Inc. for the purchase of one GMC
Dump Truck according to the specifications therefore approved by the City
Council and on file in the office of the City Clerk.

Councilman Fischer seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, 8; Nayes, none.
Councilman Kramer moved, Councilman Schnirring
seconded to approve the request of Mr. Laub, of Masters, Inc.
to plant trees and flowers on the public right-of-way in front
of their building on Tyler St. It is requested that Mr. Laub
select trees which would be small and have a limited root system,
so that future damage to curbing or utility lines in the ground
would not occur. The conditions as set forth in Mr. Marston's
memo to the Planning Commission, dated October 24, 1974 shall
apply to this approval. Ayes, 8; Nayes, none.

Councilman Schnirring moved, Councilman Hallberg seconded
to adopt the Resolution entitled: "REQUESTING INCLUSION IN THE
METROPOLITAN TRANSIT COMMISSIONS ROUTE RIDERSHIP SURVEY FOR NORTHERN
DAKOTA AND WASHINGTON COUNTIES" only with the understanding that the
City of Hastings will not have any charge to it for participating in
this study. The City of Hastings will participate only if there is
no cost to the City. Ayes, 8; Nayes, none.
At this time Mr. Marston reported on a resolution concerning
the Housing Redevelopment Authority in the City of Hastings, no action
was required at this time and the Council took no action due to the
fact that the HRA has a meeting scheduled for later this week to con-
sider this very issue.
Councilman Novak moved, Councilman Hallberg seconded to
approve the sale of 2.097 acres in Industrial Park to Mr. Tony Kramer,
at the approved purchase price of $10,000 an acre. Ayes, 7; Nayes,
none. Councilman Kramer abstained.

At this time a Petition signed by 126 residents of East
Hastings was presented to the Council by the City Administrator. The
Council officially accepted it for the record. The Pe~ttion read
as follows: "The people of the First Ward want to let it be known
that we do not want any more property of the East end of town to be
commercialized. In fact we want the property to be restored from
Commercial zone to Residential zone".
The City Administrator stated that there were no applica-
tions before the government for a re-zoning in East Hastings at
this time.
Councilman Driscoll moved, Councilman Fischer seconded to
enforce the two-hour parking requirement on the Second street area
and the surrounding environs in which the two-hour limit is posted.
For the first two weeks starting November 5th, the police department
of Hastings will issue warning tickets. Effective November 20, 1974,
the police department will begin issuing the normal traffic violation
ticket, in which a fine will be imposed for violation of the two-hour
parking limit in posted zones in the Second street area. Ayes, 8;

Mr. Marston reported that the Annexation report was still
in draft form and hopefully the final document would be ready for
presentation by the November 18th meeting.
Councilman Hallberg moved, Councilman Novak seconded to
approve a refund of the 1973 Special Asseijsments that were re-assessed
in 1974 to the following individuals and for the following amounts:

CONTINUE DAKOTA adopt the Resolution entitled: "In Support of the Continuance of
COUNTY RD. & Dakota County Road and Bridge Fund Monies to the City of Hastings" and
BRIDGE FUND stated that these funds should continue to support the City's main-
MONIES TO CITY tenance program until such time that a levy limit adjustment can
be made in the State government, which would allow the City to make
up for the estimated loss of these funds through some other legal
means. Ayes, Councilmen Novak, Fischer, O'Connor, Kramer, Schnirring
and Hallberg; Nayes, Councilman Collins and Driscoll. Motion carried.

Councilman Kramer moved, Councilman Fischer seconded to approve
the appointment of Eileen Gaddes, 1010 W. 14th Street, Hastings, as the
secretary to the Engineer and that the City Administrator be allowed
to establish a step increase method for a salary in that position over a
period of three separate six month intervals. Ayes, 8; Nayes, none.

Councilman Driscoll moved, Councilman Novak seconded
to approve James A. Putz as an individual who has successfully
completed his six month probationary period as a patrolman on
the Hastings Police Force and is now being promoted to a full
time regular Patrolman on the police force. Ayes, 8; Nayes, O.
Councilman Novak moved, Councilman Driscoll seconded
to approve the expenditure of $25.00 for the purpose of sending
Thomas Simmons to attend a conference at the League of Munici-
palities office concerning the Fair Labor Standards Act, and to
bring the necessary information back so that the City of Hastings
can do what is necessary to comply with the standards under the
law. Ayes, 8; Nayes, none.
Councilman Driscoll moved, Councilman Hallberg
seconded to take off of the table, the proposed water and sewer
rates as presented by the engineering firm of TKDA. Ayes, 7;
Nayes, Councilman Novak. Motion carried.
Councilman Schnirring moved, Councilman Kramer sec-
onded to move the first reading of the water and sewer rates as
proposed in the November 4th letter of TKDA. Ayes, 5; Nayes,
Councilmen Collins, Driscoll and Novak. Motion carried.
Councilman Hallberg moved, Councilman Schnirring
seconded to establish a Public Hearing for November18, 1974
on the water and sewer rates, as proposed in the Study of TKDA,
and presented in their letter of November 4, 1974. Ayes, 8;
Nayes, none. The Council informally asked the Staff to mail the
new proposed rates to the same Industries that previous notice
had been mailed to, concerning the initially proposed rates.

At this time, the City Administrator informed the
Council of a letter which he had received concerning Mr. Ra1phe's
request from the Meyer Company, for the City to vacate the en-
trance way into the basement to the City Hall building. After
a general discussion with the Council, the Council instrudted
the Administrator to work out the necessary arrangements, and to
see if it is at all feasible to establish another entrance to
the basement. At this time it is not the City Council's desire
to fight the request of Mr. Ra1phe, but that hopefully a satis-
factory arrangement can be reached in due time.
Councilman Novak moved, Councilman Hallberg
seconded to approve two election judge replacements for the
general election of November 5, 1974. To replace Mrs. Paul
Klein with Mrs. Reino1d Fox, in the First Ward, and Mrs. June
Jelley replacing Mrs. Donald Sagissor in the Fourth Ward.

Councilman Driscoll moved, Councilman Collins
seconded to approve Mr. Frank Truax as the Assistant Fire Chief
and Fire Marshall to the City of Hastings. At this time
Councilman Kramer moved to table the consideration of Mr. Truax
for a two week period of time and that it be brought up again
at the meeting of November 18, 1974. Councilman Schnirring
seconded the motion. Ayes, 6; Nayes, Councilman Collins and
Driscoll. Item tabled.
Councilman Schnirring moved, Councilman Fischer
seconded to approve the setting aside, at this time, the EPA
refund monies in the amount of approximately $180,000, for the
purpose of being applied toward the Vermillion River Flood
Control Project, which is currently being reviewed by the United
States Corp of Engineers. Be it further understood that the
setting aside of this money is being done now until such time as
the Council, in the future, can make a decision as to the exact
allocation of the cost of these projects, and it does not in any
way mean that the Council may not eventually decide to, either
fund all of the project of the EPA fund, or possibly assess all
or a portion of it to the benefitted properties. The point of
the motion is to merely set aside the monies for use in this
area, if it is so desired by the Council at a future date.

Councilman Driscoll moved, Councilman Novak seconded to
approve the expenditure of $100 from Federal Revenue Funds for
the purpose of buying supplies, of an office type nature for the
Bicentennial Commission, which is in the process of establishing
programs and getting organized for its various activities.

At this time the City Administrator reminded the City
Council members that at 5:00 o'clock, Wednesday afternoon, at
City Hall would be the most appropriate time to canvass the ballots,
and requests that all Councilmen be present.
The City Attorney, at this time brought the Council up-
to date concerning the legal actions the City of Hastings has taken
in regard to the new County Courthouse. The County Judge has signed
the order which prevented the County from moving any further depart-
ments into the new building, and a hearing on this matter has been
set for November 7, 1974. It was also brought to the Council's
attention, at this time, that a letter from the County Attorney,
requesting the building inspector to accompany the contractors and
the architects inspectors for a detailed inspection of the City
this week, was sent to the City, and we will be happy to assist them
in this matter.
Councilman Driscoll moved, Councilman O'Connor seconded
to approve the B-TU Mix request for an extension of contract time to
November 15, 1974. Ayes, 7; Nayes, Councilman Kramer.
Councilman Driscoll moved, Councilman O'Connor seconded to
approve the street light on Eddy St., from 15th to 16th street.

Councilman Hallberg moved, Councilman Novak seconded to
