HomeMy WebLinkAbout12-18-74 1629 Hastings, Minnesota November 18, 1974 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, Movember 18, 1974 at 8~00 o'clock P.M. in the Council Chambers of the City Hall. Members present: Councilmen Novak, Driscoll, Fischer, O'Connor Lramer, Collins and Mayor Petersen. I- Members absent: Councilmen Schnirring and Hallberg. The Mayor asked if there were any corrections or additions to be made to the Minutes of the SpeciaLmeeting of the City Council held on October 30, 1974. There being none, the minutes were approved as read. The Mayor called for corrections or additions to the minutes of the regular meeting of the Council of November 4, 1974. There were none, the minutes were approved as read. The Mayor then asked if there were any corrections of additions to be made to the Minutes of the special meeting held on November 6, 1974 for the purpose of canvassing the election returns. There being none, the minutes were approved as read. The Mayor opened the Public Hearing concerning the drainage and utility easements on Dakota Hills 4th Addition at 8:04 P.M. The City Administrator noted that the public hearing had been duly published in the newspaper, the mailings had been certified and the public hearing had been properly called. After all those present were given an opportunity to be heard on the matter, the Mayor closed the public hearing at 8:06 P.M. PUBLIC HEARING DRAINAGE & UTILITY EASEMENTS DAKOTA HILLS 4TH ADD. I Councilman Novak moved, Councilman Fischer to vote for the approval of the drainage and utility for Dakota Hills 4th Addition Ayes, 6; Nayes, none. file in City Administrator office. The Mayor opened the public hearing on the proposed water and sewer rates and the second reading of same at 8:07 P.M. The Administrator at this time noted that all the proper notifications of the hearing had been performed and the public hearing had been properly called. After those present had an opportunity to be heard concerning the proposed rates, the Mayor closed the public hearing at 8:25 P.M. seconded easements Copy on RESOLUTION 41 1/1- PUBLIC HEARING WATER & SEWER RATES 2ND READING Councilman Novak moved, Councilman Driscoll seconded to approve the proposed water rates of the TKDA study as listed: Ayes, 6; Nayes, none. Motion to include 2nd. reading of same. Being a tie vote, the Mayor voted naye. Motion failed, sewer rates were not approved. Councilman Novak 'moved, Councilman Collins seconded to approve the special use permit for Charles Huberty, 308 w. 13th Street, with the following conditions: Ayes, 6; Nayes, O. 1. That the home occupation (barber shop) be closed upon completion of the apartment. 2. The off-street parking spaces should be provided as required by ordinance. 3. The petitioner's apartment should be limited to a one bedroom unit because anything more than that would re- quire at least a 9,200 square foot lot, which the petitioner does not have. Councilman O'Connor moved, Councilman Driscoll seconded to establish a public hearing for December 10, 1974 to consider the Downtown Redevelopment Project. It is under- stood that Council will have an opportunity to review the report from the consultants prior to this meeting. Ayes, 6; Nayes, none. Dexter Marston presented to the Council his Annexation Report, the Council accepted the report and re- quested that this item be held over until the December 2nd Agenda where it again should be brought before the Council for discussion. r-- Councilman Driscoll moved, Councilman Novak seconded to approve Mike Gegen, 1128 W. 15th Street, as the new member for the Hastings HRA Committee. Ayes, 5; Nayes, Councilman Kramer. Councilman Driscoll moved, Councilman O'Connor seconded to approve the attendance of Mr. Marston to the Minn. NAHRO Conference, December 5 & 6 at Bloomington and to pay the $50.00 registration fee. Ayes, 6; Nayes, none. Councilman Kramer moved, Councilman Fischer sec- onded to approve the request of Modifications as specified in a letter dated November 6, 1974, and signed by Dexter Marston, which relates itself to Items 10 and 12 of a previous council resolution which was adopted on August 19, 1974, concerning a 109,050 sq. ft. GLA Shopping Center. The city of Hastings agrees to Item #10 and #12 as interpreted in Mr. Marston's letter and so amend the previous motion of August 19, 1974. Ayes, 6; Nayes, none. The City Administrator discussed with the Council the Oak tree inspection proposal from a Dr. French from the University of Minnesota. The Council decided that it would be beneficial to have the survey performed as long as there would be no cost to th~~i~d instructed the City Administrator to pass on to Dr. French the Council's desire to see the survey done. Mr. Michael O'Connor gave a report concerning the status of the Bicentennial Committee and asked that the entire Council pass a motion designating the Bicentennial Committee as an official committee of the city. Councilman Novak moved, Councilman Drsico1l seconded to hereby officially appoint the Bicentennial Committee as a Committee duly appointed by the Hastings City Council. COUNCIL RAZE VIRTUE MOORE PROPERTY Councilman Kramer moved, Councilman Fischer seconded to remove from the table the appointment of Mr. Truax as the Assistant Fire Chief, from the November 4, 1974 meeting. Ayes, 6; Nayes, none. Councilman Driscoll moved, Councilman Novak seconded to approve the appointment of Mr. Truax as the Assistant Fire Chief and Fire Marshall for the city of Hastings. Ayes, 6; Nayes, none. The City Administrator explained to the Council that bhis coming Saturday a meeting was going to be held among several muni- cipalities concerning the proposed NSP rates. At this time the Council instructed the Administrator to attend the meeting and obtain addi- tional information as to what would be involved if the city joined with other municipalities in a joint powers act to challenge the rates and present a case against the increase. The Council wants additional information on this matter and what cost would be involved to the City. The Administrator will report back to the Council at the next regular council meeting regarding the information obtained. r--'" Moved by Councilman O'Connor, seconded by Councilman Kramer to grant a six month extension of time to Refining Systems Incl with the understanding that Refining Systems will have to pay 8% on the unpaid balance of their fee due from the October 21st date until such time as the amount is paid in full. Be it further resolved that the city of Hastings will delay payment to the Calder Corp. for their fee until the full payment is received for the land itself, by the city. Ayes, Councilmen Kramer, O'Connor, Fischer; Nayes, Councilmen Collins, Driscoll and Novak. Being a tie vote, the Mayor cast a vote in the negative. Motion defeated Moved by Councilman Novak, seconded by Councilman Driscoll to grant a six month extension of time to Refining Systems Inc. for their payment for the land purchase in Industrial Park. The extension would be from the October 21st, 1974 date. Ayes, Councilmen Collins, Driscoll and Novak; Nayes, Councilmen Kramer, O'Connor and Fischer. Being a tie vote, the Mayor voted in the affirmative. Motion carried. Councilman Driscoll moved, Councilman O'Connor seconded to approve the appointment of Diane Latuff as the new part-time secretary for the Engineering department, effective date, November 13, 1974 at a salary of $2.50 per hour. Ayes, 6; Nayes, none. 1'--'" I . I I U The City accepted the letter from the Insurance Underwriter Agency which stated that the Hastings fire rating had been changed from a Class 6 to a Class 5. The Mayor, at this time appointed Ronald Hillmer and Gordon Andersoril:s as new Sergeants on the Police Force and asked the Council for a vote to support this appointment and insure that the city records will reflect the appointment accordingly. Councilman Driscoll moved, Councilman Collins seconded to approve the Mayor's appointment of Mr. Hillmer and Mr. Anderson to the rank of Sergeant on the Hastings Police Department. Ayes, 6; Nayes, none. - t::: ~ --.:t _. - t\: Councilman Fischer moved, Councilman Kramer seconded to forward the name of Ewald Fischer as a candidate for the position of Metropolitan Council representative from the area that Hastings is located in. Ayes, 5; Nayes, Councilman Novak. Councilman Driscoll moved, Councilman Fischer seconded to declare the Virtue Moore property, which is located behind the Red Owl store on Eddy St. as being dilapitated and uninhabitable, lagalwYldesertbed as Lot 8, Block 80, Town of Hastings. The City Attorney reported that the owner's guardian had indicated a will- ingness to have the structures removed and the cost thereof assessed against the propeEtYt therefore the following order for removal be passed and the matter processed according to the Statutes: Ayes, 6; Nayes, none. -- 1632 ORDER FOR REMOVAL CITY OF HASTINGS IN THE MATTER OF THE HAZARDOUS BUILDING LOCATED AT 12TH AND EDDY STREET LEGALLY DESCRIBED AS LOT 8, BLOCK 80, TOWN OF HASTINGS TO: VIRTUE MOORE AND JENNIE GLASS, HER GUARDIAN Pursuant to Chapter 393 of the Laws of 1965, as amended, the City Council of the City of Hastings having duly considered the matter finds the buildings located on the above described property to be hazardous, dil- apidated and incapable of occupancy or repair for the following reasons: I The City Council of the City of Hastings after receipt of numer- ous complaints from numerous persons ordered an inspection and a report thereof to be made of the above described premises. Said report was sub- mitted by the Building Inspector and Fire Marshal of the City of Hastings. The report states that the buildings on the property are very dilapidated and in an extreme state of disrepair. That the structures are not served by utilities. That they are infested by vermin. That the structures are in violation of numerous provisions of fire and building codes. That the property is not serviced by operable plumbing and heating. That the property is not presently occupied and there appears no likelihood that it will be occupied nor that it could be occupied by human beings in its present condition. Foundations, walls, floors, and ceilings are deteriorated and crumbling. There are numerous instances of patching, sagging and buckling. The outbuildings are dilapidated, falling down shacks and the entire property, including all structures, constitute a severe fire hazard. .---- Pursuant to the foregoing and in accordance with Chapter 393 of the Laws of 1965 it is hereby ordered that the above hazardous buildings be razed and the debris removed within thirty (30) days of the date of the service of this order. It is further ordered that all personal property or fixtures that may unreasonable interfere with the razing of the building be removed within fifteen (15) days and if not so removed, the City may remove themself such personal property or fixtures at private auction. You are further advised that unless such corrective action is taken or an answer is served upon the City of Hastings and filed in the office of the Clerk of District Court of Dakota County, Minnesota within twenty (20) days from the date of the service of this Order upon you, a motion for summary enforcement of this Order will be made to the District Court of Dakota County. You are further advised that if the City of Hastings is compelled to take any corrective action h all necessary costs, ex- pended by said City will be assessed against the r al estate and collected as other taxes. BY ORDER OF THE CITY COUNCIL THIS ... ~_. .,....".~~...._- ATTEST: ~ Yo/ V Administrator The City Attorney presented a copy of the Court hearin~ which was held on November 7, 1974, which continued the in- junction against the County prohibiting them from moving addi- tional people into the new county courthouse until such time as it has been properly inspected and certified for occupancy by the Building Inspector of the City of Hastings. It is the Council's desire, at this time to con- .tinue with the present system, beginning the council meetings at 8:00 o'clock and conducting the business meetings as usual. Councilman Driscoll moved, Councilman Novak seconded to approve the partial payment to B-TU Mix for 1974 construction, Proposal #1, for the sum of $39,869.10. Ayes, 6; Nayes, none. Councilman Kramer moved, Councilman Fischer seconded to approve the partial payment to A. Kamish & Sons for R.R. grading in Industrial Park in the amount of $11,568.23. Ayes, 6; Nayes, 0 The City Engineer presented a revised assessment policy and alternatives for Council's consideration at this time. The Council accepted the report and suggested that it be put on the December 2, 1974 agenda for further review and discussion.
