The Acting Ivmyor asked for any corrections or additions to the ~Iinutes of the meeting of January 16, 1978 and hearing none declared the IvIinutes approved as read. TIle Public Hearing to consider ele request' to rezone from A and A Flood Fringe to R-l and R-l Flood Fringe approxi- mately 3 acres North of County Highway #47 and West of the Vermillion River, said property owned by Harold Welch and Russell Welch, \Vas opened at 7:30 P.M. The Administrator read into the record the legal notices of the Hearing. There were no objections to the rezoning. TIle Hearing was closed at 7:35 P.M. PUBLIC HEARING REZONE WELaI PROPERTY I lIIoved by Councilman Karnick, seconded by Councilman Shannon to approve the second reading of the Amendment to the Zoning Ordinance to rezone from A and A-Flood Fringe to R-1 and R-l Flood Fringe approximately three acres North of County Highway #47 and West of the Vermillion River, O\'ffied by by Harold \\Teldl and Russell Welch. Ayes, 7; Nayes, none. Councilman S11annon introduced the follO\~ing resolution and moved its adoption: SECOND READING REZONE WELaI PROPERTY RESOLUTION CALLING FOR AN ELECTION ON $88,000 GEiERAL OBLIGATION BONDS FOR LAKE REBECCA PARK IMPROVFJ.tENTS RESOLUTION #143-78 CALL FOR SPECIAL ELECTION LAKE REBECCA REFERENDlR-.f WHEREAS, the City O1arter and State Statutes authorize tile City of Hastings to issue General Obligations Bonds to parti- cipate \'lith the Corps of Engineers in the improvement of the Lake Rebecca area by encouraging an installation of recreational facilities and otiler open space and park improvement; and WHEREAS, the City Council is resolved to issue General Obligation Bonds or to incur long term indebtedness to the United States Government in an amount not to exceed $88,000 (in addition to ele $50,000 heretofore autllorized purs'uant to Resolution #20-76 adopted by tile City COlU1cil of the City of Hastings March 29, 1976), for the City's share of said improvement; and WI.1EREAS, the City Council desires said improvemem:!"' to occur and determines the same to be a public purpose; and W'rIEREAS, the issuance of said bonds is subject to approval of the electorate at a special election on said matter and the Council wishes to provide for said special election on said matter: l NO\V, TI-IEREFORE, BE IT RESOLVED by the City Council of the Ci ty of Hastings, I,Iinnesota, as follows: 1. That a special election is hereby called for ~mrch 21, 1978, from 7:00 o'clock a.m. to 8:00 o'clock p.m. 2. The entire City shall constitute one election district. TIle sole polling place shall be the auditorium lobby of the Senior High Sdloo1 located at 11th and Pine Streets, I.mstings, }Iinnesota. 213 3. Each qualified elector of the City may cast his or her ballot at the polling place. 4. The issue submitted for election shall be as set forth in the next following paragraph setting forth the notice of S~cial Election. 5. The Clerk shall cause to be published in the official newspaper, as required by law, the following notice. "Shall the City of Hastings, Minnesota, through its City Council, be authorized to borrow money by issuing General Obligation Bonds or by otherwise incurring a long term obligation supported by the full faith and credit of the City, in an amount not to exceed $88,000 (in addition to a previously authorized amount of $50,000), for the improvement of Lake Rebecca and the Lake Rebecca Park area." For purposes of this election, the entire City of Hastings shall constitute one election district. The polling place for said district shall be the lobby of the auditorium located in the Hastings Senior High, 11th and Pine Streets, Hastings, MiIUlesota. The Clerk shall further cause the above Notice of Election be posted in three (3) places ten (10) days before said election and the above Ballot to be posted four (4) days before said election, both posting of Notice and Ballot to be at the polling place and other conspicuous places in the City. 8. Said election shall be held and conducted in accordance with the City Charter and Statutes of the State of Minnesota applicable thereto. The Council shall meet as required by law for the ~Qse of canvassing said election and declaring the results. Moved by Councilman Trautmann, seconded..hy Councilman Karnick to approve the variance from the Zoning Ordinance requiring off-street parking for the Hastings Farm ~~rket at 110 East 14th Street with the provision that the site plan for parking be approved by the Plamring Conunission. Ayes, 7; Nayes, none. No action was taken on the Petition from Mid-Continent Development Corporation and Clara & Leo Sch\..U1lacher regarding the vacation of Whispering Lane. Moved by Councilman Erickson, seconded by Councilman Karnick to approve the application for a Vending Wagon Permit for Georgene Dowell and Mary Wagner. Ayes, 7; Nayes, none. The Council was updated by the City Engineer, on the status of the Water Rate Study. No action was taken. Moved by Councilman Fischer, seconded by Councilman Trautmann to adopt a resolution whereby the City of Hastings requests the State Energy Agency to favorabl, consider the City of Hastings for the Infra Red Fly-over Program. Section 7.05. - Vacation of streets Alleys, and Easements. The CounC1.1 may by resolution approved by-at least a majority of its entire'laemb~rship, vacate any street, alley, public way, grounds, or easements or part thereof wi thin the City of Hastings. Such vacation may be made only after published notice and an oppor- tunity for affected property owners and the public to be heard, and upon such further terms and by such further procedures as the Council may prescribe. AMEND NRRC APPOINTMENTS LIBRARY BOARD APPOINTMENTS Moved by Councilman Fischer, seconded by Councilman Trutna to amend the NRRC appointments of January 16, 1978 as follows: Eugene Pitra, Jerone Kieis, and David Frauenshuh are appointed for two year terms, Richard Graham withdrew his application as there were only three vacancies.
