The City Council of the Ci ty of Has tings, Minnesota met in a
regular meeting on Monday, August 7, 1978 at 7:30 P.M. in the Council
Olambers of the City Hall.
Members present: Councilmen Shannon, Trautmann, Fischer, Novak,
Erickson, Trutna, Karnick, Collins, and Mayor
Petersen.

Members absent:
None.
The Mayor called for additions or corrections to the minutes of
the meeting of July 17, 1978 and hearing none declared the minutes approved
as read.
Dennis Palmer from Barr Engineering, the firm hired by the City
to do the Southwest Trunk Storm Sewer Study, presented an interim preliminary
report which has been put on file at City Hall. Mr. Palmer reviewed the fac-
tors that contributed to the problem and explained concepts being considered
that address problem areas. At present they are waiting for topographical
maps which the City has ordered, as the information from these maps will allow
better accuracy and detail in the drainage system analysis. The final study
is anticipated to be completed in November.
Moved by Councilman Novak, seconded by Councilman
Collins to extend the Building Moratorium now in effect, for an
additional 90 days.
Motion and second withdrawn to allow the City Engineer
time to review exceptions, primarily in the 1978 Improvements, to
any such moratorium.

Moved by Councilman Collins, seconded by Councilman
Trautmann to pass the third and final reading of the amendment
to the Anti-Litter Ordinance with the addition of the following
sentence: It is the Council's intent that 55 gallon drums be
prohibited. Ayes, 8; Nayes, none.
Moved by Councilman Trutna, seconded by Councilman
Fischer to accept the resignation of Milton Terrell from the
Planning Connnission effective August 22, 1978. Ayes, 8;
Nayes, none.
Moved by Councilman Novak, seconded by Councilman
Erickson to approve the special use permit for Donald Kluender
to operate a gravel pit North of the old municipal landfill and
West of Co. Rd. #91. Ayes, 8; Nayes, none.
Moved by Councilman Shannon, seconded by Councilman
Fischer that the request for a special use permit, submitted by
Fay Olamberlain, 1361 Blueberry Court, to rent out the basement
of their home be denied. Ayes, Shannon, Trautmann, Fischer,
Erickson; Nayes, Trutna, Novak, Karnick, Collins. A special
use permit must be passed by a 3/4 vote of the Council, there-
fore the permit is denied.
Moved by Councilman Novak, seconded by Councilman
Trutna to approve the special use permit for the Webber Ford
building expansion East of Vermillion St. and West of Hwy. 316
conditioned on the following: 1. The parking stalls indicated
along the property lines be set back 5 ft. in the rear and 10 ft.
from the right-of-way. 2. That the developers submit plans for
the new blacktopped area with elevations showing pDGposed
drainage. Ayes, 8; Nayes,. none.

a Fireplace chinmey. The ordinance requires a 7 foot setback
from a side property line. The variance would allow a 5 foot

Trautmann that a Public Hearing be called for September 5, 1978
at 7:30 P.M. to consider the request for vacation of the alley
between 1st Street and 2nd Street, from Tyler Street to the
C.M. ST. P. railroad tracks, submitted by Master Ind.

Novak to call for a Public Hearing on September 5, 1978 at
7:45 P.M. to consider the petition of David Breyer to vacate a
portion of 4th Street between Locust and Lake Streets. Ayes, 8;
Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Karnick to accept the quote received from Ace Blacktopping for
$4,913.44 for the site preparation, grave:!: base, bituminous
surfacing for the East Side Park basketball court. This quote
does not include the basketball standards or fencing. City
Staff is directed to purchase and install standards, and the
Planner is directed to request the State Planning Agency to
eliminate the fence from the Grant Agreement. Ayes, 8;

Shannon that the entire City of Hastings be designated as the
"target area" for the Minnesota Housing Finance Agency Home
'Improvement Grant Program, Phase III. Ayes, 8; Nayes, none.

Fischer to hold over the final reading of Ordinances #75 through
#86 to the August 21, 1978 meeting of the Council. Ayes, 8

Trutna to adopt the resolution accepting the bid of O'Brien
Chevrolet-Cadillac, Inc. to furnish the City of Hastings Police
Department one 1978 Chevrolet Impala 4 door Squad car at the bid
price of $6,133.33. Ayes, 8; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Trautmann to amend the motion of July 5, 1978 granting permission
to Don Olson to reconstruct a portion of his greenhouse by adding
the following sentence: "To confirm that Greenhouses are a per-
mitted use in an R-2 Zone." Ayes, 8; Nayes, none.

sentence: "The City Council authorizes the City Engineer to
