The City COlUlcil of the City of Hastings, Minnesota met in a
regular meeting on Monday, September 18, 1978 at 7: 30 P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Trautmann, Fischer, Erickson, Trutna,
Novak, Karnick, Collins, and Mayor Petersen.

The Mayor asked for additions or corrections to the minutes of the
meeting of September 5, 1978 and hearing none declared the mintues approved
as read.
The Mayor opened the Public Hearing on the adoption of PUBLIC HEARlNG EAST
the assessments for the East Hastings Sanitary Sewer and Water- HASTINGS ASSESSMENTS
main construction at 7:30 P.M. The legal notices of the hearing
were read into the record. The City Engineer gave a brief pre-
sentation of the project. Information on the total costs,
proposed rates of assessment, the areas to be assessed, etc. The
Engineer explained that the Contractor has clean up work to do
before the project is accepted by the City. Comments were received
from Peter Mitzuk, Steve Crepps, and Margaret Kordosky. Several
citizens asked about the drainage situation on East 1st. Street.
When all persons present had been given an opportunity to be heard
the Mayor declared the Hearing closed at 8:05 P.M.
Councilman Erickson introduced the following resolution RESOLUTION #192-78

RESOLUTION ADOPTING ASSESSMENTS FOR EAST HASTINGS
SANITARY SEWER & WATERMAIN EXTENSIONS - 1978

WHEREAS, pursuant to proper notice duly given as required by
law, the Council has met and heard and passed upon all objections to
the proposed assessments for the improvement of the following:

NOW, THEREFORE BE IT RESOLVED by the City Council of Has tings :
1. Such proposed assessments, a copy of which is attached hereto
and made a part hereof is hereby accepted and shall constitute the
special assessments against the lands therein, and each tract of
land therein included is hereby found to be benefited by the pro-
posed improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal installments extending
over a period of 10 years, the first of the installments to be
payable on or before the first Monday of January, 1979. Any deferred
installments shall bear interest at the rate of eight percent (8%)
per annum. To the first installments shall be added interest on the
entire assessment, from the date of this assessment resolution until
December 31, 1978. To each subsequent installment when due shall be
added interest for one year on all unpaid installments.

3. The owner of any property so assessed may, for 30 days after
notification from the City Treasurer, pay to the City Treasurer,
the whole of the assessment without interest, and he may at any
time, prior to certification of the assessment to the County
Auditor, as herein provided, pay the whole of the assessment against
any parcel with interest accrued to the date of payment to the City
Treasurer, and he may at any time thereafter pay the County Treas-
urer the entire amount of the assessment remaining unpaid.
4. The City Clerk shall forthwith transmit a certified duplicate
of this assessment to the County Auditor to be extended on the
pr tax lists of the County and such assessment shall be
ollec ed and paid over in the same manner as other municipal taxes.

Councilman Karnick seconded the motion to adopt said resolution
and the same was passed by the following vote: Ayes, 7; Nayes, none.
STIJDY DRAINAGE PROBLEM Moved by Councilman Karnick, seconded by Councilman
E. 1ST STREET Erickson that the City Engineer make a study of the drainage
problem on East 1st Street and report back to the City Council
when the study is completed. Ayes, 7; Nayes, none.
PUBLIC HEARING FEDERAL The Mayor opened the Public Hearing to receive corrnnents
REVENUE SHARING FUNDS on the possible uses of Federal Revenue Sharing Funds at 8:10 P.M.
The legal notices of the Hearing were read into the record. The
City Administrator explained that the Hearing was only to receive
written or oral corrnnents on possible uses of these funds available
to the City as part of its 1979 Budget, and that no decisions were
to be made at this time. Tom Riemer, Al Sieben, and Carole Holmes
suggested that this money be allocated for Flood Control in the
Southwest part of the City. Mrs. Robert Liska asked that consid- [i'i:.....
eration be given the Northwest Ponding Basin Area. Mr. Palmer
from Barr Engineering gave a second interim report on the South-
west Trunk Storm Sewer Study. A cPpy of this report is on file in
the City Engineer Office. The Mayor closed the Hearing at 8:38 P.M.

S.W. PONDING BASIN
Moved by Councilman Novak, seconded by Councilman
Trautmann that the City Engineer order Barr Engineering to prepare
a feasibility study on the Southwest Ponding Basin Outlet.

Moved by Councilman Trautmann, seconded by Councilman
Erickson to approve the Home Occupation Permit request for
Clifford Birkholtz, 1311 W. 17th St. to maintain an office for
keeping insurance records and storing products used as a Shaklee
Distributor. Ayes, 7; Nayes, none.
Moved by Councilman Erickson, seconded by Councilman
Trautmann to adopt the resolution accepting the bid for a 3/4
Ton 1978 Model Pick-up Truck submitted by Webber Ford-Mercury,
Inc. in the amount of $7,290.00. Ayes, 7; Nayes, none.

The next item on the Agenda was the reques t of AI
Sieben for a permit to install sewer and water connections on
his lot at 11th & Sibley Streets. Drainage is a problem in this
location. After discussion by the Council the following motion
was made: Moved by Councilman Erickson, seconded by Councilman
Karnick that the Engineering Department include in the 1979
Improvements, a feasibility study for storm sewer along Sibley
Street. Ayes, 7; Nayes, none.
A discussion was held on the request to vacate a
portion of 4th Street, from Mr. & Mrs. David Breyer. Moved by
Councilman Trautmann to approve the vacation of a portion of
4th Street. tion failed for lack of a second.
