HomeMy WebLinkAbout10-16-78 Hastings, Minnesota October 16, 1978 364 \~': The City Council of the City of Hastings, Minnesota met in a regular meeting on MOnday, October 16, 1978 at 7:30 P.M. in the Council Chambers of the City Hall. Members present: Councilmen Shannon, Trautmann, Erickson, Trutna, Novak, Karnick, Collins, and Mayor Petersen. I Members absent: Councilman Fischer. The Mayor asked for additions or corrections to the minutes of AME Ii /J the meeting of October 2, 1978. The minutes to be amended to include the ",; Nil rl 3 Federal Revenue Sharing Funds proposed allocations in the Resolution adopting ~ the Budget. They are as follows: West End Flooding- $100,000; Dutch Elm Program - $30,000; Highway #61 Improvements - $20,000; Westview Mall Lights - $40,000; Debt Service - $10,000. Minutes approved as amended. Mbved by Councilman Shannon, seconded by Councilman Trutna to deny the Special Use Permit request of James Tanner to conduct a Pre-Kindergarten School at 1501 Brittany Road. A Petition was presented to the Council opposing the request. The neighbors concern was the increased traffic on Brittany Road. Kathy Stockman spoke in favor of granting the request. The Mayor then called for the vote which was as follows: Ayes, 7; Nayes, none. Mbtion carried. Moved by Councilman Karnick to reconsider the request for a Special Use Permit from Harold Nicholls to construct a two family dwelling. Motion seconded by Councilman Trautmann. I Moved by Councilman Collins to table the request of Harold Nicholls. Mbtion failed for lack of a second. The Mayor called for the vote on the motion to reconsider. Ayes, 5; Nayes, none. Moved by Councilman Karnick, seconded by Councilman Trautmann to grant the Special Use Permit to Harold Nicholls for the construction of a two family dwelling on Walnut Street be- tween 12th & 13th Streets. Ayes, 6; Nayes, Collins. DENY SPECIAL USE JAMES TANNER 1501 BRITTANY RD. RECONSIDER SPECIAL USE PERMIT-H. NICHOLLS APPROVE SPECIAL USE PERMIT-:H. NICHOLLS Moved by Councilman Novak, seconded by Councilman Trutna to approve the following variances for the construction of a dental building as requested by Dr. M.C. Humbert. TYLER ST. sideyard setback and a variance from the required 50 foot loading dock length. The proposed length is 40 feet. The granting of the variances is conditioned upon the following: The Planning Commission shall review the drainage swale design and loading dock drainage prior to the issuance of a building permit. The conditions listed in the Council's resolution of intent to vacate the alley be met: a) That the owner of the properties to the North of the alley acquire the narrow strip of land to the South of the alley so as to allow proposed expansion of structure presently existing North of the alley. b) That the petitioner will pay all costs involved in relocation of any utility lines existing in the alley which the City requires to be relocated. c) That existing well be capped off as required by applicable Codes. d) That by dedication or easements, as the City may determine, provision be made for an access road or driveway fron 2nd St. Northerly along the Westerly edge of the existing railroad tracks to the Local Oil facility. e) That the vacation not extend more Easterly than a Southerly extension of the East line of the building presently located North of the alley. Moved by Councilman Shannon, seconded by Councilman Karnick to pass the first reading of the amendment to the Zoning ordinance, Sections 10.07 & 10.08 granting greater driveway entrance widths. Also to call for a Public Hearing on the amendment for November 6, 1978 at 7:30 P.M. in the Council Chambers of the City Hall. Ayes, 7; Nayes, none. W (assume bearing) a distance of 435.20 ft., thence N 6lDc143 M 30 Sec E a distance of 170.30 ft., to the east property line of Lot 5, thence SlID 35 M 08Sec. E a distance of 477.73 ft to the south property line, thence N 89D 33M OOSec. W a distance of 54.92 ft. to the point of beginning, containing 1.147 acres, to: Jerry Grot john. Purchase price of $11,147.00 paid in cash. Ayes, 7; Nayes, none. The bids for the lease of 106.6 acres of farm land in the Industrial Park were opened at 2:30 P.M. on Friday, October 13, 1978. Bids were as follows: Carlson Brothers $50.00 per acre Gordy Bauer $42.00 per acre Harlan Herman $35.75 per acre Moved by Councilman Erickson, seconded by Councilman Trutna that the bid be awarded to Carlson Brothers at $50.00 per acre, the highest bidder. The lease is for the 1979 and 1980 crop season. Ayes, 7; Nayes, none. APPROVE CONSENT AGENDA Moved by Councilman Shannon, seconded by Councilman Erickson to approve the following items on the Consent Agenda: Ayes, 7; Nayes, none. a) Partial payment: Pine Bend Paving, $48,809.70 (1978 Improv- men ts ) AWARD BID-LEASED FARM LAND IND. PARK INSTALL FURNACE & AIR CONDITIONER 2ND FLOOR CITI HALL b) All bills as audited. Moved by Councilman Shannon, seconded by Councilman Trautmann to authorize the City Administrator to accept the quote from O'Connor-Kranz Company, in the amount of $5,338, to furnish and install a new horizontal gas furnace and electric air condi- tioning units, together with the necessary ductwork, for the second floor of City Hall. Other quotes were solicited with'no response to the City. Immediate action is necessary due to incle- ment' weather-- conditions. Ayes, .7; Nayes, none. DELETE 1978 IMP. PROJECT Moved by Councilman Erickson, seconded by Councilman 41H ST. ASH TO FARM Karnick to delete from the 1978 Improvement Project: 4th Street surfacing, curb and gutter, Ash to Farm Street, and direct the City Engineer to notify Pine Bend Paving of said deletion from their 1978 City contract. EXPAND SCOPE STORM DRAINAGE STUDIES Moved by Councilman Erickson, seconded by Councilman Karnick to expand the scope of work under current13arr Engineering contract to include comprehensive storm drainage studies for undeveloped lands immediately adjacent to or within the City limits as per the recommendation of the City Engineer. In lieu of granting an easement to the City the Hastings Development Corporation is willing to give the City ownership of the land including all other lands still held by the corporation on either side of the Verm- illion River.
