The City Council of the City of Hastings, Minnesota met in a
regular meeting on ~bnday, November 6, 1978 at 7:30 P.M. in the Council
Chambers of the City Hall.
Members present: Councilmen Shannon, Trautmann, Fischer, Trutna,
Novak, Karnick, Collins, and ~fuyor Petersen.

Members absent:
Councilman Erickson.
The Mayor called for additions or corrections to the minutes of the
meeting of October 16, 1978 and hearing none declared the minutes approved
as read.
The Public Hearing to amend the Zoning Ordinance in
regard to driveway entrance widths was not held because the
Hearing notice was not published. ~ved by Councilman Fischer,
seconded by Councilman Karnick to reschedule the Publi Hearing
for the next Council meeting on November 20, 1978 at 7:S0 P.M.

Moved by Councilman Novak, seconded by Councilman
Trutna to approve the Home Occupation Permit request for Keith
LaValla, 1950 Walnut Street to repair guns at his home, contin-
gent upon the City receiving a copy of the federal license issued
to Mr. LaValla. Ayes, 7; Nayes, none.

The Council held a discussion regarding impound lots
in the Industrial Park. It was determined that impound lots
are not a permitted use in the Park. The Industrial Park
Advisory Board recommended that the proposed impound lot be
located in another area in the Park. They also recommended
further study to determine a site in the Park for this use and
if there is a suitable site, this land should be rezoned to
accomodate this. The Council decided to hold over this item to
the November 20th meeting of the Council. The City Administrator,
along with Mr. Erickson and Mr. Grot john, is to review locations
and report to the Council at the November 20th meeting.

Shannon to rescind the Council approval, given at the October
16, 1978 meeting of the Council, of the sale of 1.147 acres of
land in the Industrial Park to Jerry Grot john. Ayes, 7;

The next item on the Agenda was the building permi t
applications for Townhouses in Whispering Oaks 3rd Addition,
Phase II. The Council felt that there are concerns regarding the
elevations, location, and construction of Whispering Lane and
their relation to the proposed development; surface drainage; and
developer performance which must be resolved before additional
development should occur. Fred Kippur, attorney for the developer
of the Townhouses, stated that because the Council had previously
approved the Plat and the Development Agreement between his client
and the City, construction should not be delayed. Moved by
Councilman Novak, seconded by Councilman Shannon to table the
issue until the City has received and reviewed recommendations
from the drainage study, are assured of the construction of
Whispering Lane, and have executed assurances of compliance with
developer commitments.
Moved by Councilman Collins, seconded by Councilman
Trautmann to pass the first reading of the amendment to Chapter
3 of the City Code with regard to days and hours of operation
of Liquor Licensees, allowing Off-Sale liquor establishments
to be open Monday through Friday of the week until 10:00 P.M.

subject to proof of ownership by tile State Liquor Commissioner.

Collins to approve the issuance of a Sunday On-Sale Liquor
License for the Eagles Club, 1220 Vermillion Street, Hastings,

Novak to approve the following changes in Election Judges and
Registrar. Mary Teuber to replace Mrs. Larry Hunter, Mrs. Ann
Minnaert to replace Freda Christensen, as Election Judges and
Patricia McNamara to replace Helen Schoen as Registrar.

John Simser, representing the residents from the
drainage problem area of Conzemious Park and the Southwest
ponding Basin presented the Council with a Petition requesting
that certain drainage problems be resolved immediately. A copy
of the Petition is on file in City Hall. The Council explained
that action regarding these requests could not be taken until
the Barr report was received. Moved by Councilman Trautmann,
seconded by Councilman Novak to accept the Petition and instruct
Barr Engineering to include the items in the Petition in their
study of the overall drainage report. Ayes, 7; Nayes, none.
