The City Council of the City of Hastings, Minnesota met in
a regular meeting on Monday, January 7, 1985 at 7:30 p.m. in the Council
Chambers of the City Hall.
Members Present: Councilmen Berg, Werner, Kulzer, Bond, Nesbitt,
Plan, Mathiowetz, and Mayor Stoffel.
Members Absent: Councilman Trautmann.
The City Administrator/Clerk administered the oath of Office
to the newly elected Mayor and Council Members.
The Mayor called for additions or corrections to the minutes
of the year end meeting of December 31, 1984 and hearing none declared
the minutes approved as presented.
The Mayor declared the public hearing open at 7:33
p.m. to consider a petition to vacate all of the utility
easements at Lincoln Lane. The City Planner reviewed the
proposed vacation with the City Council. All persons wishing
to speak on the matter were given the opportunity to do so.
No one wished to speak on the matter. The Mayor declared the
public hearing closed at 7:34 p.m.
The Mayor declared the public hearing open at 7:34
p.m. to consider a street vacation at Franklin Street. The
City Planner reviewed the matter with the City Council. All
persons wishing to speak on the matter were given the oppor~
tunity to do so. No one wished to speak on the issue. The
Mayor declared the public hearing closed at 7:38 p.m.
Moved by Councilman Berg, seconded by Councilman
Mathiowetz to deny the Street Vacation.
Moved by Councilman Bond, seconded by Councilman
Plan to table the matter of the Street Vacation at 901 East
2nd Street (Franklin Street) until the February 4, 1985 regular
City Council meeting giving the Planning Committee of the Council
an opportunity to review this matter. Ayes, 7; Nayes, None.
Moved by Councilman Werner, seconded by Councilman
Plan to pass the 3rd and Final Reading of Ordinance #170
amending Section 10.07, Subdivision 2, of the City Code
having to do with general requirements for a mobile home
park. Ayes, 7; Nayes, None.
Moved by Councilman Werner, seconded by Councilman
Kulzer to refer the matter of an ordinance amendment, dealing
with planned residential developments, to the Planning Commis-
sion to review the present ordinance and present concepts for
proposing a district which would allow for the development
for Council review. Ayes, 7; Nayes, None.
Moved by Councilman Werner, seconded by Councilman
Berg to approve the final plat of Gretchen's 1st Addition
with the stipulation that the park dedication fee be paid
and the development contract be signed by the proper
authorities. Ayes, 7; Nayes, None.
Moved by Councilman Bond, seconded by Councilman
Mathiowetz to table the matter of the excess property request
at Cannon Street until the February 4, 1985 regular City
Council meeting giving the Planning Committee of the Council
an opportunity to review this matter. Ayes, 7; Nayes, Noneo
Moved by Councilman Werner, seconded by Councilman
Nesbitt to adopt the Resolution No. 1-85 vacating a utility
easement - Lincoln Lane. Ayes, 7; Nayes, None. Copy of

Nesbitt to adopt the Natural Resources and Recreation Commission
budget for 1985 which would include using $30,000 from the 1985
Federal Revenue Sharing Budget for the lighting of two (2)
softball fields at the complex. Ayes, 7; Nayes, None.

with the understanding that any new teams partici-
pating at the Complex in 1985, their users fee will

ation of a gate.

Bond to appoint Councilman Trautmann as Acting Mayor.
Moved by Councilman Plan, seconded by Councilman
Nesbitt to select Councilman Werner as Acting Mayor.
Moved by Councilman Berg, seconded by Councilman
Mathiowetz to select Councilman Nesbitt as Acting Mayor.
The Council, by paper ballot, voted as follows:
Trautmann, 3 votes; Councilman Werner, 2 votes; and Council-
man Nesbitt, 2 votes.
DESIGNATE LEGAL
NEWSPAPER
Moved by Councilman Berg, seconded by Councilman
Kulzer to name the Hastings Star-Gazette the official legal
newspaper for the City of Hastings for the year 1985. Ayes,
7; Nayes, None.

Moved by Councilman Nesbitt, seconded by Councilman
Mathiowetz to approve the following as depositories for City

DEPUTY TREASURER Nesbitt to appoint Wallace H. Erickson as the City Treasurer
and Barbara C. Thompson as the Deputy Treasurer for the calendar
year 1985. Ayes, 7; Nayes, None.

Nesbitt to appoint Wallace H. Erickson as the Industrial
Park Director for 1985. Ayes, 7; Nayes, None.
Moved by Councilman Kulzer, seconded by Councilman
Werner to appoint Beverly Bacon to fill the unexpired
vacancy on the Cable Commission. Her term would expire
12-31-85. Ayes, 7; Nayes, None.
Moved by Councilman Nesbitt, seconded by Councilman
Plan to adopt the 1985 Cable Budget as follows: Ayes, 6;
Nayes, Bond.

The City Administrator/Clerk discussed with the
Council the current status of the Hydroelectric Plant.
Moved by Councilman Kulzer, seconded by Councilman
Bond to reduce the Hastings Hockey Senior Hockey Team's ice
time fees by $1,000 in support of the tournament to be held
in Hastings. Ayes, 6; Nayes, Nesbitt.
The City Administrator/Clerk discussed with the
Council a possibility of holding a joint meeting with the
Dakota County Commissioners and the City Council to discuss
the Library matter, the City Hall, Water Tower Location, and
other related matters concerning both bodies. It was the
concensus of the Council to try and schedule such a joint
meeting.
The City Attorney reviewed the Charter and informed
the Council that the selection of Acting Mayor took a majority
vote of the entire Council (5 votes). The Council then voted
by paper ballot again but could not arrive at a majority vote.
Councilman Nesbitt withdrew his name from the
nominations.
The Council then voted by oral vote.
Moved by Councilman Berg, seconded by Councilman
Nesbitt to appoint Councilman Werner as Acting Mayor.
Ayes, 4; Nayes, Kulzer and Bond. Abstained, Werner.
Moved by Councilman Bond, seconded by Councilman
Kulzer to appoint Councilman Trautmann as Acting Mayor.
Ayes, 3; Nayes, Mathiowetz, Plan, Nesbitt, and Berg.
Moved by Councilman Nesbitt, seconded by Councilman
Berg to appoint Councilman Kulzer as Acting Mayor. Ayes,5;
Nayes, Werner and Kulzer. Motion to appoint Councilman Kulzer
as Acting Mayor passes.
Moved by Councilman Berg, seconded by Councilman
Werner to pass the 3rd and Final Reading of an Ordinance #171
establishing a Street Improvement Assessment Policy. Ayes,
7; Nayes, None.

Werner to accept Staff's recommendation that the City of Hastings
pay 45% of the Commissioners Award for damages for the permanent
easement that the City required across the property of Richard
T. Olson along West 2nd Street from the N.W. Ponding Construction
Account ($3,375.00)w Ayes, 7; Nayes, None. Copy of Resolution
on file.
Moved by Councilman Plan, seconded by Councilman
Nesbitt to 1) Pay all bills as audited; 2) Partial Sidewalk
Reimbursement - Mike Kasel, 709 Ramsey - $392.50. Ayes, 7;
Nayes, None.
Moved by Councilman Nesbitt, seconded by Councilman
Berg to have the City Staff prepare a letter to the Metroplitan
Council and the State Legislature stating that the City Council
does not feel that State dollars or Metropolitan Council funds
should be spent to upgrade the utilities in St. Paul, Minneapolis,
and So. St. Paul. Ayes, 7; Nayes, None.

Berg to adjourn the meeting at 8:40 p.m. Ayes, 7; Nayes,
None.
