HomeMy WebLinkAbout01-21-85 Hastings, Minnesota January 21, 1985 The City Council regular meeting on Monday, Chambers of the City Hall. 005 of the City of Hastings, Minnesota met in a January 21, 1985 at 7:30 p.m. in the Council Members Present: Councilman Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan, Mathiowetz, and Mayor Stoffel. Members Absent: None. .~ I I The Mayor called for additions or corrections to the minutes of the meeting of January 7, 1985 and hearing none declared the minutes appoved as presented. Moved by Councilman Bond, seconded by Councilman Kulzer to appoint Edith Kaiser and Tom Ditty to the Planning Commission. These Commissioners will be serving their first term with terms expiring 12-31-86. Ayes, 8; Nayes, None. Moved by Councilman Plan, seconded by Councilman Werner to approve a Home Occupation Permit at 1415 Blueberry Lane (Ms. Carol Potts-Werkert) to produce audio cassette tapes for aerobic instructions in her home. Ayes, 8; Nayes, None. Moved by Councilman Kulzer, second by Councilman Werner to approve a Home Occupation Permit at 1000 County Road 47 (Harold Welch) to operate a mail order business out of his home selling ski storage kits. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Werner to approve the $1,808 being assessed to the City of Hastings for the Vermillion River Watershed Management Commission. Ayes, 8; Nayes, None. n Dakota County Commissioner Joe Harris was in the audience and spoke to the Council. He said that he was v1s1t1ng all Communities in his District and was willing to discuss any of the concerns that the City of Hastings currently had. The City Council discussed with Commissioner Harris the Dakota County 4th Street Court House, the Dakota County Library in Hastings, the 2nd Street Hill sidewalk, the 2nd Street road that abuts County Road 42, CDBG HRA Grants, and County Road 42 being considered as a main corridor. After discussion about the Dakota County Library the following action took place regarding the Library in Hastings. Moved by Councilman Trautmann, seconded by Councilman Kulzer to adopt Resolution No. 3-85 stating that as such time that Dakota County will provide funds for the construction of a new library in Hastings and that the City of Hastings will provide land for the building. Ayes, 8; Nayes, None. Copy of Resolution on file. Representatives from the Veterans of Foreign Wars (VFW) and the American Legion were present and explained the POW/MIA Day. The Mayor made the following proclamation: ~ PLANNING COMMISSION APPOINTMENTS HOME OCCUPATION PERMIT- 1415 BLUEBERRY LANE HOME OCCUPATION PERMIT- 1000 COUNTY ROAD 47 VERMILLION RIVER WATER- SHED MANAGEMENT COMMISSION BUDGET DISCUSSION-COMMISSIONER JOE HARRIS RESOLUTION NO. 3-85 DAKOTA COUNTY LIBRARY PROCLAMATION - POW/MIA DAY WHEREAS. there are currently 2,483 Americans still m1ss1ng or otherwise unaccounted for in Indochina and their families still suffer untold grief due to uncertainty about their fate; and WHEREAS, the Lao People's Democratic Republic has recently indicated increased willingness to cooperate and agreed with the U.S. government to improve the overall relationship between our two countries; and WHEREAS, the Socialist Republic of Vietnam has pledged to accelerate their effort to cooperate with the United States government in resolving this humanitarian issue, separate from other issues dividing our two countries; 006 January 21, 1985 WHEREAS, the President of the United States has declared resolution of the POW/MIA issue a matter of highest national prior- ity and has initiated high level dialogue with the governments of the Lao People's Democratic Republic and the Socialist Republic of Vietnam on this issue; and WHEREAS, the citizens of Hastings fully understand and agree that the fullest possible accounting can only be achieved through government to government cooperation; and WHEREAS, the citizens of Hastings support the President's pledge of highest national priority to resolve the status of the 2,483 Americans still missing and unaccounted for in Indochina; and n WHEREAS, the citizens of Hastings urge the U.S. govern- ment to accelerate efforts in every possible way to obtain the immediate release of any Americans who may still be held captive in Indochina and the return of American servicemen and civilians who died in Southeast Asia whose remains have not been repatriated; and WHEREAS, the c1t1zens of Hastings strongly urge the governments of the Socialist Republic of Vietnam and the Lao People's Democratic Republic to fully cooperate with the U.S. government in the humanitarian effort to resolve the fate of 2,483 American servicemen and civilians still missing in Southeast Asia; and WHEREAS, the families of America's missing men, including 46 from Minnesota , continue to wait for word on the fate of their loved ones; NOW, THEREFORE I, LuAnn Stoffel, Mayor of the Town of Hastings, do proclaim January 27, as POW/MIA Day and urge the citizens of HASTINGS to recognize this important and lingering issue by taking action on this day to: DRIVE WITH AUTOMOBILE LIGHTS ON and WRITE LETTERS TO THEIR ELECTED GOVERNMENT REPRESEN- TATIVES as a show of concern for these missing citizens and their families. MASTER'S INC. AGREEMENT SALE OF EXCESS PROPERTY - THREE VEHICLES COUNCIL COMMITTEE APPOINTMENTS COMMUNITY EDUCATION REPRESENTATIVES 1ST READING - ORDI- NANCE AMENDMENTS CHAPTER 2 - o The City Administrator/Clerk and Robert Deike from the law firm of Holmes and Graven reviewed with the City Council the Development Contract between the City of Hastings and Master Incorporated concerning the relocation of the Master Incorporated Plant from the Downtown Hastings Area to the new Industrial Park. No action was necessary at this meeting. Moved by Councilman Trautmann, seconded by Councilman Werner to approve the sale of three (3) vehicles which the City has determined to be excess property. These vehicles are as follows: 1) One 1978 Ford (Building Inspectors previous car); and 2) Two 1978 Chevrolet Wayne Transitte 13 passenger buses. The Council authorized the advertisement and acceptance of the highest sealed bid for the sale of each of these three (3) vehicles. Ayes, 7; Abstained; Berg. The Mayor presented the Council Committee Appointments to the Council. Per the City Ordinance, the Council may take formal action at the next regular City Council meeting. Moved by Councilman Nesbitt, seconded by Councilman Plan to accept the Mayor's recommendation that Fred Trautmann and Richard Bond, with Robert Kulzer as the Alternate, to be the Community Education Representatives. Ayes, 8; Nayes, None. lJ Moved by Councilman Nesbitt, seconded by Councilman Berg to pass the 1st Reading of an ordinance amending sections 2.20 of the City Code having to do with the establishment of an Energy Commission; amending section 2.01 having to do with boards and commissions generally and amending section 2.19 subdivision 1 having to do with the establishment and composition of the Cable Commission. Ayes, 8; Nayes, None. January 21, 1985 Moved by Councilman plan, seconded by Councilman Berg to refer the matter of filling the Ice Arena Manager Position to the Administrative Committee of the Council, After Council discuss.iun the motion and second were wi thdrawn. r- Moved Councilman Werner, seconded by Councilman Berg to have an informal approval of the Mayor's Committee appoint~ ments which may be approved at the next regular City Council meeting. The City Administrator was directed to work with the informal Administrative Committee on any items he feels perti- nent. Ayes, 7; Nayes, Trautmann. Moved by Councilman Trautmann, seconded by Councilman Berg to grant McCabe's Pub permission to hold an ice fishing contest at Lake Rebecca on Saturday, February 9, 1985. This request is subject to the provisions as provided in Mr. McCabe's letter dated January 16, 1985. Ayes, 8; Nayes, None. Moved by Councilman Berg, seconded by Councilman Werner to pass the 1st Reading on an ordinance amending Section 3.20, Subdivision 7, of the City Ordinance, having to do with On-Sale Sunday Liquor License. Ayes, 7; Nayes, Bond. Moved by Councilman Trautmann, seconded by Councilman Berg to refer the matter of the Rules and Regulations for the Veterans Park Athletic Complex to the Natural Resources and Recreation Commission to study and refer back with recommenda- tions to the City Council. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Werner to adopt Resolution No. 4-85 authorizing participation in the Control Data Business Advisors Incorporated Joint Comparable Worth Study. Ayes, 8; Nayes, None. Copy of Resolution on file. Ii Moved by Councilman Plan, seconded by Councilman Kulzer to accept resignation of Volunteer Firefighter Kent Wilcox effective January 31, 1985. The Council expresses its thanks and appreciation to Mr. wilcox for his years of service. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Werner to charge the American Legion Club and the V.F.W. CLub each $25.00 per month to cover their gambling license until the State Licenses' them. Ayes, 8; Nayes, None. Moved by Councilman Bond to have the Fire Chief contact Mr. Jack Caudill regarding his request for a waiver of an ambulance fee and try and negotiate a reasonable payment. This motion died for lack of a second. Moved by Councilman Trautmann, seconded by Councilman Kulzer to deny the request of Mr. Jack Caudill to waiver or reduce the $115.00 ambulance fee. Ayes, 8; Nayes, None. ,.....-. Moved by Councilman Bond, seconded by Councilman Trautmann to select the 12th and Pleasant Streets site for the Hastings Dakota County Library. Ayes, 4; Nayes, Nesbitt, Plan, Berg, Kulzer, and Mayor Stoffel. Motion is defeated. The Mayor appointed Councilman Tom Nesbitt to the Library Site Committee. Moved by Councilman Werner, seconded by Councilman Plan to adopt Resolution No. 5-85 ordering a feasibility study for West 3rd Street between Forest and Maple Streets, request- ing street and necessary utility improvements. Ayes, 8; Nayes, None. 007 ICE ARENA MANAGER POSITION INFORMAL APPROVAL OF COUNCIL COMMITTEE MCCABE'S PUB FISHING CONTEST - LAKE REBECCA 1ST READING - ORDINANCE AMENDMENT - ON-SALE SUNDAY LIQUOR HOURS RULES AND REGULATIONS - VETERANS PARK ATHLETIC COMPLEX RESOLUTION NO. 4-85 ACCEPT RESIGNATION - VOLUNTEER FIREFIGHTER - GAMBLING LICENSE RENEWAL - AMERICAN LEGION AND V.F.W. WAIVER AMBULANCE BILL - JACK CAUDILL LIBRARY SITE FEASIBILITY STUDY - RESOLUTION 5-85 WEST 3RD STREET 008 January 21, 1985 AL SIEBEN - SAND REMOVAL Moved by Councilman Nesbitt, seconded by Councilman Kulzer to approve the letter prepared by the City Engineer requesting Mr. Al Seiben to return the fill material he had borrowed from the N.W. Ponding Basin by May 1, 1985 or penalty of $.25 per yard per day for each day of noncompliance. The Mayor called for the roll call, the roll call was started, there was Council discussion and the motion and second were withdrawn. Councilman Trautmann challenged the Chair stating that roll call had been started and the roll call should be continued. The Mayor called for the roll call. Ayes, Trautmann, Nayes, 7. Moved by Councilman Werner, seconded by Councilman Nesbitt to have Mr. Al Sieben pay a comparable rate in dollars for 7,500 yards of sand delivered to the site previously selected. The motion was amended to 5,000 yards. Ayes, 7; Naye, Trautmann. o COUNCIL COMMENTS OPPOSING SALES TAX TO BUILD CIVIC BUILDING IN MINNEAPOLIS Moved by Councilman Trautmann, seconded by Councilman Plan to direct Staff to send a letter on behalf of the City Council to State whereby the City of Hastings takes opposition to a one percent (1%) sales tax to apply towards the building of a Civic Building in Minneapolis. Ayes, 8; Nayes, None. Councilman Nesbitt requested that Staff review the Whispering Lane Plat as it relates to Watershed and sufficient Park Dedication and report back to Council. Councilman Kulzer requested that the Planning Committee meet in an early meeting on February 4, 1985 at 7:00 p.m. Councilman Plan requested that a handicap parking place stall be designated in front of Eddy's Drug Store on 2nd Street in lieu of one located next to the post office on Ramsey Street. INFORMAL APPOINTMENTS OF THE ADMINISTRATIVE COMMITTEE The Informal Appointments of the Administrative Committee will meet in a meeting on January 31, 1985 at 7:00 p.m. in the Council Chambers of the City Hall. o CONSENT AGENDA Moved by Councilman Werner, seconded by Councilman Berg to 1) Pay all bills as audited; 2) partial payment - Frazer Construction - Ramsey/Tyler Project - $13,271.48. Ayes, 8; Nayes, None. The Mayor, City Council, and City Staff expresses its condolences and sympathy to the family members of Mr. Dan Witt. Mr. Witt had made application for an amusement device license for a billiards facility at 122 West 3rd Street. Mr. Witt had been killed in the plane crash at Reno, Nevada. Ayes, 8; Nayes, None.
