HomeMy WebLinkAbout02-19-85 n I r-- / I 019 Hastings, Minnesota February 19, 1985 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, February 19, 1985 at 7:30 P.M. in the Council Chambers of the City Hall. Members Present: Councilmen Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan and Mayor Stoffel. Members Absent: Councilman Mathiowetz. The Mayor called for additions or corrections to the minutes of the meeting of February 4, 1985. Councilman Werner noted that the vote count was not on the Energy Steam Plan. With this correction the minutes were declared approved as presented. The Mayor called for additions or corrections to the special meeting of February 12, 1985 and hearing none declared the minutes approved as presented. The Mayor declared the public hearing open at 7:32 P.M. to PUBLIC HEARING- consider an ordinance establishing an Energy Commission. All ENERGY COMMISSION persons were afforded the opportunity to address the issue; no one wished to do so. The Mayor closed the public hearing at 7:33 P.M. The Mayor declared the public hearing open at 7:34 P.M. to PUBLIC HEARING- consider an ordinance amending Section 2.01 of the City Code BOARDS AND COMMISSIONS having to do with Boards and Commissions in general. All persons were given an opportunity to address the issue; no one wished to do so. The Mayor closed the public hearing at 7:35 P.M. The Mayor declared the public hearing open at 7:35 P.M. to PUBLIC HEARING- consider an ordinance amending Section 2.19 of the City Code CABLE COMMISSION having to do with the Cable Commission. All persons wishing to speak on the matter were given the opportunity to do so; no one wished to speak on the issue. The Mayor closed the public hear- ing at 7:35 P.M. The Mayor declared the public hearing open at 7:36 P.M. to consider an ordinance amending Section 3.20, Subdivision 7 having to do with on-sale Sunday liquor sales. All persons wishing to speak on the issue were given the opportunity to do so. Mr. Lynn Cyler of the First United Presbyterian Church addressed the Council expressing the Church's opposition to changing the on-sale Sunday liquor hours. No one else wished to speak on the issue. The Mayor closed the public hearing at 7:45 P.M. PUBLIC HEARING-ON SALE SUNDAY LIQUOR HOURS EXCESS PROPERTY-2124 CANNON STREET Moved by Councilman Kulzer, seconded by Councilman Berg to table the matter of the excess property at 2124 Cannon Street until the March 4, 1985 regular City Council meeting. 7 Ayes, Nayes none. Moved by Councilman Werner, seconded by Councilman Trautmann to approve the preliminary plat for Whispering Meadows-Schumacher. 3 Ayes, NayeKulzer, Nesbitt, Plan and Berg. Motion to approve fails. There was considerable council and public discussion regarding the preliminary plat approval for the Whispering Meadows. Planning Commision member Simacek and Planning Commissioner member Voelker spoke out with regard to the Planning Commission's recommendation for denial for the preliminary plat. Mr. Mike Williams representing the develop- ment firm spoke on behalf of the development. Mr. Jim Storkamp, the attorney for the developers, spoke on behalf of the prelim- inary plat and Mr. Wint Hartman expressed his concerns for the preliminary plat approval. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to approve the preliminary plat with an analysis of surface drainage by a disinterested party. There was Council discussion regarding this and the motion and second were with- drawn. The Mayor stated that since there had already been consider- able Council discussion regarding the preliminary plat approval and no decision had been reached as of yet that the matter would be referred to later in the agenda. The legal counsel is authorized to make changes in the contract as necessary, except for changing the intent of the contract. 6 Ayes, Nayes Berg. Moved by Councilman Werner, seconded by Councilman Kulzer to adopt Resolution No. 9-85 providing for public sale of $460,000 .0- general obligation tax increment bonds. 6 Ayes, Nayes Berg. Moved by Councilman Trautmann, seconded by Councilman Nesbitt to adopt Resalution No. 10-85 agreeing that the City of Rosemount assign $800,000 of their Industrial Revenue Bond alloca- tion to the City of Hastings for the construction of Master, Inc. 6 Ayes, Naye Berg. Moved by Councilman Plan, seconded by Councilman Nesbitt to pass the 3rd and final reading of an Ordinance amending Section 2.01 of the Hastings City Code having to do with Boards and Com- missions in general. 7 Ayes, Nayes none. Moved by Councilman Berg, seconded by Councilman Kulzer to pass a 3rd and final reading of an ordinance amending Section 2.19 of the City Code having to do with the Cable Commission. 7 Ayes, Nayes none. Moved by Councilman Berg, seconded by Councilman Werner to pass the 3rd and final reading of an ordinance amending Section 3.20 Subdivision 7 of the City Code having to do with liquor license Sunday sales. 4 Ayes, Nayes Bond, Nesbitt and Kulzer. Motion passes. Moved by Councilman Plan, seconded by Councilman Nesbitt to accept the Mayor's recommendation to appoint Pastor Smith as a member of the Hastings Cable Commission. This will be a 1st term, expiring on 12/31/86. Ayes 7, Nayes none. Moved by Councilman Werner, seconded by Councilman Trautmann to authorize the advertisement for the lighting of two softball fields at the Veterans Park Athletic Complex. 7 Ayes, Nayes none. Moved by Councilman Werner, seconded by Councilman Kulzer to have the City of Hastings conduct an annual reforestation spring tree sale on May 4, 1985 at the Civic Ice Arena. 7 Ayes, Nayes none. Moved by Councilman Kulzer, seconded by Councilman Berg to continue the Dutch Elm Program as in 1984. with the City of Hastings cost-sharing 40% for the removal of diseased boulevard trees. The cost of stump removal is the home owner's responsi~ 0 bility. Private trees are marked for removal only upon request and the City requires the tree(s) be removed within 30 days. . , 7 Ayes, Nayes none. o Moved by Councilman Kulzer, seconded by Councilman Trautmann to have the City sf :Hastings allocate, not to exceed $4 000 for the purpose of trimming trees which overhang the st;eet~ from the boulevards. After Council discussion the motion and second were withdrawn. There will be no charge for this event; however, the City of Hastings would receive a percent of the gate receipts and concession profits. 7 Ayes, Nayes none. 021 February 19, 1985 SOFTBALL REQUEST AT VETERAN'S ATHLETIC COMPLEX ACCEPT RESIGNATION- CITY PLANNER t.10ved by Councilman Plan, seconded by Councilman Nesbitt to accept the resignation of Frank (Chip) Gerlock effective March 1,1985. The Council expresses its thanks and appreciation to Mr. Gerlock for his services to the City of Hastings. 7 Ayes, Nayes none. Moved by Councilman Kulzer, seconded by Councilman Plan to accept the resignation of Lisa Youngren effective February 21,1985. Moved by Councilman Bond, s~conded by Councilman GUIDELINES-BOULEVARD Kulzer to have the City adopt a specific set of guidelines TREE PLANTING for the homeowner to follow regarding boulevard tree planting. The Council accepted the Natural Resources & Recreation Com- mission's guidelines as set forth with the exception of the minimum of 11 inch caliber. 5 Ayes, Nayes Berg and Kulzer. ACCEPT RESIGNATION- ADMINISTRATIVE SECRETARY Moved by Councilman Werner, seconded by Councilman REAL ESTATE ABATEMENT Nesbitt to approve the real estate abatement for property 19-03800-012-13 No. 19-03800-012-13 (John and Sharyn Atvers). The estimated market value should be reduced from $97,800 to $64,000. 7 Ayes, Nayes none. Moved by Councilman Trautmann, seconded by Councilman Werner to pass a 1st reading of an ordinance amendment pro- hibiting the feeding of water fowl. The City Council requests that the Lake Rebecca Task Force and the Natural Resources and Recreation Commission review this for comment. 7 Ayes, Nayes none. Werner to as posted 6 Nayes. Moved by Councilman Werner, seconded by Councilman Kulzer to post two-hour parking from 8 a.m. to 6 p.m. on the south side of 3rd Street between Tyler and Ramsey Street and post 'no parking' signs on the north side of 3rd Street between Ramsey and Tyler Street. 7 Ayes, Nayes none. Moved by Councilman Plan, seconded by Councilman Werner to approve a purchase agreement for the Computer Tool and Engineering Company to purchase 1.23 acres of land in Industrial Park in the amount of $6,500. 7 Ayes, Nayes none. He commended the Council for the position they had taken and stated that he would be supporting their position. Moved by Councilman Plan, seconded by Councilman Trautmann to reconsider the main motion on the preliminary plat approval for the Whispering Meadows Development. The Mayor felt that the motion was out of order. Councilman Trautmann challenged the Chair and asked that the motion not be considered until an opinion was ren- n dered by legal counsel. Moved by Councilman Werner, seconded by Councilman Bond to approve the preliminary plat as presented. Moved by Councilman Kulzer, seconded by Councilman Nes- bitt to table the preliminary plat. 3 Ayes, Nayes Bond, Trautmann, Plan and Werner. Motion to table fails. Moved by Councilman Werner, seconded by Councilman Trautmann to call the question for the preliminary plat approval. The motion and the second for the call of the question was with- drawn. After further discussion by the citizenry and the Council, the motion to approve the preliminary plat was called. 4 Ayes, Nayes Kulzer, Nesbitt and Berg. The motion to approve the preliminary plat passes. Moved by Councilman Werner, seconded by Councilman Bond to set a public hearing for the March 18, 1985 regular City Council meeting to consider assessing unpaid city accounts for services 0 that the city performed for building repair at the Red Buoy, 117 East 2nd Street. 7 Ayes, Nayes none. Moved by Councilman Bond, seconded by Councilman Trautmann to have the City of Hastings enter into the annual agree- ment between Washington County and the City of Hastings for provi- ding ambulance service in Washington County. 7 Ayes, Nayes none. This addendum will be incorporated into the personnel policy dated 2/19/85. This plan will be retroactive to January 1, 1985. The following salaries were established for the regular part-time non-union employees; however, these employees would not be included in the established step plan. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to approve a 5.3% increase for the Administrative Assistant, Dianne Latuff, effective January 1,1985. 7 Ayes, Nayes none. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to approve a salary increase for the Assistant Fire Chief, Jerry Rosendahl, in the amount of $28,904 as of January 1, 1985. This position would move into the 4th year of the step plan, rather than the next step, upon the employee's anniversary month of 1985. 7 Ayes, Nayes none. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to adjust the salary of the Assistant Engineer, Tom Montgomery, to a salary of $28,680 for the entire year. Councilman Plan stated there was a meeting of the COUNCIL COMMENTS Safety Committee scheduled for February 26, 1985 at 7:00 P.M. in the Council Chambers of the City Hall. The purpose of the meet- ing is to discuss ALS versus BLS ambulance service.
