The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday March 18, 1985 at 7:30 P.M. in the Council chambers of
City Hall.
Members Present: Councilman Berg, Werner, Kulzer, Bond, Trautmann,
Nesbitt, Plan and Mayor Stoffel.
Members Absent: Councilman Mathiowetz.

The Mayor called for additions and corectionsto the Minutes of the
meeting of March 4, 1985 and hearing none declared the Minutes approved
as presented.
The Mayor declared the Public Hearing open at 7:31
to consider assessing unpaid City Accounts for Services
that the City performed for building repair to the Red
Buoy at 117 East Second Street. All persons were given
the opportunity to address the issue, no one wished to do
so. The Mayor closed the Public Hearing at 7.32 P.M.
The Mayor declared the Public Hearing open at 7:32
P.M. to consider an Ordinance Amending Section 6.06
Subdivision 4 of the City code having to do with Trimming
of trees. All persons were given the opportunity to
address the issue, no one wished to do so. The Mayor
closed the Public Hearing at 7:33 P.M.

The Mayor declared the Public Hearing open at 7:33
P.M. to consider an Ordinance Prohibiting the feeding of
Water Fowl in Lake Rebecca Park. All persons were given
opportunity to address the issue. Mr. Jerry Hoeschen stated
that he would support limited feeding of the Water Fowl
but opposes not feeding them at all. No one else
wished to speak on the matter. The Mayor declared the
Public Hearing closed at 7:34 P.M.
The Assistant City Engineer, Tom Montgomery, reviewed
with the Council and Audience the 1985 State Aid Construction
for the Downtown Redevelopment and gave the proposed costs.
The Mayor declared Public Hearing at 7:52 P.M. to
consider the 1985 State Aid Construction for the Downtown
Redevelopment. All person were given an opportunity
to address the issue. Mr. Montgomery e~lained that
he had received a Letter from the Milwaukee Railroad
opposing the project. They stated that the project
would be of no benefit to the Railroad. Mr. John
Grossman, Main Street Project Manager, said that the
businesses in the Downtown area were in general agreement
with the project and he urged the Council support the
project. Mr. LIQyd Johnson and Mr. Don Eddy both stated
their strong support of the project. No one else wished
to speak on the issue. The Mayor declared the Public
Hearing closed at 7:54 P.M.

Moved by Councilman Trautmann, seconded by Councilman
Nesbitt to Adopt Resolution No. 16-85 awarding the bid for
the Lighting of two Softball Fields at Veterans Park
Athletic Complex to the apparent low Bidder, Collins Electric,
in the amount of $44,213.00 for wood pole construction.

Moved by Councilman Trautmann, seconded by Councilman
Kulzer to adopt Resoltuion No. 17-85 awarding the Bid for
the sale of $460,000.00 General Obligation Tax Increment
Bonds to the apparent low bidder, Norwest Investment Services.

Moved by Councilman Kulzer, seconded by Councilman
Plan to approve the On Site Parking Variance for Our
Saviors Lutheran Church (West 8th Street). This
variance also enters the City into an agreement with
the Church that if adjacent properties are acquired
that they will be designated as On Site Parking
Facilities. 7 Ayes; Nayes, none.
Moved by Councilman Trautmann, seconded by Councilman
Kulzer that the City of Hastings and the Hastings Cable
Television Company follow the rate change procedure as
addressed in the City Ordinance Chapter 14 Section 8.11.
The Hastings Cable Television Company stated that they
were of the opinion that the City of Hastings has no
Regulatory Authority over Tiers 2 and Tiers 3. Mr.
John Gibbs, from the Law Firm of Herbst and Thue the
Cityls Cable Television Attorneyls Office, stated that
their opinion was that under the "Cable Connnunications
Act of 1984" the term Basic Cable Service means any service
tier which includes the retransmission of Local Television
Broadcast Signals, and therefore the City of Hastings indeed
has Regulatory Authority over Tiers 2 and Tiers 3.

Moved by Councilman Werner, seconded by Councilman
Nesbitt to adopt Resolution No. 18-85 approving the plans
and specifications and authorizing Advertisement for bids
for the work designated as package "c" Master Incorporated.
The bids will be considered for award at the April 15, 1985
regular City Council Meeting. 7 Ayes; Nayes, none. Copy
of Resolution on file.
Moved by Councilman Berg, seconded by Councilman
Nesbitt to have the City of Hastings work with the
Minnesota Department of Transportation to obtain a new
Second Street Railroad Crossing Light System and Arms and
to have the Third Street Railroad Crossing remain open. The
City would pick up 10% of the local share.

Moved by Councilman Werner, seconded by Councilman
Trautmann to table the matter of the Railroad Signals and
Cross Arms on Second Street until a defined cost estimate
and breakdown and bid price can be obtained. 5 Ayes; Nayes,
Berg and Nesbitt.
Moved by Councilman Werner, seconded by Councilman
Kulzer to enter into a One Year Contract with the Local
49 Union. This Contractwould be in effect January 1, 1985
through December 31, 1985. A copy of the Contract is on
file in the Office of the City Administrator Clerk.

Moved by Councilman Werner, seconded by Councilman
Trautmann to appoint James McGree to the position of the
Ice Arena Manager. Mr. McGree will be covered under 491er
Union Contract Language until November 1, 1985. The
Council authorized posting and advertising for the
ParkkeeperjAssistant Arena Manager Position. 7 Ayes;
Nayes, none.
Moved by Councilman Trautmann, seconded by Councilman
Kulzer to assess unpaid City Accounts for Services performed
for building repair at the Red Buoy at 117 East Second
Street. The following are the Assessments 19-32150-085-04
and 19-32150-084-04 for $5,555.29. 7 Ayes; Nayes, none.

Moved by Councilman Werner, seconded by Councilman
Bond to deny the Third Reading of an Ordinance amending
Section 6.06 Subdivision f of the City Code dealing with
Tree Trimming. 4 Ayes; Nayes, Kulzer, Trautmann and
Berg. Motion to deny passes.

Moved by Councilman Trautmann, seconded by Councilman
Nesbitt to pass the third and final reading of Ordinance No.
176 prohibiting feeding of Water Fowl in Lake Rebecca Park.
7 Ayes; Nayes, none.
Moved by Councilman Werner, seconded by Councilman
Kulzer to reappoint John C. Larson and Dennis McNamara
to the Natural Resources and Recreation Commission. This
would be the second term for both of these Members expiring
12/31/86. 7 Ayes; Nayes, none.

Moved by Councilman Werner, seconded by Councilman
Berg to appoint Tom Montgomery as the Acting City
Engineer and State Aid Engineer until the City Engineer
Position can be filled. 7 Ayes; Nayes, none.
The City Administrator Clerk reviewed with the
Council the status of the Coalition of the Out State
Cities as it relates to the Proposed Local Government
Aid Formula. The recommendation of the City Administrator
Clerk and the Mayor was that the City not support the
Lobbying effort by the coalition and the City would
maintain support for the Leagues formula on Local
Government Aid. There was no Council Action required.
Moved by Councilman Berg, seaonded by Couneilman
Kulzer to adopt Resolution No. 19-85 approving the Plan
and Specifications and authorizing advertisement for
bids for the Downtown redevelopment project, subject
to approval of State Aid. The bids would be considered
for award at the April 15, 1985 regular City Council
Meeting. 7 Ayes; Nayes, none.

Moved by Councilman Kulzer, seconded by Councilman
Trautmann to adopt Resolution No. 20-85 Authorizing the
Mayor and City Administrator/Clerk to make application
to the Minnesota Department of Energy and Economic
Development in an amount necessary to construct a Hydro
Electric Project on Lock and Dam No.2. 7 Ayes; Nayes,
none. Copy of Resolution on File.
Moved by Councilman Werner, seconded by Councilman
Berg to adopt Resolution No. 21-85 entering into a
Joint Powers Agreement with the City of Becker, Minnesota;
enabling Hastings to issue its Industrial Development
Revenue Bonds for an improved project or projects
pursuant to an allocation given to the City of Becker
as an entitlement issuer under the Act. 7 Ayes; Nayes,

Moved by Councilman Trautmann, seconded by Councilman
Werner to approved a partial refund of assessment of
Lot 1 Schumacher Second Addition. The Engineering
Department has reviewed the matter and determined that
the property was over assessed by $3,208.97. 7 Ayes;
Nayes, none.

Moved by Councilman Werner, seconded by Councilman
Trautmann that the City of Hastings pay Austin P. Keller
in the Amount of $1,214.24 to correct six Fire Hydrants
which needed extension for proper grades in Pleasant
Valley Addition. The City in turn will bill the firm
Hanson, Thorp, Pellinen, and Olson Incorporated as the
Cities Expert for Engineering Services rendered in the
Pleasant Valley Improvement. 7 Ayes; Nayes, none.

COUNCILMEN COMMENTS
Councilman Nesbitt suggested that the City Administrator
Clerk~the City Attorney, and himself discuss the interest the
City of Hastings may have in establishing itself as a Port
Authority.
Councilman Nesbitt requested a detailed listing of
benefits received by the City of Hastings from the 11etropolitan
Council and the dollar amount of those benefits within the past
year.
