HomeMy WebLinkAbout04-01-85 Hastings, Minnesota April 1, 1985 032 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, April 1, 1985 at 7:30 P.M. in the Council Chambers of the City Hall. Members Present: Councilman Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan, Mathiowetz, and Mayor Stoffel. Members Absent: None. r I The Mayor called for additions or corrections to the minutes of the meeting of March 18, 1985. Councilman Werner noted that on page 030 Resolution #22 should reference Gretchens First Addition. With that correction the Minutes were declared approved as presented. RESOLUTION NO. 23-85 AWARD BIDS-1985 DUTCH ELM PROGRAM Moved by Councilman Werner, seconded by Councilman Plan to adopt Resolution No. 23-85 awarding the bid for the 1985 Dutch Elm Disease Tree Program to Hoffman and McNamara, the only bidder, in the amount of $37,680.00. Hoffman and McNamara will deduct $3,120.00 from their bid to use the land fill site for the disposal of brush. The bid was therefore awarded in the Contract amount of $34,560.00. 8 Ayes; Nayes, None. The Mayor declared the Public Hearing open at 7:32 P.M. to consider a street vacation for Commerce Drive in the Hastings Industrial Park No. 2 (which is now Industrial Park No.3). All persons were given the opportunity to address the issue, no one wished to do so. The Mayor closed the Pubiic Hearing at 7:33 P.M. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to approve the 3 foot side yard set back variance request at 323 West 5th Street. 8, Ayes; Nayes, None. r I . Moved by Councilman Trautmann, seconded by Councilman Werner to adopt Resolution No. 24-85 vacating Commerce Drive in Hastings Industrial Park No. 2 (which is now Industrial Park No.3). This Resolution repeals Resolution No. 14-85. Copy of Resolution on file. 8 Ayes; Nayes, None. PUBLIC HEARING-STREET VACATION-COMMERCE DRIVE INDUSTRIAL PARK #2 SIDE YARD SET BACK - 323 WEST 5th - G. HAMONS RESOLUTION NO.24-85 STREET VACATION - COMMERCE DRIVE - INDUSTRIAL PARK Moved by Councilman Werner, seconded by Councilman MINOR SUBDIVISION - Plan to approve the Minor Subdivision at 506 River Street to 506 RIVER STREET divide a duplex into two zero lot line parcels, per the Planning Commission recommendation. 8 Ayes; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Bond to approve the final plat for Whispering Meadows Development and also enter into a Development Agreement with Michael J. & Cheryl L. Williams, the developers. FINAL PLAT-WHISPERING MEADOWS Contract Moved by Councilman Nesbitt, seconded by Councilman Kulzer to amend the main motion to include 1) The Plat be approved contingent upon a finalized coordinated contract 2) That the Contract be changed to incorporate a berm or similar type barrier along the North edge of the drainage easement to insure against surface water being directed to the Whispering Meadows Property and the Townhouse Association Property 3) The final contract be coordinated with the Townhouse Association to identify applicable restrictive convenants and to insure that the requirements by the City to properly police the Contract. There was considerable Council discussion and the Amendment to the main motion was withdrawn. r-- The Mayor called for roll on the main motion. 8 Ayes; Nayes, None. Moved by Councilman Nesbitt, seconded by Councilman Kulzer to have the City Staff, the Townhouse Association, and the Developers of Whispering Meadows, meet and study the procedures for surface water drainage, determine if the property easements are sufficient, and identify applicable restrictive covenants to insure that requirements for the City to properly enforce the contract are in place & report back to Council. 8 Ayes; Nayes, None. 033 April 1, 1985 LAKE ISABEL PRESENTATION RESOLUTION NO. 25-85 JOINT POWERS AGREEMENT- ROSEMOUNT FIRST READING-ORDINANCE AMENDMENT-LICENSING AND REGULATING OF CATS REQUEST FROM ALLAN LARSON-REINSTATEMENT APPOINT INDUSTRIAL PARK BOARD MEMBERS RESOLUTION NO. 26-85 SALE OF BONDS-1985 PROJECT RESOLUTION NO. 27-85 SALE OF BONDS-WATER REVENUE WATER UTILITY RATE INCREASE APPOINTMENT TO THE VERMILLION RIVER WATERSHED COMMISSION SET PUBLIC HEARING- CABLE T. V. RATE ADJUSTMENT ENGINEERING CONSULTANTS FOR HYRO-ELECTRIC PLANT APPOINT ENERGY COMMISSION MEMBERS Representatives from Hickock Association and the D.N.R. gave a presentation to the City Council & Audience regarding the Lake Isabel study. Upon review by the Council the matter was referred to the Lake Isabel Task Force to study the proposals presented by Hickock Association and submit a recommendation to the City Council. Moved by Councilman Kulzer, seconded by Councilman Plan to adopt Resolution No. 25-85 entering into a Joint Powers Agreement with the City of Rosemount making available to the City of Hastings up to $749,303.00 of the 1985 allocation of the City of Rosemount's IRB entitlement. 8 Ayes; Nayes, None. Moved by Councilman Kulzer, seconded by Councilman Berg to reinstate Allan Larson as the City Engineer. Ayes, Kulzer, Nesbitt and Berg. 5, Nayes. Moved by Councilman Nesbitt, seconded by Councilman Plan to appoint the following Industrial Park Advisory Board Members. Dennis Morris would fill an unexpired term of Meryl Borcher, with this term expiring on 1-31-86, reappoint Arvid Evensvold, Don Bahls and Neil Seiwert for three year terms; the terms expiring 1-31-88. 8 Ayes; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Werner to adopt Resolution No. 26-85 authorizing the sale of $990,000.00 general obligation taxing increment bonds, series 1985B, and setting a special meeting of the City Council for April 29, 1985 at 4:30 P.M. in the City Hall Council Chambers. The bonds will be considered for award at this meeting. 8 Ayes; Nayes, None. Moved by Councilman Werner, second Councilman Nesbitt to set a public hearing for the April 15, 1985 regular City Council Meeting to consider implementing a water utility rate increase. 8 Ayes; Nayes, None. Moved by Councilman Kulier, seconded by Councilman Nesbitt to authorize the City Staff to seek Legislation to have a City of Hastings named as a Port Authority. 8 Ayes; Nayes, None. Moved by Councilman Berg, seconded by Councilman Kulzer to pass the First Reading of an Ordinance prohibiting accumulation of junk which would be a public nuisance. 8 Ayes; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Plan to amend the 49'r Contract by adding there to Engineerig Aid I and Engineering Aid II positions. Andrea Gustufson would be hired in the first step of an Engineering Aid I, Effective 4-1-85. 8 Ayes; Nayes, None. INDUSTRIAL PARK STEAM PROJECT JOINT POWERS AGREEMENT COTTAGE GROVE PORT AUTHORITY- LEGISLATION FIRST READING- ORDINANCE AMENDMENT- CREATION OF ENGINEERING AID I AND II-LOCAL 49 RESOLUTION NO.28-85 PROPOSAL TO COMPLETE COUNTY ROAD 42 TO T.H. 55 Al Sieben, members of the Marshan Township Board and Marshan residents were in attendance to discuss the problems of serving Sieben's 2nd Addition with utilities. Al Sieben said he was unable to get signatures from the Marshan residents on the East side of Leroy Avenue asking for annexation to the City. The City Attorney stated the City could defer the assessment to the Marshan residents until they are annexed into the City but that the interest costs for deferring assessment may make the cost of the improvement more than what the City could prove benefit to the property. Councilman Trautmann then asked the Marshan Township Board Members if Marshan Township would pay one half of the interest cost for deferring the assessment. Ii The Marshan Board Members asked for 5 Minutes to discuss the question. Mr. Roger Fox, Board Chariman stated that Marshan Township would agree to pay $4,000 towards the interest. Moved by Councilman Trautmann, seconded by Councilman Kulzer to adopt Resolution No. 29-85 adding 160th Street, East of Millard Avenue, to the 1985 Utility and Street Construction Program. 8 Ayes; Nayes, None. Moved by Councilman Werner, seconded by Councilman Berg to set a Public Hearing for April 15, 1985 for the 1985 Utility and Street Construction Program. 8 Ayes; Nayes, None. r-- Moved by Councilman Trautmann, seconded by Councilman Werner to forward the request for Mr. Paul Kranz, property at 307 Sibley Street, be forwarded to the HRA for consideration. The City Council would look favorable upon Mr. Kranz request for Red tinted and stamped walk at 307 Sibley Street if the HRA would pay 20% of the total cost. 7 Ayes; Nayes, Kulzer. Moved by Councilman Trautmann, seconded by Councilman Nesbitt to adopt Resolution No. 30-85 including Siebens Second into the 1985 Utility and Street Construction Program. 8 Ayes; Nayes, None. Copy of resolution on file. Moved by Councilman Plan, seconded by Councilman Berg request to install up graded railroad signals at the Second Street crossing. The City's portion of costs for this would come from the unallocated general "fund reserve. The staff was directed to include a rubberized crossing in the C.I.P. 7 Ayes; Nayes, Bond.
