HomeMy WebLinkAbout05-06-85 Ha,~U)1gs, Minnesota May 6, 1985 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, May 6, 1985 at 7:30 P.M. in the Council Chambers of the City Hall. Members Present: Councilmen Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan, Mathiowetz and Mayor Stoffel. I Members Absent: None. 043 The Mayor called for additions or corrections to the regular meeting of April 15, 1985 and the special meetings of April 24th and April 29th, 1985 and hearing none declared all minutes approved as presented. The Mayor declared the public hearing open at 7:31 p.m. to consider an ordinance amendment dealing with the regulation of cats. All persons were given the opportunity to address the issue. No one wished to do so. The Mayor closed the public hearing at 7:32 p.m. The Mayor declared the public hearing open at 7:32 p.m. to consider restricting the placement of garbage containers by alleys or curbsides. All persons were given the opportunity to address the issue. No one wished to speak on the matter. The Mayor closed the public hearing at 7:33 p.m. The Mayor declared the public hearing open at 7:33 p.m. to consider an ordinance regulating junk cars, furniture, house- hold appliances and miscellaneous items stored on public or private property. All persons were given an opportunity to address the issue. No one wished to speak on the matter. The Mayor closed the public hearing at 7:34 p.m. I The Mayor declared the public hearing open at 7:35 p.m. an ordinance amending Section 3.01 of the city code having to do with sale of beer. All persons were given an opportunity to address the issue. No one wished to speak on the matter. The Mayor closed the public hearing at 7:36 p.m. Moved by Councilman Werner, seconded by Councilman Berg to set a public hearing, amending Section 5.40 of the city code dealing with regulation of peddlers, for the May 20, 1985 regular City Council meeting. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Werner to pass the first reading of an ordinance amendment dealing with the regulation of cats. Ayes 6; Nayes, Berg and Plan. Moved by Councilman Trautmann, seconded by Councilman Berg to pass the second reading of the ordinance restricting the placement of garbage containers by alleys or curbsides. Moved by Councilman Werner, seconded by Councilman Trautmann to accept the report prepared by the Engineering consulting of Foth & VanDyke as prepared for the Industrial Park Steam/Incinerator Project. Ayes, 8; Nayes, None. o Moved by Councilman Ber, seconded by Councilman Nesbitt to approved the extension of a two hour parking from 8:00 a.m. to 6:00 p.m. throughout the downtown area during the street construction, excluding Tyler and Ramsey Street between 3rd & 4th Streets. A copy of the area for limited parking is on file in the office of the City Administrator/Clerk. Ayes, 5; Nayes, Werner, Bond and Trautmann. Moved by Councilman Trautmann, seconded by Councilman Kulzer to authorize the expenditure of $90,000 entitlement funds the Hastings HRA has received from the Dakota County HRA for the acquisition of the McCarthy Building at 102 Tyler Street. Ayes, 8: Nayes, None. Moved by Councilman Berg, seconded by Councilman Werner to hire Gary Wytaske as the Assistant Arena Manager/Parkkeeper effective May 6, 1985. Mr. Wytaske salary will be 90% of the full union wage for the first 6 months then 95% of the full wage for the following 6 months under the 4gers union contract. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Berg to authorize the Lake Rebecca Task Force Committee to apply for a grant for a fishing pier (portable dock) for Lake Rebecca from the Department of Natural Resources. Ayes, 7: Nayes, Kulzer. o Moved by Councilman Nesbitt, seconded by Councilman Berg to submit to the State the following proposals if the federal funding levels are cut for Transit at the proposed rate for 1986 and 1987. 1) Reduce the service; 2) Increase the fares; 3) pursue revenue contracts for advertising on the vehicles. Ayes, 8; Nayes, None. Moved by Councilman Werner, seconded by Councilman Berg to authorize the city staff to advertise fora part-time clerical position at City Hall. Ayes, 8: Nayes, None. Moved by Councilman Werner, seconded by Councilman Berg to terminate the agreement of October 31, 1984 with HSA/JHA and enter into a new agreement for an hourly fee plus out of pocket expenses for Jim Hanson. Ayes, 7: Nayes, Bond. Moved by Councilman Trautmann, seconded by Councilman Berg to authorize the City of Hastings to enter into a Dakota County Mutual Aid Agreement for joint and cooperative uses of fire personnel and equipment. Ayes, 8: Nayes, None. o Moved by Councilman Werner, seconded by Councilman Plan to adopt Resolution No. 46-85 establishing a legislative position regarding application of Federal Fair Labor Standards Act to municipal employees and authorizing the city staff to enter into negotiations for re-opening the 1985 Fire and 4ger contract, and the personnel policy to bring them into compliance with the recent Supreme Court ruling dealing with the Fair Labor Standards Act. This employee is being hired through the emergency Veterans Job Training Act of 1983. Mr. Ludwig will be hired at $9.00 per hour with the Veterans Administration paying one half of the salary up to a total maximum of $10,000. Ayes, 8; Nayes, None. Moved by Councilman Plan, seconded by Councilman Werner to have the City of Hastings enter into a Joint Powers Agreement with School District #200 for the 1985-86 budget. Ayes, 8; Nayes, None. Moved by Councilman Kulzer, seconded by Councilman Nesbitt to set the Public Hearing for the June 3, 1985 regular City Council meeting regarding Street Vacation on North Frontage Road. Ayes, 8; Nayes, None. Moved by Councilman Plan, seconded by Councilman Werner to approve the revision to the Final Plat for Highland Hills Second Addition. Ayes, 8; Nayes, None. Moved by Councilman Werner, seconded by Councilman Berg to adopt Resolution No. 48-85 requesting an advance encumberance of $107,110 from the cities 1986 State Aid Allotment. Ayes 8; Nayes, None. Copy of resolution on file. Moved by Councilman Berg, seconded by Councilman Werner to authorize the city staff to contact the Milwaukee Railroad regarding the First Street Railroad Tracks. Ayes, 8; Nayes, None. Moved by Councilman Berg, seconded by Councilman Werner to adopt Resolution No. 49-85 delaying the Water Tower Bid opening until May 14, 1985. Ayes, 8; Nayes, None. Moved by Councilman Trautmann, seconded by Councilman Werner, to authorize the City Staff to use the services of the veterans from the Hastings Veterans Home to serve in conjunction with the Park Rangers paying them the minimum wage for their services. The city will allocate $2,000 towards payment for these services. Ayes, 7; Nayes, Kulzer. Moved by Councilman Trautmann, seconded by Councilman Bond to approve the entire concept of the site plan for Three Rivers Partnership at 160th & Millard Avenue and approve the construction of Phase I subject to the following: Ayes, 7; Nayes, None. 1. Approximately 25 fire hydrants within the development will be placed in such a matter that the furthest residential structure will be no greater than 250 feet from any hydrant. 2. That the cul-de-sac designated on the north portion of the proposal be shortened to a distance of 500 feet in order to satisfy minimum requirements of the subdivision regulations. 045 May 6, 1985 HIRE ASSISTANT BUILDING INSPECTOR- JON LUDWIG JOINT POWERS AGREE- MENT-SCHOOL DISTRICT 200 SET PUBLIC HEARING- STREET VACATION NORTH FRONTAGE ROAD FINAL PLAT-HIGHLAND HILLS SECOND RESOLUTION NO.48-85 STATE AID FUNDS FIRST STREET RAILROAl RESOLUTION NO.49-85 DELAY WATER TOWER BID OPENING PARK RANGERS SITE PLAN APPROVAL- THREE RIVERS PARTNERSHIP-160TH & MILLARD AVENUE 3. Than an agreement be entered into with the City regarding the proper installation and maintenance of the water system in order to insure that any breaks in the lines within the development will not render the entire development dry for firefighting purposes. 4. A more complete landscape plan be submitted for review and approval by City staff. 5. That unmountable curbs will be placed in the development. 6. That if the Enviornmental Quality Board requires the preparation of an Enviornmental Worksheet it will be the responsiblity of the applicant to prepare same. 7. That the applicant must make an arrangement for a secondary access to Trunk Highway 316 prior to initiating the second or third phases of the proposed project. 8. Wood sided mobile homes. 046 May 6, 1985 VARIANCE-THREE RIVERS PARTNERSHIP REZONING REQUEST AT HWY 55 & PINE ST.-CWL HASTINGS BOARD AND CARE-620 RAMSEY CONSENT AGENDA ADJOURNMENT Moved by Councilman Trautmann, seconded by Councilman Bond to approve the variance for Three Rivers Partnership at 160th & Millard Avenue so that they may be allowed to place model manufactured homes on 10 sites within the proposed development. This is subject to an annual review. Ayes, 8; Nayes, None. Moved by Councilman Werner, seconded by Councilman Trautmann to remove from the table the matter of the rezoning for the proposed office building at Highway 55 and Pine Street for C~~, Inc. Ayes, 4; Nayes, Nesbitt, Plan, Berg, Kulzer and Mayor Stoffel. There are Council discussion regarding the disrepair of the structure currently owned by the City of Hastings at 620 Ramsey Street. The Council directed staff to prepare a request for proposals and to contact the Hastings Preservation Commission regarding their interest in this building. o Moved by Councilman Werner, seconded by Councilman Plan to 1) pay all bills as audited; 2) annual renewal of amusement device licenses; 3) sidewalk reimbursement-Dick Conway $330.00.
