The City Council of the City of Hastings, Minnesota met as the Board
of Equalization at 6:30 p.m. in the Council Chambers of the City Hall.
All interested persons were directed to the County Assessor for
consultation. The Board of Equalization meeting had been duly called.

Members Present: Councilmen Berg, Werner, Kulzer, Bond, Nesbitt,
Plan, Mathiowetz and Mayor Stoffel.
Members Absent:
Councilman Trautmann.
The Board of Equalization meeting was continued until June 3, 1985
at 6:30 p.m.
The City Council of the City of Hastings, Minnesota met in a regular
meeting on Monday May 20, 1985 at 7:30 p.m. in the Council Chamber of the City
Hall.
Members Present: Councilmen Berg, Werner, Kulzer, Bond, Nesbitt,
Plan, Mathiowetz and Mayor Stoffel.
Members Absent: Councilman Trautmann.
The Mayor called for additions or corrections to the minutes of the
meeting on May 6, 1985 and hearing none declared the minutes approved as
presented.
Moved by Councilman Bond, seconded by Councilman Mathiowetz to
adopt Resolution No. 50-85 awarding the bid to, the apparent low
bidder, Hydro-Storage for the construction of a Water Tower in the
amount of $468,400.00.

Moved by Councilman Kulzer, seconded by Councilman Nesbitt to
table the award for bids until more resident input can be received.

The Mayor called for the vote on the main motion. 7 Ayes; Nayes,
None. Copy of resolution on file.
Moved by Councilman Nesbitt, seconded by Councilman Kulzer to
adopt Resolution No. 51-85 accepting and awarding the bids for the
1985 Municipal Street and Utility Construction to, the apparent low
bidder, A.P. Keller in the amount of $428,615.60. 7 Ayes; Nayes,
None. Copy of resolution on file.
Moved by Councilman Kulzer, seconded by Councilman Plan to
adopt Resolution No. 52-85 accepting and awarding the bid for the
}~ster Project to Jesco Incorporated for the concrete in the amount
of $254,266.00; and to Pine Bend Paving Incorporated in the amount
of $8,232.00 for the class V base. The Council is postponing the
award to bids for the utility work. 7 Ayes; Nayes, None. Copy

The Mayor declared the Public Hearing open at 7:55 p.m. to
consider an ordinance amending Section 5.40 Subdivision 4 of the
City Code dealing with the license fees for peddlers. All persons
were given an opportunity to address the issue. Georgene Dowell of
the Treat Truck asked for clarification to the ordinance. No one
else wished to speak on the matter. Mayor closed the Public Hearing
at 8:03 p.m.
Moved by Councilman Kulzer, seconded by Councilman Berg
to approve the site plan for Ron Battern 1207 Vermillion Street
subject to the following conditions:
That the three spaces located adjacent to the sidewalk on
Vermillion Street be eliminated.
That the applicant installs 3~ foot hedge on the rear
property line.
That bumper curb shall be installed 5 feet from the rear
property line.
That the south side of the property be screened.

approve a site plan and variance at 655 Pleasant Drive for a Day

pass the second reading of an ordinance amending Section 5.40
Subdivision 4, regulating peddlers. 7 Ayes; Nayes, None.
Moved by Councilman Werner, seconded by Councilman Nesbitt
to pass the second reading of an ordinance establishing regulations
relating to cats. 5 Ayes; Nayes, Plan and Berg.
Moved by Councilman Werner, seconded by Councilman Bond to
pass a third and final reading of Ordinance No. 177 restricting
the placement of garbage containers by alleys or curb sides.

Moved by Councilman Plan, seconded by Councilman Berg to pass
the third reading of an Ordinance No. 178, amending Section 9.83
of the City Code dealing with junk cars, furniture, household
appliances and miscellaneous items stored on public or private
property. 7 Ayes; Nayes, None.
Moved by Councilman W~rner, seconded by Councilman Bond to
pass the third and final reading of Ordinance No. 179 amending
Chapter 3 of the City Code dealing with the serving of the
nonintoxicating malt liquor. 7 Ayes; Nayes, None.
Moved by Councilman Nesbitt, seconded by Councilman Plan to
approve the first amendment to redevelopment contract between the
City of Hastings and Master Incorporated. The impact of this
amendment is to change the requirement that the project be 65%
complete before disbursement of the tax increment bond proceeds
or the HRA purchase price proceeds to require only 60% completion.

Moved by Councilman Werner, seconded by Councilman Plan to
set a public hearing for the June 3, 1985 regular City Council
meeting to consider the sale of 33 feet of City land to Mr. & Mrs.
William Helwig. 7 Ayes; Nayes, None.

Moved by Councilman Nesbitt, seconded by Councilman Werner
to adopt Resolution No. 53-85 appointing a responsible authority
and assigning duties for Minnesota Government Data Practices Act.

The Mayor appointed a Committee to discuss the proposal of
Larry and Linda Brown who are in process of formulating plans for
a water slide facility in Hastings. The Mayor appointed Marty
McNamara, Parks and Recreation Director; Andy Endres, Water
Superintendent, Chairman of the Councils Safety Committee,
Chairman of the Councils Planning Committee, Chairman of the Councils
Operations Committee, a representative from the Lake Rebecca
task force, and Legal Counsel.
Moved by Councilman Werner, seconded by Councilman Berg
to accept the resignation, effective immediately, of Scott
Meinhart from the volunteer fire department. The Council
expresses its thanks and appreciation to Mr. Meinhart for his
services. 7 Ayes; Nayes, None.
Moved by Councilman Nesbitt, seconded by Councilman Plan
to have the Council and the Staff develop a set of parameters
with provisions for site location and funding. Library Board
Chairman Richard Graham, Councilman Tom Nesbitt, Councilman
Theola Plan, a member of the County Planning Board, a member
of the County Library Board will be included in discussion
to identify these parameters. 6 Ayes; Nayes, Werner.

Moved by Councilman Kulzer, seconded by Councilman Plan
to authorize the survey of land for appraisal purposes for property
which is surplus farm land at the Minnesota Vet~ra:ns Home. The
property is approximately 67.8 acreas of land located in the
Northeast quarter of Section 34 and the Northwest quarter of
Section 35 Township 115 range 17 in Dakota County. 6 Ayes; Nayes,
Bond.

Moved by Councilman Berg, seconded by Councilman Werner to hire
Carole Sieben as a part-time clerical person to work in the City Hall
Offices. Her effective day of employment would be June 5, 1985 at an
hourly rate of $5.50 per hour and to $6.00 per hour upon successful
completion of a 6 month probationary period. 7 Ayes; Nayes, None.
Moved by Councilman Werner, seconded by Councilman Berg to
grant premilinary approval to the T.H. 55 Frontage Road Design
and proposed funding. 7 Ayes; Nayes, None.
Moved by Councilman Werner, seconded by Councilman Kulzer
to have the City Attorney review the matter of the Bailey Street
Property line establishment and report back to the Council at
the June 3rd regular City Council meeting. 7 Ayes; Nayes, None.
Moved by Council Kulzer, seconded by Councilman Werner to
approved the tinted stamped walk on Sibley Street between 3rd & 4th
Street contingent upon County approval. 6 Ayes; Nayes, Nesbitt.
Moved by Councilman Berg, seconded by Councilman W~rner to set
public hearing for June 3, 1985 regular City Council meeting to
consider the construction of the water main to serve a new water
tower. 7 Ayes; Nayes, None.
Moved by Councilman Nesbitt, seconded by Councilman Werner to
1) pay all bills as audited; 2) Eagles annual amusement license.
