HomeMy WebLinkAbout09-03-85 City of Hastings September 3, 1985 075 The City Council of the City of Hastings, Minnesota met in a regular meeting on Tuesday, September 3, 1985 at 7:30 p.m. in the Council Chambers of the City Hall. I , , Members Present: Counci1rnernber Berg, Werner, Kulzer, Bond, Trautmann, Nesbitt, Plan, Mathiowetz and Mayor Stoffel. Members Absent: None. The Mayor called for additions or corrections to the minutes of the meeting of August 1 9th and the Special meetings of August 16th and August 26, 1985 and hearing none declared the minutes approved as presented. The Mayor declared the Public Hearing open at 7:31 p.m. to consider a proposal to declare 3.43 acres excess property in the Southwest Ponding Basin. Everyone wishing to speak on the matter was given the opportunity to do so. No on wished to speak on the matter. The Mayor closed the Public Hearing at 7:33 p.m. The Mayor declared the Public Hearing open at 7:33 p.m. to consider Rezoning Block 1, Lot 9 Olson's Addition from R2 to Agriculture. Everyone wishing to speak on the matter was given the opportunity to do so. No one wished to speak on the matter. The Mayor closed the Public Hearing at 7: 34 p.m. n The Mayor declared the Public Hearing open at 7:34 p.m. to consider vacating the Old North Frontage Road description. Everyone wishing to speak on the matter was given the opportunity to do so. No one wished to speak on the matter. The Mayor closed the Public Hearing at 7:35 p.m. The Mayor declared the Public Hearing open at 7:36 p.m. to hear and pass on all objections, written or oral, if any, to the proposed assessments on the Ramsey and Tyler streets, street construction, storm sewer and sidewalk. Jim Kleinschmidt, City Engineer, explained the project as to total cost and assessment. The City Mayor asked if anyone wished to speak on the issue. Mr. Herman White, 322 East 3rd Street read a letter stating the following: PUBLIC HEARING-SOUTH- WEST PONDING BASIN- EXCESS PROPERTY PUBLIC HEARING- GUARDIAN ANGELS- REZONING PUBLIC HEARING- VACATION-NORTH FRONTAGE ROAD PUBLIC HEARING-RAMSEY AND TYLER ASSESSMENTS The project has been done in opposition of the residents, the project was a benefit to certain businesses not the residents, there were large holes in the streets during construction, the sewer line was damaged, the front step to his home and the foundations were cracked, he was told that if the driveway had to be installed and there was a previous driveway there would be no cost to the property owner, the lighting was too bright, there was a removal of 14 non-diseased trees causing very high temperatures now in his home, the County Tax Assessor has told him that he will now have higher taxes, there is going to be a parking lot installed across the street. He petitions the City and the County to set aside his assessment due to the mental and physical stress he sustained during and since the construction. Mr. Elmer Sands toe , 322 Ramsey Street stated that he had put in a new sidewalk October of '84 and that the sidewalk was removed and replaced and now has cracks in it. Donald Youngren, 306 Ramsey Street asked why the residents are getting taxed to beautify the area for the businesses and that it will not benefit the residents and he asked if there was a deferred payment policy for Senior Citizens. John Felty, 308 Tyler Street asked why the power lines were moved from one side of the street to the other and he stated that his driveway was torn up and replaced and that he was told that there would be no cost when there had been an existing driveway in place. Bud Rohr, 311 E. 4th Street asked why he was getting assessed because he lived between Ramsey and Tyler and he had no problem. A letter was received from Chicago, Milwaukee, St. Paul and Pacific Railroad Company objecting to any assessment against property. The Mayor closed the public hearing at 8:05 p.m. The Mayor declared the Public Hearing open at 8:06 p.m. to consider declaring the Old Latto Hospital, 620 Ramsey Street, excess property. Everyone wishing to speak on the issue was given the opportunity to do so. No one wished to speak on the rratter. POLICY ON CITY VEHICLES Moved by Counci1rnernber Trautmann, seconded by Councilmernber Werner to adopt the following policy for the use of City vehicles. 8 Ayes; Nayes, None. 1) Any department that has been assigned the use of a city vehicle shall be responsible for that vehicle(s). If an individual within a department has been assigned the use of a vehicle, that individual shall be responsible for that vehicle. That responsibility shall include, but not be limited to the following: 077 September 3, 1985 The general condition of the vehicle both inside and outside. Routine maintenance, such as oil change, greasing, tire rotation, etc. General preventative maintenance. Cleanliness both inside and outside of vehicle. Any and all measures applicable to the care and preservation of the vehicles. No city owned vehicle shall be used for any personal activities or business (except the Police Chief who nay use a city vehicle within 2-way radio communication distance of the Hastings tower). No individual shall consume or be in the possession of any form of alcoholic beverage while requiring the use of a city vehicle. Storage and/or housing of the vehicle shall be provided off-street whenever possible and feasible. All city vehicles shall display the city's ownership insignia, or state required state required I.D. (Except Police). All city vehj..cles mu.st be keRt locked when not in use or pqrked and unoccupied. 'T'he Police & F1.re veh1.cl..es wirl be excluded when doing so will affect the outcome of an emergency S1.tuat1.on. If an individual has been assigned the use of a city vehicle, and that individual schedules vacation or is absent from work for any reason for more than one (1) day, arrangements shall be made to make the vehicle accessible as assigned by the City Administrator. (Except Police and Fire) 8) A duplicate set of keys for each vehicle shall be kept and retained wi thin the department and nade known so that each vehicle can be made accessible by other departmental or city staff. (Except Police and Fire) 9) An employee that is assigned the temporary usage of a city owned vehicle shall make a complete safety check of the vehicle, including, but not limited to stop lights, directional signals, tires, headlights, etc., Before starting a vehicle the oil and fluid levels must be checked. 10) Any employee that has misused the privileges of using a city vehicle, under the adopted policy or any other reason, shall be subject to review and possible discipline. This discipline shall follow the procedure as set forth in the personnel policy and may include but not necessarily limited to restricted or forbidden use of a city vehicle.
