The City Council of the City of Hastings, Minnesota :rret in a regular
:rreeting on ~nday, December 16, 1985 at 7:30 p.m. in the Council Olambers
of the City Hall.
Members Present: Councilm:mber Berg, Werner, Kulzer, Bond, Trautmann,
Nesbitt, Plan, Mathiowetz and Mayor Stoffel.

Members Absent: None.
'!be Mayor called for additions or corrections to the minutes of the
:rreeting of December 2, 1985 and hearing none declared the minutes approved
as presented.
The Mayor declared the Public Hearing open at 7:31 p.m. to consider
vacating uti"lity and drainage easem:mts in Valley Manor. Everyone
wishing to speak on the matter was given the opportunity to do so, no
one wished to do so. The Mayor declared the public hearing closed
at 7:32 p.m.

BIamR
Pastor Lester Fair addressed the audience and the City Council
expressing his apology for breaking the confidence of the neiqhbors
changing his proposal fran a 84 unit to a 102 unit developlEIlt. He
then explained his proposal to the City Council and the audience for
an 84 unit alternative housing for Senior Citizens attached to the
existing Haven lIate Nursing lIate Facility.

Mr. John Stanoch, Herbst & 'Ihue, Law finn, on behalf of Pastor
Fair, presented a history of the Haven lIate Nursing Facility, surplus
prOPerty being sold and SCIre of the services that would be offered at
the facility. He explained that his client, would be willing to put
a clause in the agreem:mt that the financing be contingent upon
exclusive use for ages 62 and over and that he was willing to put a
clause in the deed stating that under no circumstances would this
facility house anyone under 62 years of age.
Ms. Manrine Kunsahure, Health Facility Surveyor, addressed the
needs of Seniors and the costs for long tenn care.
Cindy Laugre, Social Worker in the Metro Area, addressed the
social and SPecial needs of the Senior Citizens. Mr. Russ (Shorty)
Brown stated that he felt there was a need for a Senior Citizen
facility in Hastings.
On behalf of the neighbors in the area, Mr. Jim Storkamp, Attorney,
stated that the neighbors did not oppose the concept of the housing
project for Senior Citizens but that they felt that it was not an appropriate
facility in an R 1 zoning district. Mr. Storkamp presented to the Mayor
a petition with 59 na:rres on it fran the neighborhood, whfuch added to the
previous petition presented to the Planning Ccmnission of 160. He also
cited Section 10.02 Subdivision 1 of the City Ordinance stating that
the intent of this ordinance does not allow such a use in an R1 zone.

Mr. Mel J\gin cited that the Ordinance does not pennit such a use.
Mr. Vaughn Larson requested that the Council vote in favor of
the current hane owners. Mr. Dick Collins stated that in 1969
Pastor Fair had requested a like facility and was turned down
because of the R1 zone.
Mr. Harry Krieger, Mr. Jerry Olson, Mr. Robert Williams, Ms. Patricia
J\gen and Ms. Marie Lu Russman all spoke in opposition to the SPecial
use pennit citing the ordinance and questioning the fire protection.

INSPECrOR POSITION put the Assistant Building Inspector position in the salary adjust::nEnt
schedule with his January 1, 1986 salary being set at $23,801 and IIDVing
to $24,277 at the ti:rre of his first years anniversary. This notion also
approves the transfer fran the contingency fund to the Building Inspection
salary budget the anount $3,250. 8 Ayes; Nayes, None.

The IRS requires that certain vel1icles be exempted and considered
as fringe benefits. The ruling does not exempt the Parks Depart:nEnt
vehicles, the Street Depart::nEnt vehicles and the Building Depart::nEnt
vehicles. The IRS indicates that an employee using one of these vehiCles
be charged $3.00 per day for ccmnuting. State and Federal withholding
taxes and social security taxes must be withheld fran these employees
last check issued on Deca:r1ber' 30, 1985. This deduction for withholding
will "'~Tange fran $170 to $230 for 1985.
