Regular Meeting
7:00 pm
Chairman Twedt called the meeting to order at 7:00 pm.
1. Roll Call
Commissioners Present: Hiedeman, McInnis, Peine, Truax, Twedt, Zeyen.
Commissioners Absent: Schmitt
Staff Present: Planning Director John Hinzman, Associate Planner
Kris Jenson, Public Works Director Tom Montgomery.
2. Approve January 9,2005 Planning Commission Meeting Minutes
Commissioner Truax requested that the minutes be modified to reflect that the
Fountain Meadows proposal did not come back before the Commission at
tonight's meeting as anticipated.
Motion by Commissioner Truax, second by Commissioner Zeyen to approve
the minutes of the January 9, 2005 Planning Commission meeting as presented
by Staff with Commissioner Truax's notation. Motion passed unanimously.
PUBLIC HEARINGS
3. Pakola, Robert - Special Use Permit #2006-03 - 1st Floor Residential in a C-3
District - 315 3rd St E.
Chairman Twedt opened the public hearing at 7:06 pm. Hearing no comment,
the hearing was closed at 7:07 pm.
Commissioner Truax questioned that if the commercial area needed four spaces,
and the upstairs units required two spaces, how was this site not deficient on
parking.
Director Hinzman stated that an ordinance was passed 2-3 years ago that
grandfathered in all existing uses within the downtown area for parking
requirements. The ordinance also stated that any intensification of a use required
the intensification to meet the parking requirements. The office portion of the
building would require just slightly more than 2 spaces, and with the existing
garage and driveway off 3rd St E, the site does meet the requirements.
Robert Pakola, applicant, stated that the office to be located within the building
will be a satellite office for his architecture business and that he would be the

only person working out of that space.
Planning Commission Action:
Commissioner McInnis moved and Commissioner Truax seconded the motion
to recommend approval of a Special Use Permit for Robert Pakola at 315 3rd St
E to permit partial residential use of the 1st floor in the C-3 Community
Regional Commerce Zoning District to the City Council, with the following
conditions:
1) Adherence to the site plan presented to the Planning Commission.
2) Any modifications or additions to the building may require further City
review and approval.
3) Approval is subject to a one year Sunset Clause; if significant progress is
not made towards construction of the proposal within one year of City
Council approval, the approval is null and void.
Upon vote taken, Ayes: 6, Nays: O. Motion passed.
OTHER ACTIONS
4. City of Hastings - Site Plan #2006-06 - Well House No.8 - 39521 st Street E.
Planner Jenson presented background information on the request.
Commissioner Truax stated that his following comment did not related to land
use issues, but that he was going to say it anyway. If the Public Works
Department has the money to install cameras at this site, then he feels that
money could have been found to install cameras at the skate park for security,
rather than having to close it altogether.
Chairman Twedt expressed concern for impacts on the nearby walking path.
Public Works Director Tom Montgomery stated that the nearby path would not
be impacted or used in any way for the construction of this facility. It will have
its own driveway to the site. Direction was also give to the architects to
compliment the shapes of the existing picnic shelter and overlook buildings
already on site.
Chairman Twedt questioned how this would improve the City's water supply.
Director Montgomery stated that during the peak summer periods, the current
five wells pump for 20 hours a day, and were one to go down, it would require
serious conservation measures such as city-wide sprinkling bans. During the
winter months, the City only has two of the wells pumping to provide water. He
added that the construction of this well is about two years past due.
Commissioner McInnis asked at what level would the City be comfortable with
for pumping during the peak summer periods.
Director Montgomery said 15 to 16 hours per day would be acceptable.

Commissioner Zeyen questioned the cost for this entire project.
Director Montgomery stated that will the drilling of the well and construction of
the building it is anticipated to cost around $800,000.
Planning Commission Action:
Commissioner Truax moved and Commissioner Hiedeman seconded the
motion to recommend approval of the site plan for Well house #8 at 395 21st St
E in Vermillion Falls Park to the City Council, with the following conditions:
1) Adherence to the Site Plan and Architectural Elevations as presented to the
City Council.
2) All disturbed areas on this property shall be stabilized with rooting
vegetative cover to eliminate erosion problems.
3) The disturbed areas of the site shall be maintained to the requirements of the
City's property maintenance ordinance.
4) Final approval of the development grading and utility plans by the City of
Hastings.
5) Lighting must not exceed 0.5 foot candles at the property line.
6) Any signage on the site is required to obtain a sign permit from the Planning
Department prior to being erected on site.
7) Approval is subject to a one year Sunset Clause; if significant progress is not
made towards construction of the proposal within one year of City Council
approval, the approval is null and void.
Upon vote taken, Ayes: 6, Nays: O. Motion passed.
5. City of Hastings - Site Plan #2006-07 - Water Treatment Plant - 1320 N.
Frontage Rd.
Planner Jenson presented the Staff report on the item.
Commissioner Hiedeman asked about what type of properties the landscape
ordinance applied to.
Director Hinzman stated that the landscape ordinance applies to commercial and
industrial projects, as well as multi-family residential.
Chairman Twedt asked why the addition was necessary.
Director Montgomery stated that due to rising nitrate levels in wells #3 (in Lions
Park) and #5 (along N. Frontage Rd) the water needed to be treated to remove
the nitrates. Water from both wells will be combined at this location and treated
before flowing into the system for distribution. He added that the City has been
studying ways to address this issue for 2 years.
Commissioner Peine questioned the reason that the new portion appeared to be
two-stories tall.

Director Montgomery stated that the size of the tanks in the plant requires a
taller building that the existing well house currently is.
Planning Commission Action:

to recommend approval of the site plan for the water treatment plant at 1320 N.
Frontage Rd to the City Council, with the following conditions:

6. Presentation of 2005 Planning Department Annual Report
Director Hinzman recapped the past year in relation to projects approved, lot
supply, and potential future projects.
7. Other Business
Director Hinzman updated the Commission on Council actions since the last
Commission meeting.
