Regular Meeting
7:00 pm
Chairman Anderson called the meeting to order at 7:03 pm.
1. Roll Call
Commissioners Present: Anderson, Greil, Hollenbeck, Stotko, Truax, Twedt
Commissioners Absent: Michno
Staff Present: Associate Planner Kris Jenson
2. Approve March 20, 2002 Planning Commission Minutes
With no changes, the minutes were accepted by a unanimous vote.
Public Hearing - Wallin Property Special Use Permit - to place fill in a floodway area
of the Vermillion River.
Planner Jenson stated that because the required information was not received from the applicant,
Staff requested that the item be tabled until the next Planning Commission meeting. She
reminded the Commission that it would require a vote to table the item.
Planning Commission Action:
Commissioner Greil moved and Commissioner Hollenbeck seconded the motion to table the
Special Use Permit request to place fill within a floodway area until the May 13th meeting,
due to insufficient information.
Upon vote taken: Ayes: 6 Nays: 0. Motion carried.
4. Public Hearing - Minor Subdivision for 15xx Florence Street
Planner Jenson presented background on the project.
Chairman Anderson opened the public hearing at 7:06 pm. Hearing no public comment, the
hearing was closed at 7:07 pm.
Commissioner Truax inquired as to some inconsistencies from the site plan map to existing
conditions in the field.
Planner Jenson stated that the information included on the site plan map is to help the
Commission identify the area affected by the request. Specific information such as building
locations is gathered from aerial photographs taken by Dakota County, and that the information is
only updated occasionally due to the costs involved.
Commissioner Greil inquired as to parking availability in the area.
Planner Jenson stated that each unit is required to provide at least two off-street parking spaces,
which are generally provided for in the garages or the driveway for the units.
Planning Commission Action:
Commissioner Stotko moved and Commissioner Greil seconded the motion to recommend
for Lot 4, Block 1, REUTER
Approval of a resolution waving platting requirements.
The resolution waving platting requirements and a certificate of survey shall be recorded
with the County. A copy of the certificate of survey shall also be filed with the City.
3. The applicant shall pay $850.00 in park dedication fees, prior to release of the resolution.
4. The applicant shall pay $315.00 in sewer interceptor fees, prior to release of the
resolution.
5. The developer shall plant one front yard tree at the time of home construction. This tree
shall be at least two inches in diameter at the base and the species of the tree should be on
the list of approved trees created by the City Forester. This requirement is consistent with
what the city has been requiring in other areas.
Upon vote taken: Ayes: 6, Nays: 0, Motion carried.
5. Public Hearing - Minor Subdivision of 315 Spring Street.
Planner Jenson presented background on the item.
Chairman Anderson opened the public hearing at 7:13 pm.
Matt Cumber, a representative of Hastings Housing Coalition, stated the he felt this was a good
use of the land and that Habitat makes a strong effort to fit in with the neighborhood.
The public hearing was closed at 7:16 p.m.
Commissioner Greil complemented the house design, saying that he feels it will blend with the
neighborhood very well. He inquired about the payment of only one park dedication fee and
sewer interceptor fee on the site.
Planner Jenson stated that because there had been an existing home on the site until a couple of
years ago, that the site was being given credit for that unit.
Chairman Anderson complimented the home design as well, and expressed a wish that more units
in the neighborhood would follow Habitat's lead.
Commissioner Twedt inquired if the site was located within a historic district.
Planner Jenson stated that it was not.

Planning Commission Action:
Commissioner Truax moved and Commissioner Hollenbeck seconded the motion to
approve the minor subdivision of 315 Spring Street, subject to the following conditions:

6. Variance - request by Dave Bohlken for a front yard setback variance.
Planner Jenson presented background information on the item.
Commissioner Twedt inquired about the location of the retaining wall on the property as
mentioned in the Staff report.
Planner Jenson stated that while she had not visited the site, the Staff report did indicate that is
was along the north property line.
Commissioner Greil asked Commissioner Twedt if he had a specific concern regarding the
retaining wall.
Commissioner Twedt stated that he was concerned about the location of the retaining wall in
relation to the proposed addition.
Planner Jenson stated that the applicant was requesting a front yard variance to construct an
addition to an existing front porch. The addition would wrap around the house, covering
approximately half of the home. At the point, the porch would become a singe-car garage for
storage on the site. The applicant is also intending to construct a deck on the rear of the home.
All construction will meet setback requirements except the area of the porch at the front of the
building.
Planning Commission Action:
Commissioner Twedt moved and Commissioner Hollenbeck seconded a motion to recommend
approval of the variance for the front yard setback to 7.5' from 20' for 410 Forest Street to the
City Council, based on the following findings of fact:
1) Construction of the home predates establishment of minimum front yard setbacks. The
proposed addition would not encroach any further into the front yard setback than the
existing home.
Upon vote taken: Ayes: 6, Nays: 0. Motion carried.
