DETERMINATION OF QUORUM IV. APPROVAL OF MINUTES Approve Minutes of the Regular City Council Meeting, Special City Council on August 16, 2018 and Council Workshop on August 6, 2018 Minutes were approved as presented. V. COUNCIL ITEMS TO BE CONSIDERED VI. CONSENT AGENDA The items on the Consent Agenda are items of routine nature or no perceived controversy to be acted upon by the City Council in a single motion. There will be no discussion on these items unless a Councilmember or citizen so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. Approve Pay Estimate #2 – 2018 Mill & Overlay Project ($354,062.07) 4. Approve Pay Estimate #3 - 2018 Neighborhood Infrastructure Improvements 5. Approve Pay Estimate #4 – Riverfront Renaissance Improvements Phase 3.1 ($200,220.76) 6. Resolution No. 08-07-18 - Accept $400.00 Memorial Tree Donation from Sue Schmoller to the City Parks & Recreation Department 7. Approve Utility Disconnection Agreement – United Methodist Church (1525 Maple Street) VII. AWARDING OF CONTRACTS AND PUBLIC HEARING These are formal proceedings that give the public the opportunity to express their concern, ask questions, provide additional information, or support on a particular matter. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. 1. Public Hearing – Vacation of Easement #2018-39 – Wallin 17th Addition Sign up to receive automatic notification of Council agendas At ccagenda-subscribe@hastingsmn.gov or by calling 651-480-2350 City Council packets can be viewed in searchable format on the City’s website at http://www.hastingsmn.gov/city-government/city-council/city-council-agendas-and-minutes Hinzman introduced the item which asks the Council to hold a public hearing and consider vacation of a drainage and utility easement located on Outlot A, Wallin 17th Addition. Final action on the resolution to vacate the easement will not be sought at tonight’s meeting; action will be held in conjunction with the Preliminary and Final Plat application of Wallin 18th Addition. Public Hearing opened at 7:06 p.m. Todd Rapp, Attorney for Wallin Development clarified the action relates to the Wallin 16th addition. Public Hearing closed at 7:09 p.m. VIII. REPORTS FROM CITY STAFF These items are intended primarily for Council discussion and action. It is up to the discretion of the Mayor as to what, if any, public comment will be heard on these agenda items. A. Public Works B. Community Development 1. Resolution 08-08-18: Variance to 35’ Shoreland Height Limit – Vermillion Shores Apartment – WAI Continuum (950 31st St. W.) Hinzman introduced the item asking Council to approve a site plan for a 60 unit apartment building to be located at 950 West 31st Street, allow for a variance up to the 35’ maximum height of structures in a Shoreland Overlay District, and issue a Special Use Permit for a multiple-family residential dwelling in a Shoreland Overlay District. The request is being brought forward by WAI Continuum on property owned by Siewert Construction Company. Council discussion on reason for height restriction by DNR, option to flip development on curvature, other properties in City that may need similar variance, amount of impervious surface, rainwater mitigation requirements, and height of apartment building across street. Leifeld, Braucks to approve as presented. 6-0 2. Resolution 08-09-18: Special Use Permit – Multiple Family Residential Building – Vermillion Shores Apartment – WAI Continuum (950 31st St. W.) Vaughan, Leifeld to approve as presented. 6-0 3. Resolution 08-10-18: Site Plan Vermillion Shores Apartment – WAI Continuum (950 31st St. W.) Council discussion on nearest playground and trail connections. Leifeld, Braucks to approve as presented. 6-0 4. Resolution 08-11-18: Preliminary and Final Plat – South Pines 9 – Greg J. Homes (Sandpiper Circle) Hinzman introduced the item requesting the Council grant preliminary and final plat approval of South Pines 9 containing 25 single family lots and one outlot. The property is generally located along Sandpiper Circle, north of Tuttle Drive. Council discussion encouraging staff to ensure developer follows construction traffic conditions. COMMENTS FROM AUDIENCE During this period of time, citizens may speak informally to the Council on subjects not on the agenda Todd Siewert responded to comments regarding recent opinion article published in the Hastings Star Gazette. Matt Begich, 718 West 14th Street, raised questions about tree trimming and topping of trees. Staff will follow up with Mr. Begich. Dan Peterfesso, 109 Sandpiper Circle, inquired about City Council’s influence and role in Highway 316 project. Open House is scheduled for Tuesday, August 21st. Mr. Peterfesso also inquired about future plans to extend Tuttle Drive and possible discussions with Marshan Township. X. UNFINISHED BUSINESS XI. NEW BUSINESS XII. REPORTS FROM CITY COMMITTEES, OFFICERS, COUNCILMEMBERS  Highway 316 Improvements – Public Open House on Tuesday, August 21st from 5:00 – 7:00 p.m. at Crossroads Church.  Parks and Recreation Commission meeting on Tuesday, August 21st at 6:30 p.m. at City Hall.  Heritage Preservation Commission meeting on Tuesday, August 21st at 7:00 p.m. at City Hall.  Planning Commission will meet on Monday, September 27th at 7:00 p.m. at City Hall.  City Offices will be closed on Monday, September 3rd in observance of Labor Day.
