DETERMINATION OF QUORUM V. APPROVAL OF MINUTES Approve Minutes of the Regular City Council meeting on March 18, 2019 Minutes were approved as presented. VI. COMMENTS FROM THE AUDIENCE Gary Stevens of 1326 W. 17th Street commented on infrastructure needs on 15th Street and mill and overlay program. VII. COUNCIL ITEMS TO BE CONSIDERED Councilmember Lund asked to add a review of the neighborhood improvement process to the Operations Committee. Mayor Fasbender indicated this would be moved to #3 under Administration. Braucks, Lund to add to agenda. 7-0 VIII. CONSENT AGENDA The items on the Consent Agenda are items of routine nature or no perceived controversy to be acted upon by the City Council in a single motion. There will be no discussion on these items unless a Councilmember so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. Resolution No. 04-03-19: Approve an In-Store Fireworks License for Cub Foods 10. Resolution No. 04-04-19: Approve a Temporary On-Sale Liquor License for Dakota County Historical Society 11. Resolution No. 04-05-19: Reauthorization of Variance to Erect Carport; Peters, 295 West 15th Street 12. Resolution No. 04-06-19: Proclaiming Arbor Day for 2019 IX. AWARDING OF CONTRACTS AND PUBLIC HEARING These are formal proceedings that give the public the opportunity to express their concern, ask questions, provide additional information, or support on a particular matter. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. X. REPORTS FROM CITY STAFF These items are intended primarily for Council discussion and action. It is up to the discretion of the Mayor as to what, if any, public comment will be heard on these agenda items. A. Public Works 1. Adopt ADA Transition Plan Caven summarized the origins of the ADA Transition Plan and that it was a 30 year plan established to ensure the City’s infrastructure was in ADA compliance. Council approval is needed to qualify for federal funding if it becomes available. Council discussion showing appreciation for staff work on project, federal mandate without funding, total costs, grant funding options, 30 year timeline, resident responsibilities, MnDOT schedule for intersection upgrades, playground accessibility, upgrading City facilities when remodeling. Balsanek, Lund to approve as presented. 7-0 B. Community Development 1. Resolution No. 04-07-19: Minor Subdivision and Variance #2019-06; Kranz, 1548 Featherstone Road Hinzman discussed the minor subdivision and variance request for 1548 Featherstone Road. Planning Commission voted to approve with no concerns heard from neighboring residents. Council discussion on potential development near property in future and neighborhood notification. Administration 1. Seek City Council Direction on Consent Agenda Process Fluegel described the Consent Agenda process and the pros/cons of allowing citizens to remove items from the agenda. Council discussion at what point during the council meeting comments from the audience are received. Fluegel clarified language has been on consent agenda since at least 1984. Balsanek, Vaughan to not include citizen ability to remove items from the consent agenda. Folch motion to amend to add “on consent agenda or other items” to Comments from the Audience header. Seconded by Councilmember Leifeld. Roll call vote. 5-2 Balsanek and Vaughan voting against. 2. Solar Subscription Opportunities Councilmember Folch recapped the history of solar opportunities for the City and asked that it be presented to the Planning Commission for their consideration. ISD 200 School Board Member Kelsey Waits spoke about the school board decision process for a solar subscription. Council discussion on changing technology, carbon free energy, past solar subscription process, solar not identified as council priority, process for item coming back to council, appropriate committee of council or commission to take up item, concerns with previously proposed contracts. Folch make motion to approve and send to Planning Commission, seconded by Councilmember Leifeld. Councilmember Leifeld amends motion to send item to Utilities Committee of the Council. Leifeld, Lund to amend motion. 7-0 Vote on main motion as amended. 7-0 3. Neighborhood Infrastructure Process Councilmember Lund asked to have the neighborhood infrastructure process referred to the Operations Committee of the Council to look at three things: CIP used as guidance to provide more notification to residents of upcoming street improvement projects, creating a brochure of process from start to finish, including timelines, definitions, etc., and clarity of formulas used to calculate assessment and documenting these formulas.
