HomeMy WebLinkAbout20200203 - CC Minutes Hastings, Minnesota City Council Minutes February 3,2020 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, February 3, 2020 at 7:00 p.m. in the Council Chambers at the Hastings City Hall, 101 East 4"'Street, Hastings, Minnesota. Members Present: Mayor Fasbender, Councilmembers Balsanek, Braucks, Folch, Leifeld, Lund and Vaughan Staff Present: City Administrator Dan Wietecha Administrative Services Director Julie Flaten City Attorney Dan Fluegel Community Development Director John Hinzman Park&Recreation Director Chris Jenkins IT Manager Alan Nordquist Councilmember Balsanek recognized former Councilmember Tom Nesbitt Sr. with a moment of silence. Presentation: Dakota Broadband Board, Executive Director Carah Koch Carah Koch, Executive Director of Dakota Broadband Board, provided an overview and update of the Dakota Broadband Board activities. Council discussed 5G, comparison to similar counties and cities, underserved areas in the county and state, the lack of fiber laid and possible future fiber growth in Hastings and possible further discussion at a City Council Work Session or at a Utilities Committee of the Council meeting. The Council thanked the Dakota Broadband for all of their work. Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the Regular City Council meeting on January 21, 2020. Minutes were approved as presented. Resolution No. 02-04-20: Acceptance of and Appreciation of a Donation from the Starkson Family Life Celebration Chapel to the Hastings Police Reserve 7. Accept Scholarship from Flint Hills Resources for Firefighter Training 8. Approve`The Longer Table' as a Special Event 9. Approve Water Service Repair Assessment Request—515 Tiffany Drive(Krinke) 10. Approve Special Event Request—League of Women Voters 11. Appoint New Parks &Recreation Commissioner—Santelman 12. Side by Sides/ATV's/Golf Carts on City Streets 13. Approve Agreement Regarding Sewer and Water Service Lines and Waiver of Procedural Irregularity and Assessment Appeal—Glendale Heights 3`d Addition Councilmember Balsanek motioned to approve as presented,seconded by Councilmember Folch. Ayes 7; Nays 0. Public Hearing: Resolution No. 02-05-20: Comprehensive Plan Amendment and 2"d Reading/Adopt Ordinance No. 2020-02: Rezone Property-Shepherd of the Valley Church(1450 West 4th Street) Hinzman detailed the reason for the Comprehensive Plan Amendment and rezoning of the property located at 1450 West 4`h Street. Mayor Fasbender public hearing opened at 7:38 p.m. Robert Wellemeyer, resident on Summit Point Court, presented a petition signed by 75 residents and spoke in opposition of rezoning the property. Hearing no further comments, Mayor Fasbender closed the public hearing at 7:43 p.m. Council discussed the 17 unit calculation, ownership of the property to the West, clarification on the effects of the zoning changes, number of lots if the property stayed zoned as R1, possible effects of re-zoning the entire property as R3,recognition of the Church of requesting to only re-zone approximately half of property, next steps in process if approved, Council's ability to review and plans in the future, potential increase in traffic, possibly delaying the decision until traffic impacts have been examined, types of development which may occur in R1 and R3, how the re-zoning may meet the current housing needs in Hastings, potential saturation of R3 zoning, comprehensive plan guidance, current neighborhood mix of townhomes and single family homes, other developments around City, infrastructure needs, neighborhood concerns and the City's ability to regulate traffic flow. Councilmember Folch motioned to approve Resolution No. 02-05-20: Comprehensive Plan Amendment as presented, seconded by Councilmember Braucks. Ayes 5;Nays I-Balsanek; Lund abstained. Councilmember Folch motioned to approve Ordinance No. 2020-02:Rezone Property as presented, seconded by Councilmember Leifeld. During the discussion; prior to voting, Councilmember Balsanek motioned to table this item. Councilmember Balsanek's motion was not seconded. Ayes 4;Nays 2 -Balsanek and Vaughan; Lund abstained. Approve Joint Powers Agreement with Dakota County for Mississippi River Regional Trail Reconstruction Project Jenkins discussed the joint powers agreement between Dakota County and the City for the Mississippi River Regional Trail Reconstruction project. Council discussed portable restroom locations and summer restroom availability. Councilmember Balsanek motioned to approve as presented,seconded by Councilmember Lund. Ayes 7;Nays 0. Remove from the Table: Keeping of Chickens Hinzman explained the history of this request with Council, Commissions, and Committee meetings and why it was being asked to be removed from the table. Councilmember Folch motioned to remove from the table, seconded by Councilmember Leifeld. Ayes -Folch, Leifeld and Fasbender; Nays - Vaughan, Balsanek, Braucks and Lund. Motion failed,the item was not removed from the table. Draft Ordinance: Keeping of Chickens No discussion. Mediated Settlement Agreement Fluegel summarized the events leading up to mediation and the mediation settlement agreement with Greg J Homes of Hastings, Inc. Council discussed the settlement and the MS-4 permit requirements. Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Braucks. Ayes 7;Nays 0. Authorize Submittal of COPS Grant Application Wietecha explained the benefits of the COPS Hiring Program Grant;that it could provide 75%of entry level wages and benefits up to$125,000 to hire new or rehire existing career law enforcement officers. He asked that Council direct the Public Safety Committee of the City Council to consider allowing Hastings Police Department to apply for the grant by the mid-March deadline. Council clarified the definition of re-hiring law enforcement personnel. Councilmember Vaughan motioned to approve as presented, seconded by Councilmember Leifeld. Ayes 7;Nays 0. Mayor Fasbender and Councilmembers made the following announcements: • Mayor's State of the City Address Wednesday, February 5 at 11:30 a.m. at the Hastings Golf Club. • Public Safety Committee of the City Council will meet on Thursday, February 6 at 5:30 p.m. • Planning Commission will meet on Monday, February 10 at 7:00 p.m. • Operations Committee will meet on Tuesday, February 11 at 7:00 a.m. • Parks &Recreation Commission will meet on Tuesday, February 11 at 7:00 p.m. • HEDRA will meet on Thursday, February 13 at 6:00 p.m. • All City offices are closed Monday, February 17 in observation of President's Day • Heritage Preservation Commission will meet on Tuesday, February 18 at 7:00 p.m. • Councilmember Folch asked for an update on the existence of a pandemic plan for the City. • Councilmember Vaughan gave an update that funds were included in the Governor's bonding bill for projects supported by the Great River Rail Commission. • On Tuesday, February 4 at 3:15 p.m. Dakota County will unveil new public art near the Judicial Center in Hastings. • On Saturday, February 8 Ice Fishing Adventures will be held at Lake Rebecca from 9:00 — 11:00 a.m. • On Thursday, February 13 After Hours Skate Night for teens will be held at Pioneer Park beginning at 8:30 p.m. • League of Women Voters will hold a voter information session on the Presidential Nomination Primary on Saturday, February 15 at City Hall beginning at 9:00 a.m. • Police Department staff will participate in the Polar Plunge on Saturday, February 22.
