City Council Meeting Minutes
September 21,2020
The City Council of the City of Hastings,Minnesota met in a regular meeting on Monday, September 21,
2020 at 7:00 p.m.via Zoom video conference.
Mayor Fasbender explained why and referenced various city, state and federal declarations and guidelines that
an in-person meeting was not practical or prudent due to the COVID-19 Pandemic.
Members Present: Mayor Fasbender, Councilmembers Balsanek,Braucks,Folch,Leifeld, Lund and Vaughan

Approval of Minutes
Mayor Fasbender asked if there were any additions or corrections to the minutes of the City Council
Meeting on September 8,2020.
Minutes were approved as presented.
Comments from the Audience
Mayor Fasbender stated comments received about items not on the agenda have been distributed to all
councilmembers and are acknowledged.

Public Hearing for Ordinance Amendment 2020-11-Rezone Property to R-3 Medium-High Density
Residence-PRD-Villas at Pleasant(Northridge and Pleasant),and Resolution No. 09-10-20:
Preliminary Plat-32 Lots and Resolution No.09-11-20: Final Plat- 16 Lots

Hinzman detailed the ordinance amendment to rezone the property Iocated at Northridge and Pleasant
from A-Agriculture and R-1 Single Family Residence to R-3 Medium-High Density Residence-Planned
Residential Development fora 32-lot subdivision consisting of villa homes and the preliminary and final plats.
He indicated that the Planning Commission unanimously voted for the rezoning and approved the preliminary
and final plats.
Mayor Fasbender noted all comments received prior to the meeting were distributed to the Council and
are part of the record.
Mayor Fasbender opened the public hearing at 8:00 p.m.
Kevin Green, 1782 Fallbrooke Drive, spoke in support of the development.
Paul Hiller,2467 Rivershore Court, spoke in opposition of the development.
Hearing no further comments, Mayor Fasbender closed the public hearing at 8:07 p.m.
Council discussed how reducing the size of cul de sacs effects emergency service vehicle access and
snow removal,proximity of cul de sacs to adjacent properties, placement and removal of accumulated snow,
light spill to adjacent properties and the associated privacy fence and landscaping to reduce light spillage,
number of units on site if zoned R1,parking allowed in cul de sacs, City's cul de sac requirements,potential
public/private maintenance agreement for snow removal, stormwater runoff, lengthening of privacy fence and
additional landscaping, curb cut restrictions on Pleasant Drive, removing the cul de sacs and connecting the
streets,roles of Council, appreciation for development and housing needs in the community.
Stuart Simek, developer,provided clarification on several items.
Councilmember Balsanek motioned to approve the ordinance amendment as presented, seconded by
Councilmember Braucks. Roll Call: Ayes 7;Nays 0.
Councilmember Balsanek motioned to approve the preliminary plat as presented, seconded by
Councilmember Leifeld.
Council discussed the need to re-examine the City's cul de sac requirements to include access for
emergency and snow removal vehicles and public versus private maintenance.
Roll Call:Ayes 5;Nays 2—Lund and Vaughan.
Councilmember Balsanek motioned to approve the final plat as presented, seconded by
Councilmember Folch. Roll Call: Ayes 6;Nays 1 Vaughan.
Public Hearing for Ordinance Amendment 2020-12-Rezone Property to R-2 Medium Density Residence
- Sieben Ridge(General Sieben Drive)
Hinzman detailed the ordinance amendment to rezone the property located on General Sieben Drive
between Northridge Drive and Fallbrooke Drive from A-Agriculture to R-2 Medium Density Residence for a
116-lot subdivision consisting of traditional single family and villa homes.He indicated that the Planning
Commission unanimously voted for the rezoning. He also commented that the preliminary and final plats were
removed from discussion because the developer provided revisions which need to be reviewed by staff prior to
Council review.

Council discussed ownership of the adjacent property,adjustment to building standards due to
proximity to quarry and potential pollution concerns.
Councilmember Vaughan motioned to approve the ordinance amendment as presented, seconded by
Councilmember Braucks. Roll Call: Ayes 7;Nays 0.
Public Hearing. Vacation of Easement-Lot 10,Bloch 3,Riverwood 8th Addition (West 36th Street)
Hinman explained the reasons to consider the vacation of portions of a drainage and utility easement
and that final adoption of the resolution will be considered at an upcoming Council meeting.
Mayor Fasbender opened the public hearing at 9:07 p.m.
Hearing no comments,Mayor Fasbender closed the public hearing at 9:08 p.m.
Resolution No.9-12-20: Relocate Existing Home-Al Sieben (535 35th Street W)
Hinzman discussed the proposed house move and that the Planning Commission voted to deny the
request.
Council discussed the requirements for green space around the home and driveway and garage
requirements.
Councilmember Balsanek motioned to approve the denial as presented, seconded by Councilmember
Vaughan. Roll Call: Ayes 7;Nays 0.
Tourism Update
Kristy Barse, Chamber President,discussed the Chamber of Commerce 2020-2021 marketing plan and
budget.
Council expressed appreciation to the Chamber for adaptation during the COVID-19 Pandemic.
Councilmember Folch motioned to approve as presented, seconded by Councilmember Lund.Roll
Call:Ayes 7;Nays 0.
CARES Act
Wietecha discussed the various requested council actions relating to CARES Act Funding approvals.
He summarized previous approvals and pending expenses.
Councilmember Balsanek motioned to remove the motion of reimbursing HEDRA$233,000 for the
HEART grant and license fee relief from the table, seconded by Councilmember Leifeld.Roll Call: Ayes 7;
Nays 0.
Councilmember Folch withdrew the original motion and Councilmember Balsanek withdrew the
second to the original motion.

Councilmember Balsanek motioned to approve Items 1 through 8,the second set of recommendations
as listed in the staff report and$2,500 for plexiglass in the Council Chambers,seconded by Councilmember
Braucks.
Council discussed possibly waiving the second half of liquor license fees and whether the CARES Act
funding was applicable for this, previously discussed potential expenses, other possible uses of remaining
funds and next steps.

Resolution No.09-08-20: Approve Preliminary 2021 City Properly Tax Levy,Preliminary Budget and
Setting Truth in Taxation Hearing and Resolution No.09-09-20: Approve Proposed 2021 HEDRA—
HRA Special Tax Levy
Wietecha discussed the preliminary 2021 City property tax levy,budget, setting the truth in taxation
hearing date and the proposed 2021 HEDRA/HRA special tax levy.
Council discussed HEDRA housing and site acquisition proposed budget items and expressed
appreciation for fiscal conservativeness when preparing budget proposal.
Councilmember Lund motioned to approve the Preliminary 2021 City Property Tax Levy, Preliminary
Budget and Setting Truth in Taxation Hearing date as presented,seconded by Councilmember Folch.Roll
Call: Ayes 7;Nays 0.
Councilmember Vaughan motioned to approve the Proposed 2021 HEDRA—HRA Special Tax Levy
as presented, seconded by Councilmember Lund. Roll Call: Ayes 7;Nays 0.
Closed Door Session to Discuss Evaluation of Individual Subject to City Council Authority pursuant
to Minn. Stat. 13D.05,subd.3(a)
Mayor Fasbender indicated the relevant MN Statute as to why there is a closed-door session.
Councilmember Braucks motioned to close the public meeting and open the closed-door session at
10:32 p.m., seconded by Councilmember Lund. Roll Call: Ayes 7;Nays 0.
Councilmember Balsanek motioned to close the closed-door session and reopen the public meeting at
11:48 p.m., seconded by Councilmember Braucks. Roll Call: Ayes 7;Nays 0.
Mayor Fasbender and Councilmembers made the following announcements:
• HEDRA will meet on Thursday, September 24 at 6:00 p.m.
• Planning Commission will meet on Monday, September 28 at 7:00 p.m..
• Happy Birthday to Councilmember Braucks!
• We have several other recreation programs coming up at Levee Park:
o Raptors in the Park on Wednesday, September 23 at 6 pm. A live raptor presentation in
partnership with Carpenter Nature Center.
o Movie in the Park—"The Karate Kid"will be shown on Friday, September 25 at 7:00 pm,
sponsored by Ardent Mills. Teran Harmon State Farm.Insurance Agent will host fun
giveaways, including glow sticks. Please bring a non-perishable food donation for Hasting
Family Service.

o Performance in the Park on Tuesday, September 29 at 6 pm. BRKFST Dance Co. will
give a breakdancing, martial arts, and contemporary dance performance.
o Story in the Park on Wednesday, September 30 at 6:00 pm. For kids 0 and under, enjoy
big book stories, music, and socially distanced activities all about animals. Kids must be
accompanied by a caregiver.
Councilmember Leifeld motioned to adjourn the meeting at 11:49 p.m., seconded by Councilmember
