V. APPROVAL OF MINUTES
Approve Minutes of the Regular City Council meeting on April 19, 2021.
Minutes were approved as presented.

Mayor Fasbender stated comments received have been distributed to all
councilmembers and are acknowledged.
VII. COUNCIL ITEMS TO BE CONSIDERED
VIIL CONSENT AGENDA
The items on the Consent Agenda are items of routine nature or no perceived controversy to be
acted upon by the City Council in a single motion. There will be no discussion on these items
unless a Councilmember so requests, in which event the items will be removed from the Consent
Agenda to the appropriate Department for discussion.

IX. AWARDING OF CONTRACTS AND PUBLIC HEARING
These are formal proceedings that give the public the opportunity to express their concern, ask
questions,provide additional information, or support on a particular matter. Once the public
hearing is closed, no further testimony is typically allowed and the Council will deliberate
amongst itself and with staff and/or applicant on potential action by the Council.
1. Resolution No. 05-04-21: Award of Contract for 2021 Neighborhood Infrastructure
Improvements (W 15d' Street- Phase II)—McNamara Construction($2,595,590.00)
Stempski discussed the 2021 Neighborhood Infrastructure Improvements,
received bids and why the contract should be awarded to McNamara
Contracting.

2. Public Hearing: Sidewalk Cafe License for Geek Grind LLC d/b/a Geek Haven
Coffee, 120 2nd Street East
Hinzman detailed the sidewalk cafe request from the Geek Grind. He also noted
that staff reviewed the application and recommends approval.
Public hearing opened at 7:12 p.m. and hearing no comments, the public
hearing was closed.
3. Public Hearing: City Code Amendment-Climate Controlled Storage
Hinzman detailed the amendment to the City Code to allow climate controlled
storage as a use in the C-4 Zoning District. He noted that the Planning
Commission unanimously voted to recommend approval.
Public hearing opened at 7:16 p.m.
No comments were heard.

3. Resolution No. 05-05-21: South Oaks of Hastings 4t1i Addition-Preliminary and
Final Plat Approval- Greg J Homes
Hinzman discussed the preliminary and final plats for South Oaks of
Hastings 4r"Addition, specified that staff recommends approval, the reasons
why the Planning Commission unanimously voted to deny the application
and received public comments. He also noted the grading and drainage
information is still missing.
Council discussion of original approval of preliminary and final plats in
2017 but expired because they were never filed with the County,why this
item was brought before Council regardless of the missing information,
what happens if application was denied, sidewalk requirements, previous
legal dispute with developer, the validity of the 2017 stormwater agreement,
whether the additional drainage pond requires an HOA for maintenance
and the maintenance requirements specified in the ordinance, other
developments have HOA's to maintain drainage ponds, staff's requests and
requirements for information were not unusual, the resolution, flooding of
houses if the regional pond overflows and regional pond maintenance.
Mark Thieroff, attorney for the developer, indicated that if requested from
the City, an extension would be granted, acknowledgement of the late
submission of required documents, not opposed to additional drainage pond
but opposed the HOA requirement and requested that Resolution Condition
1B regarding the drainage pond be removed.
Vaughan, Braucks to approve as presented.
Council discussion that the City must adhere to stormwater rules
determined by the State, the one-year time limit listed in the resolution for
the submittal of a stormwater plan, the approved resolution can be amended
if a submitted plan using the regional pond was approved by staff.

Announcements
• May is National Building Safety Month. This is Municipal Clerk Appreciation
Week. And next week is National Police Week. Please join me in a great and
heartfelt thank you to our employees in these departments. They provide essential
services and help ensure the safety of our community.
• Congratulations to Sadie Reiners who was recently awarded the Janet Loner United
States Tennis Association Junior Team Tennis National Organizer of the Year Award
for her work developing tennis opportunities for youth. Sadie Reiners founded the
Hastings National Junior Tennis & Learning Chapter which now has 80 participants
annually and fields 7-10 teams each year.
• The inaugural Eagle Watch Bike Tour is a family-friendly bike event on the Point
Douglas Trail between Hastings and Prescott. Enjoy biking this 3 �/z mile trail,
spotting bald eagles, and exploring two historic downtowns on Saturday, May 8.
• On Wednesday, May 12,the Hastings Police and Fire Departments will hold a Public
Safety Night downtown from 5:00 to 7:30. The event will have public safety
displays, including fire equipment and police K-9.
• Volunteer with the Hastings Parks &Recreation Department to plant a tree in
celebration of Arbor Day on Friday, May 14, at CP Adams Park.
