Regular Meeting
7:00 pm
Vice Chair Greil called the meeting to order at 7:00 pm.
1. Roll Call
Commissioners Present: Alongi, Greil, Hollenbeck, and Twedt.
Commissioners Absent: Anderson, Schmitt, and Truax
Staff Present: Planning Director John Hinzman, Associate Planner Kris Jenson.
2. Approve August 11, 2003 Planning Commission Minutes
Motion by Commissioner Alongi, seconded by Twedt to approve the minutes of the
August 11, 2003 Planning Commission as presented by staff. Motion passed
unanimously.
Because Commissioner Alongi may need to leave early, Vice Chair Greil stated that Item #4
will be reviewed first, with Item #3 to follow.
Biermaier, Phill & Jen - Site Plan #2003-61 Expansion of Outdoor Dining Area at
Papa Charritos - 350 33rd Street West.
Director Hinzman presented background information on the request.
Commissioner Alongi inquired as to a definition of a dry bar.
Jen Biermaier, applicant, stated that all alcohol would be brought back into the building for
storage at night, so there's no beer taps at the outdoor bar and the like.
Commissioner Alongi inquired if there had been any comments from the neighboring hotel
with concerns regarding noise.
Director Hinzman stated that a sign was placed on the site notifying the public of a land use
action, and not comments have been received. Also, the patio expansion is on the west side
of the building, and the hotel is to the east of the restaurant.
Planning Commission Action:
Commissioner Alongi moved and Commissioner Hollenbeck seconded a motion to
approve an expansion of the outdoor dining area site plan review for Papa Charritos
at 350 33rd Street West, to the City Council with the following conditions:
1) Adherence to the Plans as presented to the City Council.
2)
All disturbed areas on this property shall be stabilized with rooting vegetative cover
to eliminate erosion problems.
3)
The disturbed areas of the site shall be maintained to the requirements of the City's
property maintenance ordinance.
4)
Final approval of the plans by the Public Works Department. The applicant shall be
liable for any costs involved in consultant review of the plans.
5)
In areas of bituminous removal, concrete curbing shall be incorporated to separate
the parking lot from the outdoor dining area.
6) The sizes, species, and method of installation for all landscaping must be identified.
7)
Any uncompleted site work (including landscaping) must be escrowed at 125 percent
of the estimated value prior to issuance of a certificate of occupancy.
8)
Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to
issuance of certificate of occupancy.
9)
Approval is subject to a one year Sunset Clause; if significant progress is not made
towards construction of the proposal within one year of City Council approval, the
approval is null and void
Upon vote taken: Ayes: 4, Nays: 0. Motion passed.
Robinson, Ed - Comprehensive Plan Amendment, Rezoning, and Minor
Subdivision #2003-57 - Comp Plan Amendment from C. Commercial to U-II, Urban
Residential (4-8 units per acre); Rezone property from C-3, Community Regional
Commerce to R-3, Medium-High Density Residence; and subdivide a single family
home lot adjacent to Sibley Street - 1225 Vermillion Street.
Planner Jenson presented background information on the request.
Vice Chair Greil opened the Public Hearing at 7:08 pm. Hearing no comments, the public
hearing was closed at 7:09 pm.
Commissioner Twedt stated that it appeared that there was a well/cistern on the site and he
asked what may need to be done with it.
Director Hinzman stated that the possibility can be investigated, but generally that wells may
be maintained for irrigation purposes. Any home built on the site will be required to connect
to City water and sewer services.
Planner Jenson added that the well, if one exists, would need to be registered with Dakota
County.
Commissioner Alongi noted that there wasn't a condition for the addition of the fence.
Planner Jenson stated that one would be added.
Planning Commission Action:
Commissioner Twedt moved and Commissioner Alongi seconded a motion to
approve the Comprehensive Plan Amendment, Rezoning, and Minor Subdivision for
property adjacent to Sibley Street and a part of 1225 Vermillion Street, with the
following conditions:
1) Met Council approval of the Comprehensive Plan Amendment.
2)
That the survey be revised to eliminate the encroachment of the fence and curb
and to show the drainage and utility easements.
3)
That a 6' high opaque fence be erected along the south property line of the new
lot to buffer the view from the future residence to the parking lot and commercial
area.
4)
That park dedication fees of $1800 and sewer interceptor fees of $325 be paid
prior to the release of the City Council resolution for recording.
5)
That any wells on the property be properly sealed or capped and registered with
Dakota County.
6)
Approval is subject to a one year Sunset Clause; if significant progress is not
made towards construction of the proposal within one year of City Council
approval, the approval is null and void.
Upon vote taken: Ayes: 4, Nays: 0. Motion passed.
5. Other Business
No other business was discussed.
