Regular Meeting

Commissioner Hollenbeck called the meeting to order at 7:04 pm.
1. Roll Call
Commissioners Present: Alongi, Hollenbeck, Schmitt, and Truax.
Commissioners Absent: Anderson, Greil, Twedt
Staff Present: Planning Director John Hinzman, Associate Planner Kris Jenson.
2. Approve July 14, 2003 Planning Commission Minutes
Motion by Commissioner Hollenbeck, seconded by Truax to approve the minutes of
the July 14, 2003 Planning Commission as presented by staff. Motion passed
unanimously.
Greenlawn Underground Sprinklers - Site Plan #2003-52 - Construction of a
second building - 2250 Millard Avenue.
Director Hinzman presented background information on the request.
Commissioner Alongi asked if a condition was necessary due to the lack of maintenance
currently at the site.
Director Hinzman stated that a condition wasn't necessary, he was simply trying to gain the
compliance of the applicants.
Commissioner Schmitt asked for clarification on the number of parking spaces at the site.
A representative of Greenlawn stated that the addition of the second building and parking
areas would bring the site up to where it needed to be in terms of parking.
Director Hinzman concurred with that assessment.
Commissioner Truax asked if a condition was necessary for the inclusion of comments from
BDM.
Director Hinzman stated that condition #4 reflected the inclusion of comments from BDM.
Commissioner Alongi added that one of the conditions prior to moving forward to the City
Council was modification of plans per BDM's comments.
Planning Commission Action:
Commissioner Alongi moved and Commissioner Schmitt seconded a motion to
recommend approval of the site plan for a Greenlawn Underground Sprinklers second
building at 2250 Millard Avenue to the City Council, based on the following:
The following must be addressed prior to review by the City Council:
1)
The applicant shall incorporate the comments of the July 25, 2003 Review Letter
from John Stewart of BDM Engineering into revised plans prior to placing the site
plan request on the City Council Agenda.
2)
The location and exterior elevations for a waste enclosure building must be
submitted.
3)
All revisions must include 5 full size and 10 reduced size LEGIBLE copies. Revisions
must be received by the Planning Department no later than 10 days (typically a
Friday) prior to City Council Action.
RECOM MENDED ACTION
Approval of the Site Plan is recommended subject to the following:
1)
Adherence to the Site Plan, Landscape Plan, and Architectural Elevations as
presented to the City Council.
2)
All disturbed areas on this property shall be stabilized with rooting vegetative cover
to eliminate erosion problems.
3)
The disturbed areas of the site shall be maintained to the requirements of the City's
property maintenance ordinance.
4)
Final approval of the development grading and utility plans by the City of Hastings.
The applicant shall be liable for any costs involved in consultant review of the plans.
5)
All rooftop equipment shall be screened by a parapet wall from areas facing a public
right-of-way, and painted to match the building elsewhere.
6)
All waste enclosures shall be enclosed on all four sides to fully screen the contents,
and constructed with exterior materials to match the primary building.
7)
All parking and drive aisle areas shall be constructed to city standards including
concrete curb and bituminous surfacing.
8)
Shrub plantings must be incorporated between the southern parking lot and southern
property line. Shrub plantings must be planted at a density great enough to shield
headlight views.
9)
Spruce tree plantings must be continued along the north property line to the
northwest corner at similar spacings of existing trees.
10) The sizes, species, and method of installation for all landscaping must be identified.
11) All landscaped areas must be irrigated.
12)
A photometric plan for any parking lot lighting must be submitted for approval by the
Planning Director prior to installation.
13)
Any uncompleted site work (including landscaping) must be escrowed at 125 percent
of the estimated value prior to issuance of a certificate of occupancy.
14)
Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to
issuance of certificate of occupancy.
15)
Approval is subject to a one year Sunset Clause; if significant progress is not made
towards construction of the proposal within one year of City Council approval, the
approval is null and void
Upon vote taken: Ayes: 4, Nays: 0. Motion passed.
Hastings Public Schools - Site Plan #2003-53 - McAuliffe Elementary School -
Construction of an access road to South Frontage Road.
Planner Jenson provided background information on the item.
Commissioner Alongi asked if the new access road would be signed for busses only.
Planner Jenson responded that while no specific signs were indicated on the plans, but the
plans and information from the school district indicated that the access would be for bus
traffic only, so Staff imagines that the access will be signed to indicate that.
Commissioner Alongi asked if perhaps having the intersection offset wouldn't be a better
idea since no traffic would actually be crossing South Frontage Road between the school
access and the Target access.
Planner Jenson replied that even if there is no cross traffic there will be vehicles making
right and left turns from each access and if the accesses are offset, that turning traffic may
interfere with each other. The safest intersection is one that lines up directly to minimize
conflicts in vehicle motion.
Commissioner Schmitt added that it appeared the access road could be shifted to line up
the entrances and still allow a buffer between the proposed soccer fields and the access
road.
Planning Commission Action:
Commissioner Truax moved and Commissioner Alongi seconded a motion to approve
the site plan for an access road addition between Christa McAuliffe Elementary
School and South Frontage Road to the City Council, subject to the following
conditions:

Adherence to the plans submitted as part of City Council approval. The site plan
shall be modified so that the access road lines up with the Target driveway across
the street.

Any future plans to illuminate the parking lot will require a photometric lighting plan to
be submitted showing foot candle illumination of the property. Illumination levels are
limited to 0.5 foot candles at the property line as required in the Zoning Code.
Landscaping Plan shall be modified to include landscaping to block headlights into
the Marketplace townhomes, and submitted for review and approval by the City
Forester and Planning Director.

issuance of certificate of occupancy.

City of Hastings - City Code Amendment #2003-46 - Neighborhood Commercial
Uses in Residential Districts.
Director Hinzman presented background information on the project.
Commissioner Schmitt asked what the residential requirements were, and was there any
limit on the number of neighborhood commercial uses in an area.
Commissioner Alongi added that he was not in favor of adding regulations that would be
extremely difficult to enforce.
Director Hinzman added that there wasn't a mechanism to limit the number in an area, but
since they would all need to have a special use permit, that would give the Planning
Commission and City Council some control on the number allowed.
Commissioner Truax asked why the language did not include the R-4 district.
Director Hinzman stated that the way the code is written, what is allowed in the R-3 district is
allowed in the R-4 district.
Commissioner Hollenbeck stated that she was in favor of the language revisions as it will
maintain residential areas while allowing some appropriate commercial uses.
Planning Commission Action:
Commissioner Truax moved and Commissioner Alongi seconded a motion to recommend
approval of draft ordinance amendment to sections 10.13 - 10.17 to the City Council.

6. Other Business
Director Hinzman updated the Commission on projects previously reviewed by the Planning
Commission, as well as potential projects for the upcoming meeting.
Commissioner Alongi inquired as to when the rezoning for the Downtown Master Plan would
be brought forward.
Director Hinzman stated that the Rivertown Newsletter would be published in August, and
that an article will be included about the rezoning. Notices and hearings would be sent and
held in September.

AN ORDINANCE OF THE CITY OF HASTINGS, MINNESOTA AMENDING CHAPTER 10,
SECTION 10.13 - 10.17 OF THE HASTINGS CITY CODE PERTAINING TO:
NEIGHBORHOOD COMMERCIAL USES
BE IT ORDAINED by the City Council of the City of Hastings as follows:
Chapter 10 of the Hastings City code is amended as follows:
SECTION 10.13. R-2 - MEDIUM DENSITY RESIDENCE.
SUBD. 3. USES BY SPECIAL PERMIT.
b) Neighborhood Commercial subject to the site plan requirements of Section 10.27, and the
followin.q provisions:
(1) Any business related activity occurrinq on the premises shall not cause any adverse
chan.qes to the residential character of the nei.qhborhood.
(2) Adherence to the minimum parkin.q standards of Section 10.09.
(3) The operation of any retail business, unless it is conducted entirely by mail, is
prohibited. On-site sales shall be limited to those clearly incidental to services
provided in the dwellinq.
(4) Operation of any business shall be in conformance to the residential character of the
nei.qhborhood.
(5) Location of the property shall be considered. Properties not frontinq on a major
roadway or adjacent to a commercial zonin.q district may be unsuitable for operation
of a nei.qhborhood commercial uses.
(6) Any exterior chanqes necessary to conduct the business shall be sufficiently
screened, properly desi.qned, or separated by distance so as to be consistent with
existinq adjacent residential uses and compatible with the residential nature of the
nei.qhborhood.
(7) Shipment and delivery of products, merchandise, or supplies shall be limited to
between 7:00 a.m. and 6:00 p.m. and shall occur only in sin.qle rear axle straiqht-
trucks or smaller vehicles normally used to serve residential neiqhborhoods.
(8) Any interior chanqes necessary to conduct the business shall comply with all
buildin.q, electrical, mechanical, and fire codes .qovernin.q the use in a residential
occupancy.
(9) Si.qna.qe may consist of not more than one sin.qle faced unli.qhted wall si.qn per home
with a maximum area of two square feet.
(10)The conduct of the business shall not .qenerate noise, .qlare, vibrations, fumes, odors,
or electrical interference detectable to normal senses outside of the dwellin.q unit. In
the case of electrical interference, no equipment or process shall be used which
creates visual or audible interference in any radio or television.
(11)No traffic shall be .qenerated by such business in .qreater volumes than would
normally be expected in a residential neiqhborhood. The home occupation shall not
increase parkin.q requirements by more than four additional parkin.q spaces at any
.qiven time in addition to the parkin.q spaces required by the occupants. Any need for
parking generated by the conduct of the home occupation shall be met off of the
street.
(12)No business shall be allowed which ieopardizes the health and safety of city
residents.
(13)The Fire Marshal may conduct a fire safety inspection of the space proposed to be
used for the home occupation. Occupancy shall meet all applicable fire codes prior to
opening for business as well as thereafter.
