Members Present: Linde, Peterson, Kramer, Stoffel, Latch, Stark, Fischer, Wendler, and Walker Approved by Commissioner Linde, seconded by Commissioner Fischer to approve the Minutes of the November 8, 1976 Planning Commission Meeting. 9 AMes - 0 Nayes. APPROVAL OF MINUTES; Commissioner Kramer expressed his concern to the Planning Commission regarding the involvement of other governrnental agencies in the request to rezone 80 acres north of the County Court House from agriculture to an R-4 District. The City has been contacted by Nininger Township, Dakota County and the M{nnesota State Historical Society, vcho o's, ns a cemetery north of the proposed rezon[ng. Tv¢o of the three agencies-~have_ indicated a negative reaction to the proposal by Mr. Espeseth. At the Public Hearing, it yeas asked that anyone vcho objected to the rezoning should give specifics as to why they felt the rezoning yeas inappropriate for the area suggested. Commissioner Kramer indicated to the Planning Corrm'~isskon that he ',vas not aware of any petitions which have been received meeting the criteria he specified previously. ZONING AMENDMENT - RODGER ESPESE TH WEST 4TH STREET Corrunissioner Walker indicated that the Comprehensive Plan has designated this area for residential development and there is the need for the City to provide more Mobile Ho n~ sites. This site offers the advantages of having public utilities available and yet very little surrounding development. Commissioner Latch expressed concern about putting all higher density residential development in one area. At the present time, the immediate vicinity ha~s tovcnhouses and apartments,and with this additional high density development, future traffic problems could occur. Moved by Commissioner Kramer, seconded by Cornrnissioner WaLker to recommend to the Council that the property included in the Espeseth request be rezoned from Agriculture to R - 4. 7 Ayes; Latch and Stoffel-lNay. planning Commission Meet[n~ _N, ovember ZZ, 1976 The Commission indicated this motion was passed on the assumption that the Mobile Home Ordinance ~vill be modified so that Mobile Home Parks will be a special use in an R-4 Zoning District as per the recommended ordinance. The Planning Director reviewed the proposed ordinance for Mobile Home Parks dated 10/22/76. The Commission agreed to amend the following sections of the proposed ordinance: E "...no Mobile Home shall occupy more than 20-25% of a lot..." 3J (3) "... the park shall comply with this chapter by' within six months of passage by the City Council..." JJ (4) Eliminate this section 3J (5) "... Any existin~ Mobile Home Park will be rezoned to an R-4 zonir{g_c~assif[cation. Moved by Commissioner ]Fischer, seconded by Commissioner V~ralker to approve the Mobile Home Ordinance modification as amended. 9 Ayes ,- 0 Nays. The Planning Director informed the Commission that at the next meeting, the Midtown Redevelopment proposal %vill be discussed. By law the Planning Commission must comment on any redevelopment plan. The planner indicated that the HRA was hopeful that the Council .would have an opportunity to create the district prior to the end of the year and in order to do so the Planning Commission must review, and submit their 'comments to the Council the conclusion of their next meeting. The Comrn[ssion asked that a previous staff report on Midtoavn be forwarded to the Commission for them toreview. Commissioner Kramer left the Council Chambers at 9:47 ; Two representatives of Midcontinent Cooperation were in the audi~nce and they requested that the planning Commission approve their application for a footing and foundat[onpermit prior to compliance ~ith all the requirements listed in the Site Plan Review Pro- cedure. The developer fndicated that they ~ere a~ious to start their work prior to bad weather. MOBILE HOME PARK ORDINANCE MIDTOWN REDEVELOP- MENT PLAN SITE PLAN REVIEW WESTVtEW APARTMENTS MIDCONTINENT CORP. WESTVIEW DRIVE -3- Planning C0mm[sai0n M0ofin :~ovem~er 22, Moved by Commissioner Fischer and seconded by Commissioner Wendler that approval be given for a footing and foundation permit with the following conditions: I) No additional construction will be allowed until items Z-4-6and 7 on Site Plan Review Procedure form have been completed. Z) Necessary documentation must be supplied indicating that all of Lot A will be platted and it should be understood that no variances will be granted for any development now or in the future. 3) The developer 'should work on a long range drainage plan for the site with the City Engineer~ 8 Ayes 0 Nays The Planning Commission expressed concern that de- velopment has occurred and lots have been created that do not conform to the City's Zoning Ordinance. The Planning Director explained that the County accept any land transfers without consulting with the municipality involved to insure that the subdivision conforms to local re gul ations. Moved by Commissioner Fischer, seconded by Commissiomer Linde to send a letter to the County, Metropolitan Council and other organizations such as the Minnesota Planning Association about the need to guarantee that. platting requirements c~nnot be Circumvented by simply filing a deed with the county.
