HomeMy WebLinkAbout10/25/76PLANNING COMMISSION MINUTES OCTOBER g5, 1976 7:30 P.M. The meeting was called to order at 7:35 P.M. by Assistant Chairman Stoffel. Members Present: Stoffel, Fischer, Kramer, Stark, Peterson, and Starry Members Absent: Latch and Walker Student Member Present: Stoneberg Commissioner Linde indicated that the Minutes on the public hearing for the rezoning of Blocks 130, 134 and 135 indicated that the property was to be rezoned to Industrial. The Minutes should read that it is to be rezoned to residential property. APPROVAL OF MINUTES Moved by Commissioner Stark, seconded by Commissioner Kramer to approve the Minutes of the October 13, 1976 Planning Commission meeting as amended. 8 Ayes - 0 Nayes. Commissioner Fischer reviewed his report with the Committee. The report indicated that the rezoning request is valid due to the underutilization of the present industrial park and the need to encourage development in our new industrial area. Also the area in question, with the exception of the storage tanks on Eigh~Street , is generally residential in nature. Finally, if rezoning is not instituted, there will be general deterioration of the existing residential structures in that area due to the limitations of non conforming uses. ZONING AMENDMENT BLOCKS 130, 134 AND 135 TOWN OF HASTINGS Mayor Walter Petersen requested that this matter be referred to the Industrial Commission for their corru'nents. The matter was referred back to the Fischer Committee for further study. Commissioner Fischer indicated that he would check with the Industrial Committee and the staff wQuld have to check to see whether or not the storage tanks on 8th Street by the railroad tracks will be used and if so what the lif~expectancy of the storage tanks might be. Commissioner Stark reviewed his Committee report which indicated general agreement with the proposal. The Planning Cornrnission agreed to the following modifications of the Stark Committee recommendation. Item No. 6 of the memo was revised to read as follows: Park Donation - Land Versus Money - was referred to the Natural Resources Commission and they PRELIMINARY PLAT FRANZMEIER - ZZND PINE STREET Planning Commission Minutes -2- October 25, 1976 (Continued) have indicated to the City Planner that monies were preferred to land. If this is accepted, then we would like to recommend to the City Council that any future money acquired for park donation in this area be designated for park development within the respective neighborhood. Item No. 8 of the memo was changed to read as follows: Assessment - It was intended that no surrounding property owners would be assessed for any cost pertaining to the two additions for the development of the retention area. Commissioner Stark indicated that he was still hearing concerns expressed about the need for the retention basin. Commissioner Stark felt that the staff go on record indicating that there was no other alternative to what has been proposed. The Planning Director indicated that at this time the Engineering Department has not found any other feasible alternative for handling the drainage in the area. Moved by Commissioner Fischer, seconded by Commissioner Kramer to accept the Committee's report as amended in conjunction with the staff memo and forward its recommendation on to the City Council. 6 Ayes - ~ Nayes. The Kramer Committee' recommended to the Planning Commission that a public hearing for rezoning Mr. Espeseth's property be scheduled. Due to the need for the City to provide low cost housing and for the City to find an appropriate place for such housing, a public hearing was scheduled for November 8, 1976 to rezone Section zg, Township 115, Range 17, The north 1/g of the NW 1/4 of Section Z9, Except g acres allocated for 4th Street from Agriculture to R-4. MOBILE HOME PARK PROPOSAL- RODGER ESPESETH - WEST 4TH ST. Moved by Commissioner Fischer, seconded by Commissioner Stark to call the public hearing for November 8, 1976 at 7:30 P.M. 6 Ayes - 0 Nayes. This matter was referred by Acting Chairman Stoffel to the Kramer Committee. MOBILE HOME PARK PROPOSAL- WILLIS OLSON 160TH STREET Kerr McGee Oil Company has submitted a request for a variance to allow the construction of a new sign to exceed the height requirement by 3 1/Z feet. The petitioner claimed that the additional height would avoid any possibility of trucks damaging the new sign. The Planning Commission suggested that some bumper posts could be constructed to avoid such a problem and this was not grounds for a variance. VARIANCE - KERR MCGEE 1610 VERMILLION ST. Planning Commission Minutes -3- October 25, 1976 (Continued) Moved by Commissioner Fischer, seconded by Commissioner Peterson to deny the variance due to the fact that there was no hardship. 6 Ayes - 0 Nayes. The Commission asked that the Committee's recommendation regarding revisions to the mobile home park ordinance be placed on the next Planning Commission agenda. The Planning Director explained that Pizza Hut had met on several occasions ~vith the City staff regarding their request for a site plan approval. The Planning Director indicated that all problems had been resolved between the petitioner and the City staff except there had not been sufficient time to incorporate these changes into a new set of drawings. The staff recommended that a permit be issued for footings and foundation to allow Pizza Hut to at least complete that portion of their construction, and any additional building permit will be subject to approval of the Planning Commission of the final set of drawings. MOBILE HOME PARK ORDINANCE SITE PLAN REVIEW PIZZA HUT - 1330 SOUTH FRONTAGE ROAD Moved by Commission Fischer, seconded by Commissioner Linde to approve a footing and foundation permit for Pizza Hut. 5 :Ayes, 0 Nayes, Kramer abstained. Moved by Commissioner Fischer, seconded by Commissioner Linde to recommend that a variance be granted to Mr. Nick Freiermuthpredicated on the petitioner submitting an application for a variance with the variance being granted on the grounds that there is the need to amend footnote 'g' on page 50 of the City zoning code. 5 Ayes - Kramer, Nay. VARIANCE - NICK FREIERMUTH - 1821 MANOR LANE The Planning Director informed the Commission that ADDITION TO WESTVIEW he had received insufficient plans from Mid Continent APARTMENT COMPLEX Developers to add on to the Westview apartment complex. The information was not sufficient to grant site plan approval and recorn/-nended that they follow normal procedures. The Planning Commission agreed with the approach suggested by the Planning Director. Moved by Commissioner Fischer, seconded by Commissioner Linde to adjourn at 8 P.M. 6 Ayes - 0 Nayes. ADJOURNMENT
