MONDAY, JULY 26, 1976

The meeting was called to order at 8:01 P,M. b y Assistant Cbai, rman Stoffel.
Members Present: Sto£[el, Lind'e, Walker, ]Fischer, and Peterson
Members Absent: Kramer, Latch, Stark and Gle~uie
Student Member Present: Theresa Kusske
Commissioner Fischer indicated that the ~inutcs state AP}°ROVAL OF MINUTES
that the Peavey property should be rez oned from R-i to
R-Z where in fact it should be 1-1 to I-Z. Moved by
Cornrnissioner Fischer, seconded by Commissioner
Linde to approve the Minutes as amended. 5 Ayes - 0 Nayes.
The Stark Committee report was presented to the
Planning Commission indicating that a rezoning from
C-3 to R-Z and the grantLug of a special use permit
to allow a duplex on Lot 1, Block 38 of the Town of
Hastings would be appropriate.
ZONING AMENDMENT &
SPECiAL USE PERMIT

A public hearing for the rezoning and special use permit
was set for August 9, 1976 at 7:30 P.M.
Moved by Commissioner Fischer, seconded by
Commissioner Walker to refer to the Counci: [ for a
first reading on the rezoning of Lot i, Block 38, Town
of Hastings with a final recommendation from the Planning
Commission forthcoming after the public hearing. 5 Ayes - 0 Nayes.
Chairman Glennie's Sub-Committee report was HOME OCCUPATION
reviewed by the pl~u,~ing Commission. The Cornrnittee PERMIT - RICHARD
inspected the locksmith business operated by A/Ir. TIBBITS - 1208 SIBLEY ST.
Tibbits and noted that the business does not generate much
traffic, and does not exceed the 25% of the traffic flow
area limitation, and does have an off-street parking space.
Moved by Commissioner Walker, seconded by Cornrnissioner
Linde tm accept the Cemmittee report and recommend the issuance
of the home occupation permit. 5 Ayes - 0 Nayes.
The proposal submitted by Country Kitchen o( Hastings
meets all the City zoning requirements. The Planning
Director indicated that the Staff recommended approval
of the request subject t'o the following conditions:

1. Du~ to the excessive slope along the north property
line ( 2 1/Z to 1 ), the developer must agree to take the

2. All roof top mechanical equipment must be screened.
The City shall receive written assurance from Industrial
Builders that the property north of the South Service
Drive will be replatted as is required by state and local
laws.
The owners of the project will submit a statement prior to
obtaining a building permit indicating that they will c~nstruct
all improvements indicated on the site plan received on July
21, 1976 as well as additional improvements designated by
the Planning Commission. If unforseen circumstances prevent
the completion of improvements indicated on the site plan,
the owner and City will mutually agree upon an alternate
completion date.
5. Reexamine the landscaping plan by the driveways t® insure
the ma~te~a-~ce o[ a "clear vision area".

the five ce,,ditions stated in the memo of 3uly Z3, 1976 a~d
predicated mm the Plan~er resolving the platting problem with
the attorney. 5 Ayes - 0 Nayes.
The Plam~img Director informed the Pl~-ni,~g Commission SALE OF SOUTHWEST
that the Natural Resources Commission has recommended PONDING B~SIN PROPERT5
that the City should mot sell any of the Southwest Ponding
Basimproperty to Mr. Anderson on Zweber
M~ved by Corrwnissioner Walker, seconded by Commissioner
Lin~de that the Planning Cornraission recomraend to the Coua~cil
that they do m~t sell a~y of the Southwest Pomdi~g Basin property
tm Mr. ~dersel~. 5 Ayes - 0 Nayes.
The Pla~img C.rarnission selected Mr. Fischer to
work with the c.rnrnittee responsible f®r rewriting
the Cityts ordinances.
