Members present: Linde, Peterson, Kramer, Stoffel, Latch, Stark, Glennie,
Fischer, and Walker
Student Members Present: None
The meeting was called to order at 7:34 P.M. by Chairman Glermie.
The Planning Commission asked that the motion on APPROVAL OF MINUTES
the John 2knderson request for Home Occ}lpation be
modified to reflect that the Commission accepted the
Connrnittee report to deny the request for a home occupation
permit. Also the request for a variance by the Peavey Company
was referred to the Fischer Committee and Mr. Walker was
asked to work with the Fischer Committee on the matter.
Moved by Commissioner Stoffel, seconded by Comxnissiener
Fischer to approve tl~ Mim%xtes as abael~ded. Nine ayes,
zero nays.
The Public Hearing was opened at 7:40 P.M. by
Chairman Giermie. The Planning Director made
reference to the Affidavit of Publication and informed
the Commission that the Public Hearing had been
properly called. Mr. Willard Bauer was in attendance
and indicated that he felt that the ordinance which will
require a ten to twenty percent land or cash in lieu of land
dedication for park purposes when residential property is
platted will place a burden on a developer. The Planning
Director told Mr. Bauer that the reason most communities
have an ordinance similar to the one that was being discussed
by the Planning Cornxnission is to avoid the need for existing
residents to pay for park property and equipment needs of the
new residents. With this ordinance the new residents are
responsible for paying for the recreational areas and equip-
me~t that they will ase.

PARK DEDICATION
ORDINANCE
After all people present were afforded an opportunity to be
heard, the Public Hearing was closed at 7:47P.M.
Moved by Commissioner Fischer, seconded by Commiss loner
Stark to recommend to the Council that the attached ordinance be
implemented, and that the Council be informed of the Public
Hearing held by the Planning Commission. Nine ayes, zero nays.

The Peavey Company has requested a variance from
the front yard setback requirements to allow for the
construction of their building 1 foot 5-1/2 inches from
the right-of-way at one point and 4 inches at another.
The new construction will not be any cl~)ser to the
right-of-way than the existing building.
The Pischer Committee report indicated the followimg:
1. "A traffic hazard area at the north end of
Vermillion/Hwy. 61beidge will be minimized by
the change in mill loading/unloading areas?.
2. "The new structure will be more aesthetically
pleasing than the existing structures".
3. "The request will not adversely affect ni~ighboring
property or the City of Hastings".
Moved by Commissioner Fischer, seconded by
Commissioner Walker tO approve the variance requested by
the Peavey Mill and request that the Staff notify
adjacent property owners before the Council meeting
on July 19, [976. Nine ayes, zero nays.
Moved by Commissioner Pischer, seconded by
Commissioner Steffel to rec®mmend the rez®ning
of the Peavey property frem I{-1 te R-Z pending
any information from the Staff which would be contradictery
to the information presently available. The motion
was withdrawn.

regarding the appropriateness of rezoning the Peavey
p(~operty and this work should be assisted by a
Plan.nkng Commission Committee. Nine ayes, zero
nays. The matter was referred back ti) the Pischer
Committee by Chairman G[ennie.
Mr Gydesen has submitted an application to rezone
Lot 1, ]Block 36, Town of Hastings from C-3 to
R-Z. 'rhe request involves a special use permit to
allow a duplex to be constructed in the proposed
R-Z zoning district. Chairman Glennie referred the
matter to the Stark Committee with Commissioner
Fischer taking Comrnissioner Stark's place in
absence.

Moved by Gommissioner Kramer, seconded by
Commissioner Fischer to forward to the Natural
Resources Commission for their opinion the matter
of selling property which is part of the Southwest
Ponding tSasin and tabling ~him .item until a response is
received from the Natural Resources Commission.
Nine ayes, zero nays.
SALE OF LAND SOUTH-
WEST PONDiNG BASIN
The Planning Director informed the Commission that
a motio~had been approved at the last Council
meeting asking the Planning Commission to investigate
the possibility of rezoning Country Village Estates
and the unplatted property south which is bordered by
Pleasant on the west, Z3rd Street on the north, and the
Vermillion River on the south. The request involves
rezoning the property fTOm R-3 to R-1.

Willard Bauer indicated to the Planning Commission that
he owned the property south of Z3rd Street and he assured
the Planning Commission that whatever is developed on
the property will be a quality project. He also indicated to
the Planning Conlrnission that he wanted the property to
maintain its present R-3 zoning classification.
Chairman Glennie referred the item to the Kramer
Cornnaittee for further study.
Chairman Glennie designated hemself, Dick Walker,
and Ed Fischer as the official representatives to the
Minnesota Planning Association.

The Planning Director indicated that an application HOME OCCUPATION
for a home occupation permit had been received from RICHARD TIBBITS
Mr. Richard Tibbits, a locksmith, and suggested that
the matter be referred to a cornrnittee for study. Chairman
Glennie referred the item to a special committee
consisting of Commissioner Linde, ]Aralker and Chairman
Glennie.
The Planning Director informed the Commission of
violations which have resutled from Polka Dot and
the Co-Op Creamery not complying with the site pla.ns
which were approved by the Planning Commission.
Several examples were cited of individuals which have
failed to comply with approved site plans and the
Planning Director recommended to the Cornrnission that
the necessary enforcement procedures be taken to
bring about compliance with the City's zoning ordinance.

Moved by Corm_missioner Fischer, seconded by
Commissioner Walker to have the Planning Commission
go on record favoring enforcement of the CltyZs zoning
ordinance and ask the Council to instruct the City St~aff
to follow up on recent discrepencies between approved
site plans and actual development. Iq[ne ayes, zero nays.

Commissioner Latch to adjourn at 9:28 P.M.'
