The r~xeeting was called to order at 7:34 P.M. by Chairman Stoffe[.
Members present: Chairman Stoffel, Stark, Fischer, Trautmann, Linde,
Latch, Glermie, WMker arrived at 9:15 P.M.
Moved by Commissioner Fischer, seconded by
Commissioner Trautnxann to approve the minutes
of the October 27, 1975 Planning Commission. 7

APPROVAL OF MINUTES
At 7:35 P.M. the Public Hearing was called to order
by GhairmanStoffe[. The Plarming Director fnformed
the PIanning Gornmlssion that the Hearing was
properly called by referring to the AffaOivit of
Publication and the Notice of Public Hearing and the
Certificate of Mailing.
PUBLIC HEARING
REZONING - RED OWL
lNG. - 802-814 PiNE ST.
The Planning Directorreviewed for the Planning
Commission and the audience the staff memo of October
10th which recommends that the petition for rezoning from
an R-i and R-2 zone to a G-2 zone be denied, on the
grounds that it does not conform to the City's Comprehensive
Plan, it would lead to strip commercial deveIopment, it
would constitute a spot rezoning, and it would necessitate
the upgradingaf the Pine Street and Hwy. 55 intersection.
Mr. Lowell Wagner, representing the Red Owl Store reviewed
the process that Red Owl has been going through for the
last few years in an attempt to find a location for a new
grocery store. Mr. Wagner indicated that sLnce the growth
area in the City is to the southwest Red Owl felt that it was
important to locate south of Hwy. 55 and west of Vermillion
Street.
Chairman StoffeI opened the meetkng to the floor and the
following peopIe spoke in regards to the request by Red
Owl to rezone the property located at 802-814 Pine Street.

Red Owl should not be allowed to construct
their store at the proposed site because
it is [na residential area. Contrary to
Red Owl's research which indicates that
a store must be located [n the southwest
quadrant of the City, the people would be
wilIing to shop at Red Owl anywhere ha
the City as long as they provide the
best buys. Ape[ilion was submitted with
twelve signatures, all opposed to the
location of the proposed Red Owl store.

Their home was purchased ina residential
area and they want the neighborhood to
remain residential. Allowing Red Owl to
have their property rezoned would set a
precedent for spot rezoning throughout the
City. The City of Hastings should not
allow a big corporation to dictate how the
[and in its City will be de~eloped.
The Highway 55 entrance to the City has
an aesthetic appeal which would be destroyed
if Red Owl were allowed to construct a store
at Pine and Hwy. 55.
Commercial development should be segregated
in certain parts of the City and should not be
allowed to occur in residential neighborhoods.
At the present time the Red Ow[ store lacks
sufficient space to display ali new merchandise
and unless the slore is allowed to construct
a new facility people will shop elsewhere. In
addition the Red Owl store will be able to hire
more people and expand its payroll with a
new store.
As the City grows it is important that we
provide areas for the growth to occur.

The question is not whether or not
we want a new.Red Owl store in town, but
rather whether this is the proper location
for such a facility.
After all people were afforded an opportunity to be heard
the Public Hearing was closed at 8:32 P.M. by Chairman
Stoffel.
Moved by Commissioner Trautmann, seconded by
Commissioner Stark to deny the request by Wagner
Realty, representing Red Ow[ Inc., to rezone from
R-[ and R-2 to C-2 property at 802-8[4 Pine Street
on grounds listed in the staff memo of October [0, [975.

At 8:45 P.M. Chairman Stoffel called to order the
Public Hearing regarding a special use permit for
a conversion of a single family home at 306 W. 5th
Street to a duplex. The Planning Director made
reference to the Affidavit o[ Publication, the Notice
of Public Hearing, and the Certificate of Mailing.

When no objections were heard from the audience
Chairman Stoffel closed the Public Hearing at
8:47 P. M.
Moved by Commissioner Fischer, seconded by
Commissioner Linde to approve the requedt for
a special use permit allowing a duplex at 306
W. 5th Street. 7 ayes, 0 hayes.
Commissioner Trautmann presented the Committee's
report indicating that since the buildings along
Vermillion Street were constructed prior to 1970
this property was at no time intended to meet
the parking requirements of the original buildings,
and therefore the site plan as proposed should
be approved.
The Planning Director pointed out to the Commission
that the zoning code states that "off street parking
spaces and loading spaces existing upon the
effective date of this chapter shah not be reduced
in number unless said number exceeds the
requirements setforth herein for a similar
new use." On these grounds the staff informed
the County that they would not be allowed to sell
off their parking lot because it was now meeting
their off street parking requirement needs.
Moved by Commissioner Trautmann, seconded by
Commissioner Latch to approve the site plan
submitted by Industrial Builders with the following
eleven conditi~-ts:
1. That the building should be designed so that
there is no rear to the building.
2. All roof top mechanical equipment should be
screened.
3. The Fire Chief shall change the fire zone
before a building permit is issued.
4. A plall indicating location and intensity of the
light shall be submitted to the staff before
approvel of a building permit.
5. Sod shall be planted in all areas designated for
yard purposes.
6. A drawing indicating e[evati®n shall be approved
by the City Engineer before a building permit
is issued.
7. No outdoor refuse storage will be allowed unless
it is screened.
8. The petitioner must submit aletter requesting
permission of the City to construct an alley on
the platted right-of-way and this must receive
approval from the City Council before a final

The developer must install blacktop curbs
in areas which w~re previously driveways.
A revised landscaping plan should be
submitted which indicates planting which will
be used to replace existing trees which have
been removed.
A variance should be granted from the required
parking spaces.
Moved by Commissioner Fischer, seconded by
Commissioner Walker to approve a permit for
the footing for the addition to Gregory's restaurant
based upon a final clarification with the remaining
items of concern on the site plan to be reviewed by
the City staff, and with the staff issuing a complete
permit unless there is some unresolved problems.

Moved by Commissioner Trautmarm, seconded by
Commissioner Fischer to send the request for
the construction of a new building to the Fischer
Committee. 8 ayes, 0 nayes.
The Planning Director described briefly the
purpose of the Mandatory Planning bill and
indicated that they would be kept abreast of
any changes that were made as the 1976
legislative session progressed.

Commissioner Stark to adjourn at 10:30 P. M.

Moved by Commissioner Glennie, seconded by
Commissioner Walker to approve a variance for the
Skelly gas station sign on the grounds that a hardship
exists due to the unusual width of the right-of-way
at that location. 8 Ayes - 0 Nayes.
