All members present: Student member present: Stoneberg Moved by Commissioner Kramer, seconded by Comm~.ssioner Stark to approve the Minutes of the October 14, 1975 meeting. 9 Ayes - 0 Nayes. APPROVAL OF MINUTES Moved by Commissioner Kramer, seconded by Commissioner Stark to refer the requested variance from the sign ordinance for Super Value and Skelly Service Station to the Kramer Committee for study. 9 Ayes - 0 Nayes. VARIANCES FROM THE SIGN ORDINANCE -SUPEt VALUE AND SKELLY SERVICE STATION Commissioner Fischer stated that they have held discussions with Mr. Wagner, who is representing the Red Owl Supermarket Company. Any other discussion was put off until the Noven2ber 10th lmeeting when a Public Hearing will be held and also Mr. Wagner will be in attendance. FISCHER COMMITTEE REPORT - REZONiNG FOR RED OWL The Public Hearing was opened at 7:45 P.M. by Chairman Stoffel. Tom Simmons, who was sitting in for the Plaiming Director, cited the Affidavit of Publication, the No~ice of Public Hearing, and the Certificate of Mailing and infornqed the Planning Coml~iss[on [hat the Public Hearing was property called. The Sub- Con~n~ittce report on the preIin~inary plat was presented which recommended that the Planning Commission approve the prel[n~inary plat as submitN-d with the folto~ving n~odif[cations which are addressed in the Planning Director's nqcn~o of October 9, 1975 and the Kranaer Con~lnlttee~s r~,port of October 22, 1975: PUBLIC HEARING ~ PRELIMINARY PLAT AL & LUCILLE SIEBEN - 18TH AND MANOR LANE A 15 foot ~,ascn2ent for walkv,,ay purposes should be indicated along the south side of Lots 9 through 13. BaNey Seida, representing the Siebens, stated that the Siebens would agree with the aforementioned modifications to the prelh-ninary plat~ After all people present were afforded ~an opportunity to be heard, the Public Hearing was closed at 8:03 1©.M. Moved by Commissioner Kramer. seconder~ by Commissioner Glennie to approve the preli~nainary plat with modifications as recom~ended by the Planning Commission Sub-Committee. 9 Ayes - 0 Nayes. There was a discussion as to whether the parking being proposed was or was not a duplication of existing parking for the buildings already in that area. The petitioner subn~itted a letter asking for permission to open the 20 foot alley in Block 89 on the south end ot l~ots 3 and 4. Moved by Comn~issioner Fischer, seconded by Cor~nnissioner Kran]er to schedule a Public ]tearing for Novernber 10, 1975 at 8 P.M. Before this mo~ion was ~nade, questions as to whether a Public Nearing was needed for a variance were asked. In checking with the City Attorney fo[lowing the meeting, it was learned that a Public Hearing was not needed for a variance, and it had not been the policy in the past to hold Public ttearings for variances. After this was l~,arned, Chaimnan Stoffel decided to delay publication of the Notice of Public Hearing since it was not needed.
