Members Present: Stoffel, Trautmarm, Latch, Stark,'Glennie, Walker, and Krame r Members Absent: Linde and Fischer Student Members Present: Stoneberg Student Members Absent: Humbert and Denn The minutes of April 14, 1975 should have indicated Stoneberg being the student member present, and Humbert was incorrectly identified as being present. On the motion regarding a variance request for Greg Langenfeld, Mr. Glennie rather than Mr. Stark should be identified as 9oting nay to the motion. Moved by Commissioner Latch, seconded by Commis'sioner Stark to approve the minutes as amended. Seven ayes, zero nays. APPROVAL OF MINUTES Moved by Commissioner Latch, seconded by Commissioner Stark to approve the request for a home occupation permit for a catering business, subject to the understanding by the petitioner that the approval pertains only to an office and that no cooking will be allowed in the home. Seven ayes, zero nays. HOME OCCUPATION PERM- IT - DIRK PETERSON - 1322 W. 16TH STREET Moved by Commissioner Latch, seconded by Commissioner Stark to approve the request for a home occupation permit for a catering business, subject to the understandfng by the petitioner that the approval pertains only to an office and that no cooking will be allowed in the home. Seven ayes, zero nays. HOME OCCUPATION - PERMIT - JOHN WILKUS - 934 W. 5TH STREET The Archdiocese of St. Paul - Minneapolis have submitted a proposal for an elderly housing project located on 5.9 acres of an ll. Z8 acre site. The petition requests that the property be rezoned from an R-1 zone to an R-4 zone. Although the Comprehensive Plan does not indicate specific areas for multiple family housing on the Comprehensive Plan map, the text does suggest that such items as access to arterial streets, its proximity to shopping facilities and park property, and the opinions of surrounding property own'ers REZONING - ARCHDIOCESE OF MINNEAPOLIS AND ST. Commissioner Kramer expressed a concern that although the Archdiocese of Minneapolis - St. Paul plan on using the structure for elderly housing, he had heard of situations where buildings similar to this have been 'used for low income. families when there were vacancies. Moved by Commissioner Kramer, seconded by Commissioner Glennie to call for a Public Hearing on May 1Z, 1975 at 7:30 P.M. to consider the rezoning of the petitioners property from R-1 to R-4. Seven ayes, zero nays. The Planning Director mentioned to the Planning Commission that he had received several complaints from members of the Council and Planning Commission that the present home occupation require- ments were not stringent enough. If this indeed is the concern of the Plannin8 Commission, the code should be interpreted as prohibiting any businessess which generate traffic or can not provide off street parking. If such an interpretation is made applications for such uses as beauty shops or photography studios would be denied. Moved by Commissioner Trautmann, seconded by Commissioner Stark to refer to the Kramer Committee the matter of home occupation permits and the two specific requests involving a photography studio and a beauty shop. Seven ayes, zero nays. The Planning Director informed the Planning Commission that a request has been made for a used car lot in a C-3 zone along Vermillion Street. The zoning code at the present time does not allow as either a permitted or special use, a used car dealer. The Planning Commission was asked whether or not they wanted to reconsider this position or simply deny this request since it does not comply with the present zoning code. Moved by Commissioner B[ramer, seconded by Commissioner Walker to refer to the Fischer Committee the matter of considering whether the City should allow used car dealers in a C~3 zoning district.
