Nine ayes, zero nays. Mr. Langenfeld submitted a petition for a variance from both the rear yard set back requirement in a G-3 zone and from the parking requirement for a restaurant. These variances would be needed for the construction of a 35~x 3S~ addition on the existing restaurant. The petitioner submitted documents indicating that he could use the parking facilities on adjacent land after 5:00 P.M. Despite the document that Mr. Langenfeld submitted the code requires a legal document agreement for the use of land not owned by the petitioner and this was not submitted. Since it is impossible to comply with the zoning code's parking requirement on the present restaurant site, the Planning Director recommended that the variances be denied.
