MONDAY, MARCH 17, 1975
The meeting was called to order at 7:38 P.M. by Chairman Linde.
Member8 present: Gomrniaaioner~ Trautmann, Kramer, Stoffel,
Walker, Stark arrived at 7:45 P.M.
Student Members Present: Stoneberg and Humbert

Moved by Commissioner Latch, seconded by Commissioner
Linde to approve the minutes of the March 10, [975 Planning
Commission meeting. Eight ayes, zero nays.
The Public Hearing was catied to order at 7:45 P.M. by
Chairman Stoffel. The Planning Director read into the
minutes the Notice of Public Hearing, the Certificate of
Mailing and the Affidavit of Publication. The Ptanning
Director reviewed the revised preliminary plat for
[5 lots which provides for a cut-de-sac referred to as
Manor Court and the ending oflSth Street at Manor Lane.
Mr. Mark Hop representing Haven Homes, property owners
north of the Franzmeier plat, stated that Haven Homes
had no objection to the preliminary plat as proposed conditioned
on the petitioner and themselves working out an agreement
regarding the easement for the north half of 18th Street.
After all people were given an opportunity to be heard the Public
Hearing was closed at 8:20 P.M.
Moved by Commissioner iKramer, seconded by Commissioner
Latch to approve the preliminary plat with the following conditions:
1. All utility easements should be identified as utility and
drainage easements.
Z. The easement along the north edge of the property
identified as a utility and drainage easement shoutd be
simply identified as a Public easement (motorized vehicles
prohibited except for a public vehicle), and should be 15 feet
in width.
3. The plat should include the south [/Z of 19th Street
with the assurance to the petitioner that including
this in the plat will not obligate him to pay for any
of the existing assessments for the street and utilities
on that portion of the right of way.

The Franzmeier's should negiotate with Reverend Fair
of Haven Homes regarding the Public easement for the
northerly portion of 18thStreet. If these negiotations
fail to produce a public easement for road and utility
purposes, the City should condemn the necessary
property for the extension of 18th Street.
The width of the proposed Manor Lane should be
indicated on the preliminary plat.
The elevations of the sewer inverts should be indicated.
Preliminary street grades and drainage should be
indicated.
Final plat approval should be conditioned upon payment
of all required platting fees.
At 8:25 P.M. Chairman Stoffel called to order the Public
Hearing regarding an office building and garage for Polka-
Dot Dairy, Inc. The Planning Director read into the record
the Notice of Public Hearing, the Certificate of Mailing,
and the Affadiv[t of Publication.
Concerns from neighboring residents were expressed
regarding noise levels which would be generated from
the proposed activity, and the direction which the vehicles
would gain access'to the proposed garage. After att
people present were afforded an opportunity to be heard
the Public Hearing was closed at 8:50 P.M.
Moved by Commissioner Kramer, seconded by Commissioner
Stark to approve the preliminary plat, site plan, and variance
fronn the driveway width requirement on 18th Street with
the conditions sited in the memo dated March Z0, 1975, a
copy of which is attached. Nine ayes, zero nays.
Mr. Langenfeld submitted a petition for a variance from
both the rear yard set back requirement in a G-3 zone and
from the parking requirement for a restaurant. These
variances would be needed for the construction of a 35~x
3S~ addition on the existing restaurant.
The petitioner submitted documents indicating that he
could use the parking facilities on adjacent land after 5:00
P.M. Despite the document that Mr. Langenfeld submitted the code
requires a legal document agreement for the use of land not
owned by the petitioner and this was not submitted. Since it
is impossible to comply with the zoning code's parking
requirement on the present restaurant site, the Planning
Director recommended that the variances be denied.

Moved by Commissioner Kramer, seconded by Commissioner
Trautmann to refer the petit[on to the Fisher committee.
Nine ayes, zero nays.
Moved by Commissioner Trautmann, seconded by
Commissioner Stark to change 13th Street to 14th
Street from 14th Street on the east to Brittany Road
on the west. The remaining street name problems
should be referred to the Stoffe[ committee. Nine
ayes, zero nays.
Moved by Commissioner Latch, seconded by Commissioner
Trautmann to amend the motion by extending the renaming
of 14th Street to the western limit of the platted area in
Son[ages Znd Addition. Nine ayes, zero nays.
The petitioner has requested that a home occupation permit
for an upholstery shop in the basement of their home located
at 1227 Hit[side Court. The matter was referred to the
Kramer committee and the Staff was instructed to notify
the surrounding neighbors.
Mr. Raway has submitted an application for a home
occupation permit to sharpen saws in his basement.
The business is currently Ils[ed in his brothers name
in a different location. The matter was referred to
the Kramer committee and the Staff was instructed to
notify the surrounding neighbors.
Chairman Stoffel and Commissioner Fisher were selected
to be placed on the mailing iisi for the Minnesota Planning
As soc[ation.
The Commissioners decided that anybody interested in
attending a conference in Rochester should notify the
Planning Director or the Chairman.
Commissioner Latch reviewed a suggested flow chart for
approving future Pubtic Improvements. He submitted
this information to the Staff for further consideration
and recommendations.
