APPROVAL OF MINUTES Approve Minutes of the City Council regular meeting and workshop on March 21, 2022. Minutes were approved as presented. VI. CONSENT AGENDA The items on the Consent Agenda are items of routine nature or no perceived controversy to be acted upon by the City Council in a single motion. Resolution No. 04-04-22: Re-Approve Precincts 11. Storage container loan to Carpenter Nature Center 12. Resolution No. 04-05-22: Supporting Application for Community Project Funding for FY 2023 IX. AWARDING OF CONTRACTS AND PUBLIC HEARING These are formal proceedings that give the public the opportunity to express their concern, ask questions, provide additional information, or support on a particular matter. Once the public hearing is closed, no further testimony is typically allowed and the Council will deliberate amongst itself and with staff and/or applicant on potential action by the Council. 1. 2022 Neighborhood Infrastructure Improvements a. Public Hearing b. Resolution No. 04-06-22 Stempski presented a summary of the 2022 Neighborhood Infrastructure Improvements Assessments. The reconstruction improvements would involve complete reconstruction of the street with engineered base material and new pavement along with new concrete curb and gutter. Stempski reviewed sidewalk extensions and pedestrian ramp improvements at select locations along improved streets. Storm sewer extensions, repairs, and replacements are also included in all improvement areas. The assessment process and rates were reviewed. Stempski affirmed the total projects cost is $4.3 M, with special assessments to be $1.3M. Stempski reviewed the assessment abatement and assessment deferment programs. Public Hearing opened at: 7:19 pm Seven residents from the project areas presented their concerns and questions about the neighborhood improvement projects and assessments. Council asked staff to take a look at 13th Street concerns raised. This is a big challenge for the Councilmembers and staff and they ask the same kinds of questions. Remember that funds come from a variety of sources—City, assessments, fees. Question about what % is bonded and what % is assessed to homeowner. Stempski reported that approximately 30% is assessed directly to the homeowner. Council affirmed the receipt of a written objection from the Andersons. Expression of appreciation for roads, utilities and the actual life of a road in Minnesota. Plea for patience with the process for road improvement as we all are inconvenienced. It is difficult to see it as a benefit when there is an expense and an inconvenience during construction, but the benefit is found in the long-term. Gratitude for all who spoke to Council during the public hearing. Credit to Stempski and staff to continually work toward quality improvement for the City through the different approaches of reconstruction, reclaim and mill and overlay. Resolution No. 04-07-22: Award of Contract – 2022 Mill & Overlay Program Stempski provided a summary of the contract bidding for the 2022 Mill & Overlay Program. This project will provide a renewed pavement surface, upgrades to 21 pedestrian ramps to ADA standards, and provide 13 concrete sidewalk improvements identified within our ADA Sidewalk Transition Plan. Five bids were received and opened for the 2022 Mill & Overlay Program. Council is requested to award the contract for the 2022 Mill & Overlay Program to the lowest responsible bidder, Minnesota Paving & Materials, in the amount of $452,751.93 Lund, Braucks to approve as presented. 7 Ayes, 0 Nays 3. Amend City Charter Ordinance – Section 1.03: Ward Boundaries a. Public Hearing b. 2nd Reading and Adoption of Amendment to City Charter Murtaugh presented a summary of the Ordinance Amendment Section 1.03: Ward Boundaries. REPORTS FROM CITY STAFF These items are intended primarily for Council discussion and action. It is up to the discretion of the Mayor as to what, if any, public comment will be heard on these agenda items. A. Public Works 1. 2nd Reading and Adoption of City Code Amendment – Chapter 51.05G – Water Conservation Stempski presented a summary of the ordinance adoption of the amendment to Hastings City Code Chapter 51.05G pertaining to water conservation. In response to drought conditions in 2021, the City Council declared temporary limitations on exterior water usage. One of the limitations included time of day on lawn sprinkling systems. Best practice is to avoid water and lawn sprinkling in the heat of the day, therefore it is recommended to enact time of day restrictions in perpetuity to manage the water supply system. To ensure adequate water supply, the City of Hastings has an odd-even day lawn sprinkling policy from May 15 to September 1 of each year and is recommending to also prohibit watering between the hours of 11 AM to 5 PM during this ban each year. The exemption from the odd-even sprinkling ban is for newly planted sod, grass, or landscaping has been extended from 1 week to 2 weeks. Additional discussion on appreciation for this move toward a best practice to protect our water sources—was in place last year and do not want a yoyo effect. Clarification of watering restriction details in the ordinance. Questions about how this change will be communicated to residents. Stempski indicated that the website would be updated, notation in water bills, door hangers, social media, etc. Clarification on two-week exemption for new sod and how the rules are enforced. Council discussion on effectiveness of education without an ordinance to back it up. Folch, Fox to approve as presented. 6 Ayes, 1 Nays—Vaughan B. Parks and Recreation C. Community Development 1. Administrative Citations: a. 1st Reading: City Code Amendment Chapter 10 - General Provisions - Administrative Citations b. 1st Reading: City Code Amendment Chapter 95 - Health and Safety; Nuisances - Public Nuisances c. 1st Reading: City Code Amendment Chapter 32.04.A - Disposal of Abandoned Vehicles d. 1st Reading: City Code Amendment Chapter 158 - Property Maintenance e. 1st Reading: City Code Amendment Chapter 34.03 - Fee Schedule f. 1st Reading: City Code Amendment Chapter 91.30 - Dangerous Dogs g. 1st Reading: City Code Amendment - Repealing Criminal Penalties, Violations and Citations for Various City Code Sections. Hinzman presented an introduction to the City Code Amendment – Administrative Citations. Hinzman invited City Attorney Land to continue the presentation. She provided further detail on the seven proposed amendments. The proposed amendments create an administrative process to enforce certain nuisance code violations. The proposed amendments are consistent with Council discussion. At present, all nuisance violations are handled through the criminal code, which often times has a longer time frame for resolution. Administrative citations have been shown to lessen the amount of staff time in handling enforcement complaints. Ordinance language will allow for abatement or administrative citation. Council discussion on the benefits of shifting from the criminal citations to administrative citations—efficient way to address the situation, take less staff time, incur less cost, and allow the courts to address criminal situations. Resolution No. 04-08-22: Site Plan – Public Works Storage Building (1225 Progress Drive) Hinzman presented a summary of the site plan #2022-26 for the Public Works Storage Building, 1225 Progress Drive. The proposed use is consistent with the 2040 Comprehensive Plan as well as consistent with the requirements of the Shoreland Management Ordinance. The site has housed our Public Works Facility for many years, a large expansion of the existing building occurred in 2007. The request is to construct a 11,200 square foot storage building using an existing internal driveway with no new access point to public streets. The proposed storage building would require 13 additional parking spaces which are currently provided elsewhere within the Public Works Campus. Council question on the objection by one Planning Commission member. Folch, Fox to approve as presented. 7 Ayes, 0 Nays D. Public Safety E. Administration 1. Budget Amendment to Support Building Inspection Services Wietecha presented a summary of the budget amendment to support Building Inspection Services for the City. The amendment includes six budget impacts. The request is being presented due to the boom of construction happening in the City, which is expected to continue into the foreseeable future. Wietecha provided recommendations to each of the associated budget impacts. The budgetary impact of these amendments totals $97,593. Council discussion on the 3% staff increase, the Compensation and Classification Study, and consistency. Councilmembers indicated this type of discussion would be served well in Administration Committee. This request speaks to the workforce shortages also felt in many other areas. Concerns about impact on development if inspections cannot be completed in a timely manner. Council discussion on the budget impact for 2022 and future budgets. Fox, Lund to approve as presented. 5 Ayes, 2 Nays—Vaughan, Leifeld 2. Resolution No. 04-09-22: Providing for Competitive Negotiated Sale of General Obligation Bonds, Series 2022A Tammy Omdal, Northland Securities, presented the proposed sale date as May 2, 2022 for $6.8M General Obligation Improvement Bonds. The bonds are for financing the 2022 street improvement project, a water tower reconditioning project, and a storage building project for the Public Works department within the City. Estimated bond rate is 2.7%, which would possibly make the rate 4%. Currently, the previous bond rating was at AA. Council discussion on any impact to the City rating process has, especially when done frequently. The bond series is rated, not the City. So, there is no impact to the rating based on a repeated bond requests. Discussion on earlier rates and how low they had been. Rates are up. Bonds are affected by terms/maturity. REPORTS FROM CITY COMMITTEES, OFFICERS, COUNCILMEMBERS Announcements • Councilmember Folch reported that the Arts Task Force has been meeting every other week since January and will be recommending a Commission structure. They have a goal of the end of May to present Charter documents and staffing plan ideas. • Councilmember Folch reported that the Dakota County Board has advised that the County withdraw from Dakota Broad Band and will be meeting again on April 13, 2022. • Free Document Shredding for Dakota County residents on Saturday, April 9th • Spring Clean up curbside and drop-off options Monday, April 11 – Friday, April 22 • On Friday, April 5, volunteer with the Hastings Parks Department to plant a tree in celebration of Arbor Day. 1 pm at the Hastings River Flats. • Deadline: April 15 for musicians to apply to be part of Make Music Day on June 21. The application form is on the City website. • United Way of Hastings will be hosting a 3-session series on Fentanyl Awareness on April 26, May 3, and May 10. Info at United Way of Hastings.
