April 10, 2007 - 6:00 pm
)
1) Roll Call at 6 pm: Commissioners Miller, Nelson, Rohloff, Schommer, and Vaughan, Parks and Recreation
Director Bernstein, Superintendent Smith
Absent: Commissioners Popp and Vandehoef.
2) Approved March meeting minutes. Motion by Rohloff. Seconded by Schommer. Passed unanimously.
3) Departmental updates were passed out to the commissioners.
4) Lions Shelter Bid: Director Bernstein informed the NRRC that the low bidder for the new shelter project was
Cannon Construction who came in right around $134,000. He explained that staff requested a base bid plus an
alternate bid in the process. The alternate bid was for the overhead garage doors and was included separately so
that the city could accept the base bid and reject the alternate portion if necessary to reduce costs. All
specs/drawings were done by our licensed architect, Dick Fischer.
MOTION: Commissioner Rohloff motioned that the bid from Cannon Construction be accepted by the city.
Seconded by Commissioner Schommer. Passed unanimously.

5) Riverwood 9th Addition Park Dedication Fee: The Planning Department asked the NRRC whether they would
like to receive land or cash for park dedication for the new Riverwood 9th Addition. Commissioner Vaughan
asked if there was any way to fmd out about the demographics of the area. Director Bernstein responded that
you can generally judge the demographics by the affordability of the housing units that are being built.
Commissioner Vaughan expressed concern that this plan had already gone before the Planning Department and
been approved. Why doesn't the NRRC see the preliminary plans so that a decision can be made on park
dedication before the approval process? Director Bernstein promised to bring the NRRC's written request to see
the preliminary plans to the Planning Director and staff. Superintendent Smith mentioned that both he and
Director Bernstein do attend the Development Review meetings each week and as soon as they hear about a
new development, they try to bring it back to the NRRC. Commissioner Vaughan thought that the issue might
be resolved by slowing down the process with the developers a bit, giving staff time to get all the preliminary
steps done properly. The NRRC would like to see the development plans before the final plat is approved in the
future.
MOTION: Commissioner Schommer motioned to accept cash in lieu of land for the Riverwood 9th Addition
Park Dedication Fee. Seconded by Commissioner Nelson. Passed unanimously.
6) Vct's Concession Stand: The new Recreation Coordinator, Jared Flewellen, is dealing with the Minnesota
Department of Public Health on this issue. The Dept. of Public Health is classifying the stand as a restaurant,
which creates a lot of complications and extra requirements. Director Bernstein mentioned that we may have to
go with only prepackaged food items to keep costs down. We can't start any construction until we receive the
approved permit from the Dept. of Public Health.
7) 5th Street Tree Issue: Superintendent Smith explained to the NRRC that when any construction project is set to
take place in the city, either himself or the City Forester go out and inventory the trees involved to see whether
there will be any potential damage. Trees are then either removed or protected by the city. A property owner on
5th Street had trees on his property that were part of the construction zone, but he also had a tree that was kitty-
comer from the construction zone that had been marked as a hazard tree. Hazard trees need to be removed and
the city pays 40% of the cost of removal, with the homeowner paying the remaining 60%. In this instance, a
neighbor's tree was being removed for free because it was in the construction zone. The homeowner felt that his
hazard tree should also be removed at no cost to himself. The Engineering Department, Public Works and the
Assistant City Administrator all agreed that since this tree was not in the construction zone, it should be handled
under the hazard tree policy. City Council agreed, but did make one allowance to cover the cost of the stump
removal as well.

8) Park Upgrades: The list of proposed park upgrades for 2007 was handed out to the NRRC. Maj or proj ects were
included in the 2007 budget. Commissioner Vaughan asked about the park improvement request process that
the NRRC had developed last year. Director Bernstein replied that this process had been presented to City
Council and approved. The Park Improvement Request forms will be sent out to the NRRC so that the
commissioners can review the process. At the 2008 budget review meeting in June, the NRRC will be able to
prioritize future requests for budget review.
9) Lake Isabel: The low bid for this project was from Sun-Ram Construction and came in at $360,479. This is
about $125,000 less than the initial estimate the city received for this project. Due to the tremendous savings,
Director Bernstein would like to use additional park dedication fees to complete the entire project in one year,
instead of doing it over a period of two years. A brief history of the Lake Isabel project was given for the
benefit of the new commissioners. The bid from Sum-Ram Construction covers the total project, including the
parking lot. Barr Engineering is overseeing this project and will supervise the contractor. The engineering costs
have already been included as part of the 2007 budget. Commissioner Vaughan felt that staff needs to try and
promote Lake Isabel more, especially since the city will be spending a lot of money for all of the improvements.
Commissioner Nelson asked if there are any restrictions on the type of motors allowed on Lake Isabel. At this
time, there are no restrictions on types of motors allowed. Commissioner Miller recommended that since Lake
Isabel will hopefully be used more frequently in the future, the NRRC should review the regulations for Lake
Isabel and possibly make adjustments to ensure that the lake is used properly by everyone. The NRRC
requested that a TRAC bus tour of Lake Isabel be included with the May meeting.
MOTION: Commissioner Rohloff motioned to accept the bid from Sun-Ram Construction in the amount of
$360,479 and to use additional park dedication funds to complete the entire project in 2007. Seconded by
Commissioner Schommer. Passed unanimously.
10) Arena Floor: Director Bernstein stated that the arena floor will be patched again this year and should be
operational for this season. Staff is hoping to sign a consultant this fall and bid the proj ect out, with work being
completed in 2008. Staff needs to speak with turf representatives as well. Director Bernstein also mentioned that
there will be early ice again this year, starting the 1 st week in August. The money that was budgeted for the floor
this year will be carried over to next year's budget.

11) New Business
HAST: Commissioner Vaughan recapped a meeting that staff had with HAST (Hastings Area Swim
Team) recently. HAST has requested to use the pool five days a week in the mornings for practice. Staff
wants to allow them to use the pool Monday, Wednesday, and Friday mornings to allow for more open
swim and lap swim opportunities. It doesn't work well to have the adult lap swimmers and HAST in the
pool at the same time. Staff feels that since this is a community-wide pool, we have to make sure that all
residents have times available to use it. HAST does have the ability to go to the middle school for
practice, but they prefer to use the outdoor pool in the summer. Last year, lap swimmers were very happy
with HAST using the pool 3 days a week, but HAST was not. Staff will be providing more history and
research on this issue. Commissioner Miller was concerned that a relatively small group of residents is
being given such a large share of the available pool time.
12) Old Business
Alternate Commission Members: Commissioner Vaughan asked if any progress had been made in getting
2 alternate cOlllinissioners to sit on the NRRC in the event there is not a quorum. Director Bernstein has
brought the suggestion forward to the City Administrator who was not opposed to the idea, but said that
currently the timing is not good.
Ponding Basins: Commission Miller asked about ponding basins and who is responsible for them. Many
of the ponding basins are city property. Public Works oversees them since they are mainly for storm water
management. Some are used as parks though, like Featherstone and Rosemary Ponding Basins.
Commissioner Miller expressed concern that some of them are in poor shape, with lots of litter in them.
Superintendent Smith explained that the maintenance of these ponding basins is a joint effort by the Parks
& Recreation Department, the Public Works Department, and Administration. Director Bernstein said that
he would mention the NRRC's concerns to the Public Works Department.
Next meeting is scheduled for Tuesday, May 8th, 2007.

Departmental Updates
Parks Maintenance Activities
· The Arbor Day Tree Planting Ceremony was held on Friday, April 27th. Our
City Foreseter worked with Scouts from Troop 503, Cubs from Pack 444,
Mary Zack of Modern Woodmen of America and St. Elizabeth Ann Seton
Council Catholic Aid Association to plant additional trees at Vet's Athletic
Complex. The trees planted include the screen for the playground area.
· The Spring Clean up and Hazardous Waste Day held on Saturday, April
28th required all of the maintenance staff to work extra hours.
· We have hired all the season maintenance staff for this summer. Three
have already started and the others will start when they are finished with
their school sessions.
· The annual Spring Safety Day was held on April 205t. All maintenance staff
was in attendance.
· Preparation of many athletic fields is being done for games as needed. All
the soccer fields and women's LaCrosse field have been lined. The heavy
season of use for all our sports fields is upon us.
· The spring fertilizer application is now being done.
· The mowing season started on the week of April 30th.
· Our crew helped out to make sure all the preparations and clean up was
done for a very successful Earth Day Celebration.

· Swim lesson registration is still going well.
· Shade structures are scheduled to go up on Tuesday, May 8th.

The Hastings School District and the City of Hastings have been discussing
opportunities to place an electronic message board either along Highway 55
near the middle school or upgrade the current message board along Highway
55 and Vermillion Street. After evaluating both locations, it was determined
that the present sign at the intersection of Highway 55 and Vermillion Street
would possibly be the most visible location to place the message board.
As discussions have been progressing, it has been further discussed that since
this is currently a two-sided board, that the replacement electronic message
board would include two separate panels that would operate independently -
one by the City and the other by the School District. It has been further
discussed that since we wish to capture audiences from both directions that if
the other agency would like to display a message on the other agency's
message board to simply notify the other agency.
It is anticipated the City's message board would be operated by the Parks and
Recreation Department although a final decision or determination regarding
operation has not been set.
Tllu Suhuul District would like to have this sigt'l in~ttllled this summer. If the
City agrees to proceed with this sign, the City would repay the school district
~ of the total purchase/installation price in 2008.

At a recent City Council meeting, it was brought up what, where, and when
park dedication could or should be used for projects.
I will be meeting with the Parks and Recreation Committee of Council on
Monday, May 21 st at 6:00 PM in the City Hall Volunteer Room. If any
representatives :from the NRRC are able to join in this discussion, I would
welcome the participation.

SEC. 11.07 PUBLIC LAND DEDICATION.
SUBD. 1. All persons requesting the platting, replatting or other subdivision of
land (excluding simple lot line adjustments which do not create additional lots) shall
dedicate a portion of the area to be subdivided for parks, playgrounds, public open
space or storm water holding areas or ponds in accordance herewith. The City may at
its discretion choose to require payment of cash in lieu of land in accordance herewith.
a. General reauirements: In all subdivisions, a portion of the area to be
subdivided shall be dedicated for public recreation and open space purposes, such
dedication being in addition to property dedicated for streets, alleys, storm water holding
areas or ponds, or other public ways or easements.
No area may be dedicated for public use until it has been approved by the City
Council as being suitable and needed to preserve and enhance the public health,
safety, and welfare of the residents of the City. Such dedicated lands shall be reserved
for public use as parks, playgrounds, public open space, trails or any combination
thereof. It shall be deemed to be in the public interest to require park dedication from a
particular subdivision when the City Council after review and recommendation by the
Natural Resources and Recreation Commission and the Planning Commission,
determines that one or more of the following criteria have been met:
)
1. All or part of the land proposed to be subdivided or developed has been
previously designated as open space, park land or a trailway in the
comprehensive plan.
2. A need for additional parks or recreational facilities will be generated by
the development of the proposed facilities.
3. The land proposed to be subdivided or developed adjoins existing park or
school open space property and the City Council further finds that for the
safety and convenience of the public using the parks or the school
children attending the school, a walkway or corridor or open space is a
public necessity; or that parking lot surface runoff from the land to be
subdivided would create or add to water drainage or erosion problems
within the adjoining open space area.
4. All or part of property located in an industrial or commercial district
proposed to be subdivided is adjacent to a residentially zoned district, and
that an open space area is or will be in the near future necessary to
protect the adjacent residents from safety or health hazards which are
reasonably foreseeable from any of the permitted or conditional uses
which exist or could be developed on the land to be subdivided.
5. The land proposed to be subdivided contains or borders upon existing,
unique topographical features, including but not limited to ponds, lakes,
streams, wetlands, timber stands, hills or bluffs which should be preserved
or reserved for all the public in order to prevent safety hazards and to
provide unique recreational aesthetic enjoyment for residents.

Standards for Acceptina Dedication of Land for Public Park Purpose.
1. Land proposed to be dedicated for public purposes shall meet the general
requirements as set forth under Subd. 1. Paragraph a.
2. Prior to dedication for public purpose, the subdivider shall deliver to the
City an abstract of title or registered property abstract for such dedication.
The conveyance documents shall be in such form acceptable to the City.
3. The required dedication and/or payment of fees-in-lieu of land dedication
shall be made at the time of final plat approval. The Council may upon the
request of the property owner, at the City's discretion when cash is
provided in lieu of land, postpone to a subsequent date (not later than
commencement of construction) the time of payment. Any delayed
payment in accordance herewith shall bear interest at eight percent (8%)
per annum from the date of plat approval to date of payment.
4. The removal of trees, topsoil, storage of construction equipment, burying
of construction debris, or stockpiling of surplus soil is strictly forbidden
without the written approval of the Director of Parks and Recreation.
5. Grading and utility plans, which may affect or impact the proposed park
dedication, shall be reviewed and approved by the Director of Parks and
Recreation prior to dedication, or prior to initiation of construction which
will affect said park lands.
6. To be eligible for park dedication credit, land to be dedicated must be
located outside of drainage ways, flood fringe areas, floodway areas or
ponding areas after the subdivision is developed. Grades exceeding
twelve percent (12%) or grades which are unsuitable for parks ",)
development may be considered for partial dedication. A credit of up to
thirty percent (30%) of the required dedication at the discretion of the City
Council may be allowed for on-site storm sewer, ponding and storm water
holding and ponding areas, wetlands or other surface water resources
provided that such improvements benefit identifiable park and recreation
resources. When lands to be dedicated to be used for these purposes
have been determined to have a park function, credit will be given at a
rate of fifty percent (50%) of the pond and adjoining land area below the
ordinary high water level; a minimum of seventy percent (70%) of land
above the high water level shall be dedicated before pond credit is
granted.
7. Land to be dedicated must be determined suitable for public recreation
and open space use and must be situated so as to best serve the present
and future needs of the neighborhood and community for recreation and
park purposes. Areas to be dedicated for public park, trail or ponding shall
be brought to a suitable condition by the subdivider prior to acceptance by
the City. All dead trees, trash, junk, unwanted structures or similar
undesirable elements shall be removed by the owner at his expense.
Further, the City may at its discretion require the subdivider to rough grade
the land to be dedicated if deemed necessary for use for park purposes.
Subd.2. The amount of land to be dedicated in accordance herewith shall be as 0
follows:
A. Residential Development. The amount of land that all new residential
subdivisions shall dedicate for public parks, playgrounds, public open
space or storm water holding areas or ponds, as required by this chapter,
shall be a percentage of the gross land area being platted based upon the
proposed density per gross acre as shown below:

B. Commercial/Industrial Development.
The amount of land to be dedicated in accordance herewith shall be 10%
of the gross land area to be platted.

SUBD. 3. The Community Development Director shall transmit a copy of all
preliminary plats involving land to be dedicated for the purpose hereof, to the Natural
Resources and Recreation Commission, who shall report back to the Community
Development Director within thirty (30) days after receipt thereof, with recommendation
with reference to said proposed dedication.
SUBD. 4. Cash in lieu of land. The City may at its discretion require the
developer to make a cash payment to the City in lieu of land to meet public land
dedication requirements. The cash amounts shall be determined as follows:
A. Residential DeveloDment
1. $2,200.00 per unit for all single family detached units.
2. $1,650.00 per unit for all twin homes and two (2) unit buildings.
3.$1,100.00 per unit for all buildings containing three (3) or more units
B. Commercial/Industrial DeveloDment
1. $1,200.00 per gross acre of industrial development.
2. $1,500.00 per gross acre of commercial development.

C. Any cash so obtained shall be used by the City only for the acquisition of land or
equipment for parks, playgrounds, public open space, trails or debt retirement in
connection with lan-d previously acquired for such purposes. The City Council may,
upon request of a subdivider, delay time of payment of cash in lieu of land beyond the
time of final plat approval by the City no later than commencement of construction of
public improvements. Any delayed payment in accordance herewith shall bear interest
at 8% per annum from the date of plat approval to the date of payment.

SUBD. 5. Where the developer provides internal to the development, open
space, park, recreational or like facilities, which are to be privately owned and
maintained by the developer or residents of the developed area, a credit not to exceed
fifty percent (50%) of land required (or cash in lieu of) may be provided upon the
following conditions: That such land is not occupied by non-recreational buildings or
structures and is available for the use of all residents in the proposed subdivision. That
required open space and setbacks shall not be included in the computation of such
private open space, park, etc. That the use of the private open space shall be restricted
to park, recreational and like uses in a manner satisfactory to the City, which may
include recorded restrictions or covenants to run with the land, the same not to be
defeated, eliminated or reduced without consent of the City. That the proposed park
area internal to the development is of size, shape and location, topography and usability
for park and recreational purposes or contains unique natural features, the preservation
of which is determined to be in the best interest of the City by the City Council. The
proposed private open space, park, etc., reduces the demand for public recreational
facilities to serve the development. Determinations in accordance with this Subdivision
shall be by the City.
SUBD. 6. Where a proposed park, playground, or recreational area has been
indicated in the master plan or park plan of the City, and is located in whole or in part
within the proposed subdivision, such proposed public site shall be designated as such
and shall be dedicated to the appropriate governmental entity. If the developer chooses
not to dedicate an area in excess of the land required under the section hereof for such
proposed public site, the Council shall not be required to act or approve or disapprove
the plat of the subdivision or development of same for a period of ninety (90) days after
the subdivider meets all of the provisions of this Chapter to permit the Council to
consider the proposed plat and take the necessary steps to acquire, through purchase
or condemnation, all or part of the public site proposed under the master plan of the
City. This ordinance shall apply to all plats which receive final plat approval after July 1,
1991.

2.7 under section 462.353, subdivision 4a, as required by paragraph (a), the municipality must
2.8 adopt a capital improvement budget and have a parks and open space plan or have a
2.9 parks, trails, and open space component in its comprehensive plan subiect to the terms
2,\0 and conditions in this paragraph and paragraphs (c) to (i).
2.11 (c) The municipality may choose to accept a cash fee as set by ordinance from the
2.12 applicant for some or all of the new lots created in the subdivision, based on fair market
2.13 value of the land, no later than at the time of final approval.
2.14 (d) In establishing the portion to be dedicated or preserved or the cash fee, the
2.15 regulations shall give due consideration to the open space, recreational, or common areas
2.16 and facilities open to the public that the applicant proposes to reserve for the subdivision.
2.17 (e) The municipality must reasonably determine that it will need to acquire that
2.18 portion of land for the purposes stated in this subdivision as a result of approval ofthe
2.19 . subdivision.
2.20 (0 Cash payments received must be placed by the municipality in a special fund to
2.21 be used only for the purposes for which the money was obtained.
2.22 (g) Cash payments received must be used only for the acquisition and development
2.23 or improvement of parks, recreational facilities, playgrounds, trails, wetlands, or open
2.24 space based on the approved park systems plan. Cash payment'! must not be used for
2.25 ongoing operation or maintenance of parks. recreational facilities. playgrOlmds, trails,
2.26 wetlands, or opcn spacc.
2.27 (h) The municipality must not deny the approval of a subdivision based solely on
2.28 an inadequate supply of parks. open spaces, trails, or recreational facilities within the
2.29 municipality.
2.30 (i) Previously subdivided property from which a park dedication has been received.
2,31 being resubdivided with the same number of lots, is exempt from park dedication
2.32 requirements. If, as a result of resubdividing the property, the number of lots is increased,
2.33 then the park dedication or per-lot cash fee must apply only to the net increase of lots.

The Minneapolis Park and Recreation Board and the Minneapolis City Council
may iointly exercise the powers conferred under Minnesota Statutes, section 462.358,
with respect to requiring that a reasonable portion of land be dedicated to the public or
imposing a dedication fee on new housing units in the city, wherever located, for public
parks, playgrounds, recreational facilities, wetlands, or open space. The dedication of land
or dedication fee must be imposed by an ordinance iointly enacted by the park board and
the city council. The ordinance may exclude senior housing and affordable housing from
paying the fee or the dedication of land. The provisions of Minnesota Statutes, section
462.358, subdivisions 2b, paragraph (b), and 2c, apply to the imposition, application, and
use of the dedication of land or the dedication fee.
Sec. 3. EFFECTIVE DATE.
Section 2 is effective upon compliance by the Minneapolis Park and Recreation
Board and the Minneapolis City Council with Minnesota Statutes, section 645.021.

NRRC Park Improvement Request Information
Improvement Reauest Guidelines:
The City of Hastings and the Natural Resources and Recreation Commission (NRRC)
strengthens the enduring connection between residents and your park system by
maintaining, planning and upgrading the park system of trails, parks and open spaces
owned by the City of Hastings. In addition, the NRRC, City Council and the Hastings
Parks & Recreation staff work together to work with local residents to ensure your
needs are met. In an effort to meet the ever changing needs of the community with our
limited funding, the NRRC has developed an application for proposed improvement
projects.
The NRRC, City Council and City Staff make strategic plans for all parks, trails and
other open spaces. If you wish to propose an improvement to a City park, trail or open
space, the NRRC, City Council and City staff have adopted the following principles
guiding the upgrading of any city facility:
All proposed projects must have a direct and measurable impact within the parks/trails
and open space system.
All proposed projects must fulfill one ofthe multiple visions and goals ofthe NRRC
Comprehensive Management Plan including:
· Preservation or enhancement of an existing park/trail or open space
· Enhancement of opportunities for public leisure, education and scenic
enjoyment
If you, your neighborhood or other civic organization would like to recommend to the
NRRC any potential upgrades to a park, trail or open space, please send a letter or
e-mail that includes the following information:
· Name, address and contact information or person(s) requesting the project
· Name of park, trail or open space of the proposed project
· Nature ofthe desired project
. Why you feel this project needs attention
· Overall system improvement if this project were to proceed
· Other people, community groups or organizations who are also interested in
this project (Please include list of names and signatures if possible.)
· Would there be any contributions (either volunteer or financial) from you or
your group for this project?
The NRRC will evaluate each request based on the followim! criteria:

. Age of equipment/facility
· Improved or expanded leisure opportunities
· Demographics
· Aesthetics
· Location to other facilities
· Maintenance
· Environmental concerns
