September 4,2007
The City Council of the City of Hastings,Minnesota met in a regular meeting on
Tuesday, September 4, 2007 at 7:00 PM in the Council Chambers at the Hastings City Hall,
101 East 4th Street, Hastings,Minnesota.
Members Present: Mayor Hicks, City Councilmembers Alongi, Hazlet, Hollenbeck,
Schultz, Slavik,and Riveness
Members Absent: None
Staff Present: City Administrator Dave Osberg
Assistant City Administrator Melanie Mesko Lee
City Attorney Dan Fluegel
Planning Director John Hinzman
Approval of Minutes:
Mayor Hicks asked if there were any corrections to the minutes of the regular
meeting on August 20, 2007. Hearing none,the minutes were approved as presented.
Consent Agenda
Moved by Councilmember Hazlet, seconded by Councilmember Slavik to approve
the Consent Agenda as presented.

Public Hearing—Ordinance Amendment/Rezoning#2007-30: Creation of R-1L
Zoning District/Rezoning of Properties
Planning Director Hinman provided a report of the proposed rezoning and
ordinance amendment.

Second Reading/Adopt Ordinance—Ordinance Amendment/Rezoning#2007-30:
Creation of R-1L Zoning District/Rezoning of Properties
Councilmember Alongi asked if there are any other pieces of property in the
City which would qualify for this zoning designation. Hinzman stated that there may
be a few individual lots. Discussion over feedback from property owners on the
proposed change; Hinman stated that the CDA expressed opposition to the change,
however it will have no impact on the current use of CDA-owned property. Hinzman
stated that one property owner,not contiguous to the rest of the rezoning district,
requested to be included but staff does not recommend inclusion because it is not a
contiguous piece of properly.
Moved by Councilmember Slavik, seconded by Councilmember Alongi to
approve the ordinance amendment as presented.

approve the rezoning as presented.

Resolution—Provisional Home Occupation#2007-38: Haunted Teas at 220 7th
Street East(Martin)
Hinman stated that there were no comments regarding this specific request,but
a general comment on home occupations. .
Moved by Councilmember Schultz, seconded by Councilmember Riveness to
approve the resolution as presented.

Resolution—Variance#2007-39: Expand Non-Conforming Garage at 1207 West
Ramsey Street(Squires)
General discussion about outstanding code issues on the property.
Moved by Councilmember Riveness, seconded by Councilmember Alongi to
approve the resolution as presented.

Resolution—Variance#2007-19: Expand Conforming Garage at 708 West 2°d
Street(Martin)
Hinzman stated that the Planning Commission recommended denial of this
variance earlier this year, as approval of the request would turn a conforming use into a
non-conforming use. Staff recommends denial.
Michelle Thompson,the property owner, stated that her neighbor does not
oppose the garage expansion.
Moved by Councilmember Hazlet seconded by Councilmember Schultz to deny
the variance request.

Oktoberfest Request
Mesko Lee outlined a request by the Downtown Business Association to host an
Oktoberfest event on October 12 and 13, 2007. Among the items to be addressed as part
of a consideration of approval:
• Close off 2nd Street from Sibley Street,west one block on Friday October 12
from 6:00 p.m.to 12:00 midnight;
• Close off 2nd Street from Sibley Street,east one block to Ramsey Street on
Saturday, October 13 from noon to 6:00 p.m.,
• Designate the two-day event as a"community civic festival and celebration"
under the City Code 111.25. This designation would allow the City to issue a
permit for a variance from the provision prohibiting consumption or possession
of a liquor container on any street or other public property. The requested
variance would be for Friday, October 12, 2007 only.
• Staff's conditions regarding access, control, clean-up, etc.
There was discussion over sanitation and emergency service access. The Council
determined that this approval was a"test run"for future requests.
Moved by Councilmember Alongi, seconded by Councilmember Schultz to
approve the event with the conditions as presented.

Consider Settlement/License to Encroach at 1602 East 4t' Street
City Attorney Fluegel stated that an agreement is recommended to be approved
by the Council,whereby the garage will be removed at the property owner's costs and
the house encroachment may remain under certain circumstances.
Moved by Councilmember Slavik, seconded by Councilmember Alongi to
approve the settlement and license to encroach as presented.

Reports from City Staff or Councihnembers:
A Comprehensive Plan Neighborhood Meeting will be held at City Hall on
Wednesday, September 12 from 4:00—8:00 p.m.
The LeDuc Mansion will have Civil War Days on September 8 and 9.

Moved by Councilmember Slavik, seconded by Councilmember Riveness to
adjourn meeting at 7:36 p.m.
