MINUTES OF REGULAR PLANNING COMMISSION MEETING
HELD ON MONDAY, SEPTEMBER 24, 1973
Those present:
Mr. Kramer, Mr. Soleim, Mr. Hallberg, Mr. Hirchert,
Mrs. Stoffel, Mrs. Linde, Mr. Trautmann, Mr. Leo
Schumacher, Jr., and Mr. Steve Sindt.
Also present:
John Davidson, Mr. Schnirring, Mr. Tonsager, Mr.
Holmes, Mr. Wolff and Mr. Cater, residents on Hillside
Court and members of the press and radio station.
It was asked that the minutes of September 10, 1973 be corrected to show'
Mr. Richard Jensen present. If was moved by Mr. Hallberg, seconded by
Mr. Trautmannto approve the minutes as corrected, and unanimously passed.
Regarding Burns and Enstad request for construction of office building
at either 5th and Sibley, or West Highway 55, Subcommittee Chairman,
Soteim stated there was no firm proposal to study at the present time.

Regarding request by Tom Reuter and Vernon Jensen, it was determined
that additional studies were required and a tour of the property in approximately
one month when leaves and vegetation was removed so they could view the
topography in the area.
Regarding Otto Theuer request to relocate the Walbridge house, Mr. Soleim
reported they encountered the following problems in visiting the site and studying
the regulations:
1. The house is to be moved on a site on E. 10th Street on unplatted
property with an Industrial zone. There are no allowable "Special
Uses" in an Industrial zone, therefore rezoning to R-I, R-Z, or
R-3 would be required.
2. Septic tank requirements on 1-1/2 acres would require at least
an acre and one half of property, however, the Subdivision Regulations
require that less than 5-acre parcels unplatted must either be platted
or a Variance would be required.
The subcommittee wilt again meet with Mr. Theuer to discuss the proposal.
A discussion was held in regard to the pedestrian-way proposed by Hastings
Construction Company in Dakota Hills Znd and 3rd Additions. This was referred
to the City Council for formal action.

The Planned Unit Developn~ent concept will be discussed on October 8th
with Mr. Arno Haering from the Metropolitan Council.
There was a review of the 5-Year Capital Improvements Program.
The following projects are complete, or in progress:

These are being prowided for by Lawcon Funds or Grants-in-Aid.
Two projects which were not completed and recommended for holdover to 1974
would be:

Acquisition of right-of-way at the intersection of T.H. 61
and T.H. 316
Plans and specifications for 10th Street improvements from
T.H. 61 to the Vermillion River which would be constructed
from turnback funds when turnback funds are available.
Referring to Page 24, Table II, 1974 Capital Improvements, it was recommended
that STS-3 be changed from Storm Sewer Construction to Storm Sewer Final
Reports and Recommendations.
SS-Z, Table Ilbe replaced bySS-3, Table III and that the 6" sanitary
sewer in 6th Street from Pine Street to Forest Street be included in
the 1974 Capital Improvements budget.
S-3, Sidewalk Construction on 15th Street from Pine Street to Westview
Drive, the engineer suggested that a system of priorities be established
for sidewalk construction, that some of the Council members have
recommended various sidewalk projects outside of those proposed, one
example .is sidewalk along Nininger Road abutting Lakeside Cemetary.
Another project that might be considered is the area from Ashland St.
to Pine St., east of Pine Street, which would connect with the Pine St.
sidewalks constructed in 1973.
It was suggested that RB-5 and RB-5, Table II be replaced by RB-6
Table II, 1975 Capital Improvements Program, that the grading and
utilities on Pleasant Drive from Honeysuckle Lane to T.H. 55 precede
the construction of the birdge over the Vermillion River.
It was suggested that RB-4A be retained in the Capital Improvements
Program for 1975 and that acquisition of right-of-way for a connecting
road between Ramseyand Tyler Streets, between llthand 15th Streets
be provided so that one-way designations might be made of Ramsey and

Tyler Streets south to 18th Street.
It was suggested that PR-4, PR-5, PR-6 and PR-7 for $5000
of improvements be retained onlyin amount and these priorities
be reviewed by the Natural Resources Commission and a resolution
passed at their last meeting be studied further relative to construction
of tennis courts or improvement of tennis courts at the Roadside
Park and T.H. 55.
Again, PR-lA and PR-lB and PR-gA be included in a Grants-in-
Aid request for Lawcon or Corps of Engineers funding.
It was moved by Mr. Trautmann, seconded by Mrs. Linde to adjourn, and
unanimously passed.

It was asked that the minutes of September 10 be corrected to show that Mr.
Richard Jensenwas present. After that correction the minutes were app'roved
by Mr. Hallberg '~econded by Mr. Trautmann and unanimously approved.
Next item, Burns and Enstad request for construction of office building at
either 5th and Sibley or West Highway 55 had not been resolved. The sub-
committee chairman, Mr. Soleim, stated that there was no firm proposal to
study at the present time. They would report back once the site had been
dete rmined.
Next, the request of Mr. Tom Reuterand Vernon Jensen for construction of
houses and private well and septic tank sytems in the West Second Street area
between Spring and Pine Streets which had been referred to Mr. Hallbergs
study committee. It was discussed in some detail. Mr. Vernon Jensen was
present. He stated that he felt that a sanitary sewer and city water system
would have been the best solution to allowing construction in the area, however,
the seven 66 foot lots owned by Mr. Jensen could only be used to construct at
most three principal dwelling units. It was Mr. Jensens intent that he would
constuct only one single family residenence on the site. He stated that the
:estimated $36, 000 for sewer and water which was provided to them in 1973
would have been agreeable to them but there were a number of persons in the
area who certainly could not afford the expenditure of approximately $6, 000
per 66 foot lot. He is asking that septic tank be allowed until City sewrer is
available. That he would pay the total cost o£ extending City water to the site
and he would pay ail costs incidental to the necessary testing under the septic
tank and well ordinances. He stated that the lots were on the North side of
SEcond Street between Maple Street and Pine Street. It is possible to get the
required setbacks in accordance with Zoning regulations. He stated that they
had ample room for private septic systems and drain fields, that the property
did flatten off below Second Street which would make septic tank and drain
fields workable recognizing the fact that the soil and rock formations would
have to be tested by an independent laboratory.
The Engineer stated that we did have a topographic map of the area and it was
determined in 1973 that it was, engineering wise, possible to construct a home
on the site.

The Engineer also stated that we must address ourselves to the environmental
aspects and a report should be prepared relative to the problem that might be
created by erosion, removal of vegetation and so on.
The Engineer stated that a run off situation from roof drains or concrete
drives or if the removal of vegetation from the deep slopes can result in
disatrous erosion problems and mud slide conditions.
Mrs. Stoffel stated that she felt that if the property owner who pays taxes on
property certainly should be given every right to use that property in his own
best interest recognizing that the proposition should be given further study.
Councilman Hallberg stated that not all property is developable. It was the
Planning Commission obligation to determine what areas should and what areas
should not be developed in the best interest of the total community. He stated
that sometime if the value to the owner is based on other than soorrt planning and
there are emotions involved personal feelings toward properties which unfamiliar
persons cannot be familiar. He stated that after careful studies it may be
determined that proper facilities can and may be developed.
Mr. Trautmann stated that he felt additional studies are required, that he
would suggest that there be no action taken at this meeting.
It was then discussed how the Reuter property fit in with this one and their
requestwhich also had been referred to the Planning Commission. The
Engineer stated that a more economical sewage disposal and water system
could be studied for both the Reuter properties and the Jensenproperties.
It may be possible, .in Mr. Jensens case to put in a lift system for one
residence. It would be more economical than construction and maintenance
of septic system and drain field.
Iillwas then determined by the study committee chairman, Mr. Hallberg, that
the Council had not approved the request by Mr. Reuter but had merely formally
referred it to the Planning Commission and Mr. Hallberg stated that no study
had been done by the committee, .in the case of the Jensen request since this
was referred by the Council at their last regular meeting. It was decided that
Mr. Jensen would provide the Planning Commission with a tour approximately
one month from tod.ay so that the leaves and vegatation would be largely removed
from the slopes and the Planning Commission could more easily see the topography
in the area.
Next was the Otto Thueur request for relocation of the Wallbridge home. Mr.
Soleim, chalrman of the sub committee stated that they were not able to meet
with the Thueurs, however, some of the problems that they had encountered
in visiting the site and studying the regulations indicate that the following conditions
exist:

The house is to be moved on a site on East 10th on unplatted property
with an Industrial Zone. There are no allowable "Special Uses" in an
Industrial Zone, therefore rezoning to iK1, R2 or R3 would be required.
Septic tank requirements on 1 1/2 acres would require at least an acre
and one half of property, however, the subdivision regulation requires
that less than five acre parcels unplatted must either be platted or
a variance would be required to the subdivision regulations. They
stated that they would meet with the Thueurs to discuss ~ke proposal
further. Mr. Thueur was looking for alternate sites available. In
the discussion period it was asked how close this would be to the
Pechacheck Mobile Home Park. It was indicated that the Mobile Home
Park would be quite a ways West and North of the proposed site. This
would be basically just East of the Dinty Moore property on 10th Street.
Sewer is not presently available, however would be available with a
lift station system in that area in the future which may or may not be
part of the State Hospital connection to the City of Hastings Waste
Water Treatment Plant and sewer system.
Next, Mr. Trautmann left his seat as a member of the Planning Commission
and joined Mr. Woolf and Mr. Cater in the audience to discuss the pedestrian
way and sidewalk construction proposed by Hastings Construction Company
in Dakota Hills 2nd and 3rd Addition. Questions were as follows:
They recognize that the sidewalk easeraents exist and recognize the
traffic carrying capacities of the streets on either side of the pedestrian
ways, however, they questioned the advisability of constructing bituminous
sidewalks .in these areas for lack of lighting.
2. Protect[on from pedestrians.
3. Why they have to be constructed at this time?
4. It appears to them that there are greater needs in other parts of the
City particularly along thoroughfares.
When will the sidewalk be constructed on 15th Street as a connector.
They bring these items up only because of concern. They don't want it
now. They want Council action. They want Hastings Construction Company
to cease construction until adequate review has been made of the proposal
to construct bituminous walks in an area they consider to be an unsafe
pedestrial route.

Also questioned was what happens to the balance of property between
the private property and the bituminous sidewalk, who maintains it
and they want a Council answer to these questions. Also the expected
life of a bituminous pathway through this area, whether it would become
a deteriorated condition, weeds being allowed to grow and if the property
owners will be responsible for maintenance.
The 1Engineer stated that there would be no cost to the City, the contractor
was going to pay for it, it was his responsibility under both the Subdivision
Regulations and the Sidewalk Ordinance. The engineer indicated that ~ve
have not addressed ourselves to lighting, however, power poles are available,
lighting could be provided. As far as protection from pedestrians, this
would be up to the individual property owners to fence their property if
trespassing became a problem, as it would be for any public street, boule-
yard or right-of-way. The necessity for doing it at this time is so that if
we can put in the sidewalks prior to final landscaping, sodding and fencing
of rear yards in the area. The idea of waiting until all of the property has
been sold and improved before we put in the sidewalk would only mean the
property owners involved would be more opposed to the program than the few
that are presently involved. The answer relative to greater needs in other
areas of the City is not applicable to this case, since the developer is paying
the entire cost of the project, he is not about to expend those same funds in
any other area of the City. They stated they brought it up only because it was
of concern, they didn't want it to happen now, they wanted the Council to take
action. The engineer indicated that if they were truly concerned, that if it
was not a special interest request for their own benefit, they should have an
alternative plan which would accomplish the same thing, to move traffic between
streets. If a better plan were provided it would be recommended that the Council
consider such a plan, however, the only feasible plan would nxerely be the re-
location of the present planned-in place system, to replat the area at this time
would appear to be only a delay tactic.
The engineer stated that bituminous walks should last as long as bituminous
streets and we have a good number of bituminous streets within the City of
Hastings, most of which were constructed since 1958 have not been a serious
maintenace problem, provided adequate base and depth of surfacing is used.
We reviewed the sidewalk concept in the John Gonzemius area from 1963
and 1964 to the present final platting, which indicated no significant change
from the very original concept plan to the present platting had been made.
The Planned Unit Development concept to be discussed with Mr. Arno Haering,
from the Metropolitan Council was deferred to October 8th. Mr. Haering called
the City Engineer and indicated the information that he was going to provide the
Planning Commission had not yet been received by him. He would contact the
City and advise them when the material was available so he could meet with
them at their October meeting.
There was a review of the 5-Year Capital Improvements Program. The engineer

referred the Planning Commission to Page 23, Table I, for the 1973 Capital
