Julius Lamb request to use building across from his home as an antique shop: recommended that formal application be made for Special Mse Permit. Peter Likes request to build house at end of East 4th Street: This land is presently vacant and formal application should be made. Ben Franklin Store request for approval of their newly installed barbed wire fence: referred to Hallberg committee. Trautmann committee report on PUD study presented by Mr. Davidson. Con- tinued until members have an opportunity to study the proposals. Hallberg committee report on H.D. Hudson Co. request to vacate First Street North of present Hudson property: There are several survey questions and title questions which must be resolved prior to com- mittee recommendation. Tanner~ Secretary Hastings Planning Commission ITY OF HASTINGS 100 SlBLEY STREET, HASTINGS, MINNESOTA 55033 Phone 437-692~ Hastings on the Mississippi OFFICE OF CITY ENGINEER MINUTES OF REGULAR PLANNING COMMISSION MEETING HELD ON MONDAY, JULY 9, 1973 The meeting was held at 7:30 PM in the Council Chambers of City Hall. Those present were Mr. Jensen, Mr. Kramer, Mr. Hallberg, Mr. Soleim, Mrs. Stoffel, Mrs. Linde, Mr. Sindt and Mr. Tanner. Also present were Julius Lamb and his wife, Roger Tonsager, Richard Holmes, Walter Petersen and members of the press. Absent and excused were Mr. Trau~mann and Mr. Hirchert. The first item was the approval of the minutes of June 25, 1973. Motion was made by Mrs. Stoffel, seconded by Mrs. Linde. Next item was the review ora request of Mr. Julius Lamb to determine whether the Planning Commission would suggest a special use permit or approval of running a gift or craft shop out of the vacated garage on the Earl Bakken property located at the Southwest corner of Third and Ash St. Mr. Lamb operates a antique shop out of is o~ at the present time. The "Home Occupations" permit refers to Z5% of the floor space of a residential dwelling, therefore, operating a business in a separate building would not qualify under a "Home Occupation" section of the Zoning Ordinance. A gift or craft shop is an all owable use in an R2 zone and as such could be allowed as a allowable use within an RZ zone, however i~was felt that the applicant in order to prevent setting a pre- cedence//antique shops in residential neighborhoods without controls that Mr. Lamb submit an application for a "Special Use" permit for the next Council meeting to be held on Monday, 3uly 16. It would be referred to the Council and back to the Planning Commission for a recommendation. Mr. Lamb agreed that he would submit such a request in writing prior to July 16. Next the Engineer stated that a Mr. Peter Likes had indicated that he wanted to construct a new home on the Pete Mitzukproperty, East Hastings. This was the extreme Easterly end of East 4th Street. The area is supposedly out of the Flood Plain although during flood stage the area is isolated from land because of the Iow areas surrounding the land in question on which the house would be constructed. The Engineer indicated that he had told Mr. Likes that it would have to be determined as to how high above flood stage the property would be located on which he would construct a home and that the Engineer would determine that from actual elevations run in the field. A formal request would have to be made, however, the request was brought to the Planning Commission so that they might be aware of the fact that we will be getting requests for housing in the East Hastings area. Minutes of Regular Planning Commission Meeting Page 2 Monday, July 9, 1973 Some position is going to have to be taken in recommendation for or against new construction in this area. Next item was a letter of request from the Ben Franklin store indicating that they had installed a barbed wire fence to protect the garden store, materials stored in the alley side of the Ben Franklin store. This item was referred to Don Hallbergs committee for study and will be brought up at the regular Council meeting for referral by the City Council. (Give this to Joanne for the Agenda for the July 16 meeting). Next the subcommittee, Mr. Trautmann, Jensen, and Mrs. Stoffel prepared a report of Planned Unit Development based on the Dakota County suggested PUD land for establishing a zoning district or for granting PUD under a conditional use permit basis. It was requested to make copies of these drafts available to Mr. Walt Petersen and mei]abers of the press. The Engineer reported that the original draft copy of a Planned Unit Development Ordinance was copied from the Burnsville ordinance. The two copies, Section 7,6 and alternate Section 7~6 dealt ~vith the two methods of establishing a Planned Unit Development procedure either by zoning or special use permit. The Planning Conarnission was going to review these and make comments and report back at the next meeting as to how to combine the three draft copies and the present Planned Unit Development ordinance. It was also suggested that we might add the Planned Unit Development Section Ordinance in addition to what is already shown in the zoning ordinance. The one in the zoning ordinance being applicable basically to multi dwelling units R3 and tK4 zoning. Following the review of the Planned Unit Development Ordinance the group was reminded of the building officials meeting to be held Thursday, July 12, 7:00 PM in the Hastings City Hall. All present were encouraged to attend that meeting. Next the discussion centered around the sub committee report. Mr. Hallbergs cornrnittee consisting of Mr. Hallberg, Mrs. Linde and Mr. Dave Tanner. The committee wanted a concensus of opinion from the Planning Commission as it dealt with the $. D. Hudson request to vacate West First Street from Highway 61 to Spring Street. Mr. Hallberg indicated there was a question as to whether there was a street along the river. The question that the Planning Commission was addressing itself to was to whether in accordance with the Comprehensive Plan a green way should be retained along the rivers edge which would be public right of way and H.D. Hudson, if it in fact, had right to the land should be in a position to certify proof of ownership. If the City could i- ~--t retain easement rights along the river for public use, the Planning Commission position at this time would be to retain it for thepublic use and the need for vacation was to clarify any uncertain aspects of the platted First Street as it appeared on the 1855 plat of the original town of Hastings. There was then a question of the Corps of Engineers easement rights across the property secured from H.D. Hudson during the Second Minutes o£ Regular Planning Commission Meeting Monday, 3uly 9, 1973 Page 3 World War at the time the tank farm was constructed. The Engineer was asked to contact the City Attorney and look into the legality of such a easement, who had the easement rights, and who purchased easement rights from whom. The question was who offered the NSP easement rights and who granted the government railroad right of way easement rights at the time it was constructed. The third legal question, can the City retain the public green way in accordance with the comprehensive planif it were in fact a street. Mr. Tanner indicated it could not be acquired by emminent domain, that the City still had public rights in a street area even though the street hadn't been used by the public. The only way that street right of ways can be acquired is by formal vacation by the governing unit. Next the question of Hy De Hy Bottling Works being in operation came up. It has appeared to the Planning Commission to be a violation of City Ordinances. The City Attorney was asked to pursue this and see what procedure should be followed dealing with the illegal operation of a retail sales outlet from the Hy De Hy building.
