question.
Cit,'ford Olson application for Variance of sideyard setback at 509 W. 17th St.
asks for reduction by four and one-half (4-1/2) feet of the Forest Street setback.
Referred to Mrs. Linde's committee°
Donald Fahy asks for Special Use Permit to build duplex in R-2 Zone at north-
west corner of 9th and Pine Streets. Tabled because no report from Mr. Fahyo
Capital Improvements Program - After attempts at establishing priorities, it
was decided that there should be a public hearing on Suly P-4, 1972 at 7:30 P, Mo
At this hearing the ToK.DoA. memo of 4-10-72 will be discussed.

MINUTES OF HASTINGS PLANNING COMMISSION MEETING
HELD MONDAY, JUNE 12, 1972
Those present:
Mr. Petersen, Mr. Hallberg, Mr. Siebrecht, Mr. Soleim,
Mr. Wilson, Mr. Sieckert, Mr. Tanner, Mrs. Linde,
Mr. Leo Schumacher, Jr.
Also present:
Mr. John Davidson, City Engineer, Mr. Neal Siewert,
his Legal Counsel, and Mr. Ralph Wagner of Apache
Engineering.
The first item was approval of the minutes of May 22, 1972. It was moved by
Mr. Siebrecht, seconded by Mrs. Linde and unanimously passed without
correction.
Dakota Hills 3rd Addition was discussed. Mr. Ralph Wagner of Apache Engineer-
ing made the presentation. Mr. Wilson's committee had only reviewed the plat
.in general with the following statements:
There was some question as to whether the ravine along the north
line of lots facing 14th Street should be an easement over the lots,
or whether the 50 foot right-of-way should be dedicated to the City
as an extension of Conzemius Park. This would eliminate the
possibility of anyone living in that area upgrading the ravine and
give the City full control of the ravine from Conzemius Park to the
west.
There would have to be an access or pedestrian way at least twenty
(20) feet in width from Westview Drive to the ravine leading to
Conzemius Park. There was some discussion previously about ded-
icating that with the plat for the Townhouse development north along
13th Street.
The sidewalks through the walkway area should be constructed prior
to houses being constructed in the areas as soon as possible, perhaps
with the paving contract. The bituminous sidewalk, 6 feet wide, in
the Z0 foot walkway easement could be constructed.
The committee would recommend to table until the next Council Meet-
lng so that they might meet with Mr. Gustafson and Mr. Wagner. The
engineer indicated that Mr. Gustafson wanted to meet with him tomor-
row to discuss the tree planting along Westvlew Drive and Southview
Drive in Dakota Hills Znd Addition.

The next item was a review of Heal Siewert's request for variance. (See sub-committee
report that was attached to the agenda for a side yard set back variance for Lot l, Block
8 Townsview Estates). Mr. Siewert was present and in rebuttal stated that although
he was aware of the new ordinance he was not aware of the setback requirements.
Thinking that the subdivisions which were approved under the old ordinance would carry
the old setback requirements of 10 and 15%. In line with this if he had built the house
three or four months ago he could have built i~to the present setback and it would have
not been non-conforming. On the second item he stated that the variance received in
the past was for a garage entrance onto Pleasant Drive which is a limited access road
way. He had then became aware of the fact that Pleasant Drive was in fact a limited
access roadway. The third item, the building inspector did have a drawing with the
building permit which clearly shows a 10' side yard setback and no mention was made
of the fact until the permit had been granted and building construction had commenced.
And last rebuttal was that he could not without a complete new start desi§n a building
for the lot. That it would mean a cost of $1500.00 to tear down the present basement
structure that is in place.
There was then a motion by Mr. Siebrecht, seconded by Mr. Hallberg to deny the
variance in accordance with the sub-committee recommendation report. There was
then a tie vote of 4 yes and 4 no votes in favor of denial. This will be put on the agenda
for the June 19 meet[.ng, 1972 and the recommendation made to the City Council
(Make a note to Leone to have this placed on the agenda).
Next Mrs. Linde was a~:Ked for a mobile home report. There was no report.
Mr. Trautmann was not present so the Murray Laub alley vacation was deferred.
No report.
Mr. Peterson then outlined the minutes of the last Nininger Planning Commission
meeting that were furnished to him and the City Engineer after the meeting.
Next item, Mr. Tanner gave a brief report of the ad hoc Planning Commission Meeting
at which time he was nominated the acting chairman until a full time chairman can be
appointed. After reviewing the discussion of that meeting he stated that the next meeting
would be set or had been set for July 11, 1972 at 7:00 PM in the City Council Chambers
at which time the City Engineer, John Davidson will review the T.H. 55 by-passes.
Next item was a letter from Mr. Clifford Olson, 509 West 17th Street. This was
referred to Mrs. Linde's sub-committee.
Next a letter from Mr. Don Fahy for a special use permit. It was suggested by Mr.
Peterson that this request be held in abeyance since Mr. Fahy had indicated to him
that the routine through the Planning Commission and the Council would take to long
he did not have that much time.
Next we discussed the Capital Improvements Program as per memo dated April 10, 1972.
We went through that report and picked out those constructions proposed for 1973 which
were as follows: 1) garage, Z) police building, 3) flood protection Vermillion, 4) storm
sewer study, 5) school sidewalks, 6) armory, 7) 4th Street pumping station, 8) 316
Highway 61 intersection, 9) Pleasant Drive surfacing, 10)ponding basin developmen~ontro1

Next there was a suggestion by Mr. Wilson that we adopt the memo as proposed
and then hold public hearings for input from the general public. It was then moved
by Mr. Soleim, seconded by Mr. Wilson that a public hearing be held at 7:30 PM
in the City Council Chambers on Monday, July 24, 1972. {Make a note of this to
give to the City Clerk so that the necessary notice can be placed in the local press
and the radio stations).
Within that suggested Capital Improvements Program for 1973 was suggested for
that 1974 we insert the area including Ramse¥ and Tyler Street, the designation of
one way systems, acquisition of cross streets and sidewalk construction to be
included in the 1974 program. Also that the park developn~ent adjacent to the ponding
basin be considered for park development in the 1974 construction program.
The next regular meeting of the Planning Commission will be held on Monday, June
26, 1972 at which time we will continue our discussion of the Capital Improvements
Program.
