David Ta~n~er, Secretary I-I~stings Planning Commission 100 SIBLEY STREET, HASTINGS, MINNESOTA 55033 Phone 437-6921 OFFICE OF CItY ENGINEER MINUTES OF HASTINGS PLANNING COMMISSION MEETING HELD MONDAY, APRIL 24, 197Z Those present: Mr. Arland Siebrecht, Mr. Skip Soleim, Mr. Don Hallberg, Mr. Pat Wilson, Mr. Dave Tanner, Mr. Walt Petersen, Mr. Fred Trautmann, Mr. Frank Sieckert, Mr. Leo Schumacher, Jr. and Mr. Steve Gartzke Also present: City Engineer John Davidson, Citizens in regard to the Ackerberg apartment complex, Mr. Robert Meters, Mr. Robert Schornmer, and members of the radio and press. There is a correction to be made to the minutes of April 10, 1972. Correct these to: Include Mr. Arland Siebrecht present Paragraph 3, Supgaragraphi, to read side yard must not be less than 30" Last paragraph under the enforcement Subdivision ordinance, add the word "ordinance". It was moved by Mr. Hallberg, seconded by Mr. Siebrecht to approve the minutes as corrected. Mr. Robert Meier was present to answer questions in regard to his request for Special Use or Re-zoning of his parcel along the south side of T. It. 55. (See copy of letter attached dated April 17, 197Z) (Copies to Mr. Trautmannms committee) There was a question raised as to the sale of land for South Frontage Road right- of-way. The Engineer in his presentation stated that this would be along and adjacent to the future frontage road system, the right-of-way to be acquired by State-Aid funds. Mr. Meier stated that the land now does have access to T.H. 55 over the 76 foot easement which was provided the City for the present connection to T.H. 55 at Prairie Street. The road itself would be used only as a limited access to T.H. 55. The plan in the future would require that the frontage road be extended to the east, in which case the Meters indicated they would furnish right-of-way at a cost to the City for street frontage road purposes. However, he stated that his plan should include setbacks, taking this future frontage road into account so that the frontage road can be extended in the future. It was then referred to the study committee of Mr. Trautmann, Mr. Siebrecht and Mr. Petersen. There was a request by Mr. Robert Schommer for a Variance to the Zoning Ordinance to allow him to construct a 20 foot addition to the property at Z04 E. 3rd Street. (See copy of letter attached). (Furnish copies to Mr. Wilson's committee) This was referred to as the Verna Dodge home. The addition would be to the front of the house, there would still be adequate setback, it would provide at least as much setback as the houses adjacent on either side. This was then referred to the study committee of Mr. Wilson, Chairman, with Mr. Tanner, Mr. Soleim~ and Mr. Willeke. (Check out the committees and Mr. Trautmann's Junior member). There was some question as to whether the frontage road system would be a negotiable item in lieu of 5% parkway for the north-south service road. It was then moved by Mr. Siebrecht, seconded by Mr. Hallberg that the metes and bounds dedication of land for Mr. Held's bus garage be approved subject to the dedication of the 33 feet, one-half right-of-way for the north-south street through the Held and Star Realty property. Also, the negotiation for the east- west roadway from the north-south road to Pine Street. There was a report from the Natural Resources Commission for the Capital Improvements Program. (See copy of that budget and 5-year Capital Improve- ment Report attached). (Make copies to send to Mr. Darrel Berkowitz at TKDA.) Chairman Petersen read a letter from the Hastings Area Chamber of Commerce recommending the township form a Hastings area Chamber of Commerce. (See copy of letter attached) (Get copy from Walt Petersen or Mr. Pellant). The Ackerberg Phase I development was discussed. Chairman Petersen gave a brief review of the action that has taken place to date and suggested that a motion be made to reaffirm the 1969 action recommending approval. It was moved by Mr. Sieckert, seconded by Mr. Trautmann. Discussion was open. Councilman Hallberg stated that there is a significant difference and that considerable time lag has elapsed since the action taken in 1969 and several people were present who are wishing to be heard. He would suggest that they be given a chance to explain their position. Mr. Tanner stated that he would move to allow rebuttal from the floor. Mr. Richard Hayes acting as spokesman for the property owners living on the south side of gZnd Street stated it was not their intend to deny the use of the land or change the zoning from the zoning approved some years ago, however, they did have several alternative suggestions that might allow a more orderly transition or at least a screening for the area between the residential single family dwellings and the multiple dwelling unit. (See copy of their alternative suggestions attached). Mr. Frank Pratt was present who had recently purchased a home from Star Realty who was told there would be no apartment in that location. Mr. James Vandervest, stated that he was not told that there would be apartment units adjacent to his home. There was discussion about the unit density. The Engineer stated that he and the attorney in reviewing the Zoning Ordinance in 1970 with Mr. Ackerberg did state that we would consider his complex on a total complex basis, in which case the density requirements could be met as planned. However, since that time the area of Country Village 1st Addition, north of Z3rd Street, was finally platted, the utilities were installed and Mr. Ackerberg has been making payments on both taxes and the special assessments to service the area. It was moved by Mr. Traut- mann to limit debate. The motion died for lack of a second. Mr. Hallberg then moved an amendment to the original motion that provisions for park dedication, development density regulations be enforced into the undeveloped area to the south, Minutes of Hastings Planning Corrnmission Meeting held Monday, April 24, 1972 lVage 3. and that the screening be assured. Mr. Wilson seconded the motion. There was a discussion on the requirements of screening as outlined in the alternative methods by the homeowners present. It was suggested that fencing, planting, or a combination could be worked out with the contractor. The Engineer stated that he was sure that the developer would work with the engineer and provide a screen if required. Special Covenance would be filed with the land to meet the density requirements of 32Z units on the balance of the Z3 acres after Phase I development was complete. Density would be in accordance with the new Zoning Ordinance regulations. That motion with the amendment was unan- imously passed. We discussed in some detail the development contract. The resolutions passed with amendments and unanimously passed by the Planning Commission. There was a request from Mrs. Leona McNeal, 900 W. 3rd Street, which is on Prairie, between Znd and 3rd, to put a larger size trailer than the present 10' x 35' size on that location. This was turned over to the Study Committee chaired by Mrs. Linde, with Mr. Sieckert, Mr. Hallberg, and Mr. Willeke. There was a request by Mr. Sieckert to withdraw as chairman of that study committee and Mrs. Linde was appointed. (Make a note that this goes on the agenda at the next Council meeting). The next item of discussion was the fact that we should send Vermillion Township notices of our ad hoc special meetings and invite them to be a part of the Hastings area planning and send them an invitation as extended to the other townships. Send a note stating we did not intend that they be left out of the discussion. Walt Petersen stated that he had a brochure from the State outlining the joint exercise of Power Act. We would not be going that far with this ad hoc Planning Commission, but it would be some valuable information that can be used in the ad hoc Planning Commission concept. Mr. Petersen also stated he had a book on Environment, a hand book put out by the Bank of American, which is on file in the Engineer's office for those who wish to review it. There was an official request by Mr. Murray Laub of Master Industries to again vacate the alley south of Master Industries and include the 10 feet south of the alley that is owned by Master Industries. The company has recently received a government contract for making paint roller skins which will require an expansion of the present facility and add Z0 to 30 jobs to the present operation. It was asked that the City Clerk or City Engineer prepare for the Planning Commission a complete list of ordinances relative to streets and alleys and vacation of the same, the State Statutes relative to vacation of streets and alleys, and what right the City would have to sell property that is vacated under such acts or statutues. It was also requested that the City look into the Erlcksonproperty, requiring they clean up the Lund Ski Factory onSecond Street, knock down the walls and fill the base- ment areas. Next the Engineer unofficially presented the plat of Dakota Hills 3rd Addition which will be presented to the Council at their next regular meeting for referral. This was delegated to Mr. Wilson's subcommittee. There was a request from Kugler-Fluegel for platting in the area of Southview Drive and Louis Lane. There was some discussion about traffic along ZZnd Street, continuity of the traffic systems in the area. It was ~aoved by Mr. Trautmann, seconded by Mr. Sieckert to recommend approval subject to payment of cash in lieu of parkland and compliance to Subdivision and Zoning regulations. However, it was pointed out that the plat does lie partly within the presently defined Flood Plain and as such could not be approved, unless the area were taken out of the Flood Plain. It was moved by Mr. Tanner, seconded by Mr. Wilson to table to rezoning, and unanimously agreed to meet with Mr. Fluegel and discuss the Flood Plain aspects of the plat.
